So, we are supposed to authorize the project under the permit requested, so the purpose of comment 1 was to see if the applicant had any objection to using NWP 14 when needed. Based on my review it appears that the Corps could authorize impacts at Impact Area 1 under NWP 14 and the rest of the project under NWP 29. Sean forwarded me your email – I was the one who submitted the application and have been coordinating with the client and designers. What do you need from us? Could we propose the road crossings under the NWP 14? There are 2 proposed crossings, but I think only the entrance road from Buckhorn Duncan is within the 100-year floodplain. Admittedly, I thought as long as the project met with the requirements of FEMA and a “no rise” that it would be ok. Based on a review of “FRIS” it appears that the proposed project will discharge fill material within the 100 year floodplain with an above grade fill, which is prohibited by regional condition C. b. The proposed activities could potentially to be authorized under NWP 14. 2. Based on the proximity of the proposed project to the study listed “Burt Farm (WA0538)” the Corps will initiate review from the State Historic Preservation Office to ensure that the project is in compliance with General Condition 20.
