We are reviewing the application for the above referenced project, and in order to complete the review, some
additional information is required:
1. Please provide more details regarding avoidance and minimization of the roadway crossing impacts for this
project. It appears that the road crossing in Impact Area 1 could be moved or reconfigured to avoid the impacts
to the stream and riparian buffers. Please revise the plans to avoid the impacts or provide a detailed explanation
of why this plan for the activity cannot be practically accomplished, reduced, or reconfigured to avoid impacts to
the stream and riparian buffers. [15A NCAC 02H .0506(b)(1)]
Street "B" will serve as a main artery road for the community. Avoiding the current buffer impacts would result in the
creation of dead ends / cul-de-sacs, which would hamper the community's traffic flow during peak hours and are not
allowed, per local development standards. Also, the street is placed in a position that avoids open water impacts to
pond PA and provides essential road connectivity for the development. The east end of Street "B" will connect to other
existing/approved road alignments, which will provide required ingress/egress connections for the community.
2. The application states excavation of the 9 feet of intermittent stream channel and the map indicates fill of the
stream section. Please confirm which impact type will be occurring to this section of the stream shown in
Impact Area 1.
The permanent impact will consist of fill.
3. Sections C.6 and D.6 of the application indicate the road crossing requires buffer mitigation and that an SOA is
"in the works" for buffer credits. Please provide a status update on the SOA.
The buffer mitigation requirement stated in the original submittal was an error. Buffer impacts at this perpendicular
road crossing total 0.19 acre. Pursuant to the Neuse Buffer Rules' Table of Uses (15A NCAC 02B .0714(11)(y)(ii)),
perpendicular road crossings that impact "equal to or less than on -third of an acre of riparian buffer" are "Allowable
Upon Authorization" (i.e. mitigation is not required).
4. Please provide more information regarding the sewer line crossing impacts.
a. Will this line be connecting to an existing line owned by the Town?
Yes, the line will connect to an existing municipal wastewater collection system.
b. The application has impacts listed as temporary. Will this be turned into a permanently maintained
easement, or will this be revegetated after the temporary impacts for construction?
The easement will be revegetated and herbaceous vegetation will be permanently maintained after construction.
Please provide a complete response within 30 days of receipt of this email.

basin had any wetland credits available. We initiated an ILF mitigation request with NC DMS but have not yet received a
response. Could you please extend the comment response period so that we may provide an SOA from DMS?

Thank you for your Preconstruction Notification (PCN) and attached information, dated 8/9/2022, for the above
referenced project (please use the updated PCN form in the future). I have reviewed the information and need
clarification before proceeding with verifying the use of Nationwide Permit (NWP) 29.
Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification,
otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and
close the file:
1) Cumulative permanent wetland impacts for this project exceed the 0.lacre threshold per Nationwide Permit General
Condition 23c, and therefore compensatory mitigation is required. Please submit a compensatory mitigation plan. The
mitigation rule generally prescribes purchasing wetland credits first through a mitigation bank with wetland credits
available in this 12-digit HUC, or second through the NC Division of Mitigation Services; please provide a mitigation
acceptance letter from your proposed compensatory mitigation provider. Typically, compensatory mitigation is required
at a 2:1 credit to impact ratio unless otherwise justified based on evaluation of aquatic function.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.

Thank you for your Preconstruction Notification (PCN) and attached information, dated 8/9/2022, for the above
referenced project (please use the updated PCN form in the future). I have reviewed the information and need
clarification before proceeding with verifying the use of Nationwide Permit (NWP) 29.
Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification,
otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and
close the file:
1) Cumulative permanent wetland impacts for this project exceed the 0.lacre threshold per Nationwide Permit General
Condition 23c, and therefore compensatory mitigation is required. Please submit a compensatory mitigation plan. The
mitigation rule generally prescribes purchasing wetland credits first through a mitigation bank with wetland credits
available in this 12-digit HUC, or second through the NC Division of Mitigation Services; please provide a mitigation
acceptance letter from your proposed compensatory mitigation provider. Typically, compensatory mitigation is required
at a 2:1 credit to impact ratio unless otherwise justified based on evaluation of aquatic function.
