Atlas Environmental staff completed the delineation on May 3, 2022 and assessed the presence of one intermittent channel, five abutting wetlands, two adjacent wetlands, and one isolated wetland. Lyle reviewed the delineation on September 1, 2022. The review area mostly consists of forested land and agricultural fields along with a sewer line that runs horizontally through the Northern portion of the property. The intermittent channel feature (CH 100) originates within the Northwest portion of the review area and flows off property along the Northern boundary. Wetlands WL 1000, WL 1100, and WL 1200 are all abutting CH 100, while WL 1300 was observed as an adjacent wetland. Wetlands WL 2000 and WL 2100 were observed to be abutting the upper end of a jurisdictional feature that is off property. WL 2200 is an adjacent wetland to WL 2100. The remaining wetland (WL 3000) was determined to be an isolated wetland as it does not have a hydrologic connection to any Corps - jurisdictional features. The project purpose is for the construction of a single industrial warehouse building and associated truck and trailer parking, employee parking, stormwater treatment, utilities, railroad spur, and additional required infrastructure. The building is approximately 120,000 square feet and has been designed and engineered to avoid and minimize impacts to aquatic resources to the greatest extent possible. The size and positioning of the building, parking, and stormwater has allowed the avoidance of the stream and wetland features along the stream within the review area. Four impacts are proposed for the construction including three Corps/DWR wetland impacts as W1, W2, and W3 as well as and one isolated wetland impact as W4. Impact W1 is 0.002 acre of permanent fill to wetland WL 2000. Impact W2 is 0.054 acre of permanent fill to wetland WL 2100. Impact W3 is 0.036 acre of permanent fill to wetland WL 2200. No impacts are proposed to the intermittent stream on site. Corps wetland impacts do not exceed 0.10 acre so no Corps mitigation is required. Corps wetland and isolated wetland impacts total 0.124 acre so DWR wetland mitigation is required. The wetland impacts occur within two adjacent HUC's — the Deep 03 (isolated impacts 0.032 acre) and the Lower Yadkin 03 (Corps impacts 0.092 acre). Although no archaeological resources have been previously recorded within the project area, only a small portion of the project area has been systematically surveyed for the presence of archaeological resources. The project area includes landforms and soils adjacent to Muddy Creek that have a high probability for archaeological sites, and we expect the project area may contain intact, significant archaeological sites. Prior to the initiation of any ground disturbing activities within the project area, we recommend that a comprehensive archaeological survey be conducted in areas of high archaeological potential by an experienced archaeologist. The purpose of this survey will be to identify any archaeological sites that may be damaged or destroyed by the proposed project and make recommendations regarding their eligibility status in terms of the National Register of Historic Places. Potential effects on unknown resources must be assessed prior to the initiation of construction activities. This work should be conducted by an experienced archaeologist, who meets the Secretary of the Interior Professional Qualifications. If you are only searching for a list of species that may be present in the project's Action Area, then you may use the Service's Information, Planning, and Consultation System (IPaC) website to determine if any listed, proposed, or candidate species may be present in the Action Area and generate a species list. With regard to the above -referenced project, we offer the following remarks. Our comments are submitted pursuant to, and in accordance with, provisions of the Endangered Species Act. Based on the information provided and other information available, it appears that the proposed action is not likely to adversely affect any federally -listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Act at these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for your project. Please remember that obligations under section 7 consultation must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. However, the Service is concerned about the potential impacts the proposed action might have on aquatic species. Aquatic resources are highly susceptible to sedimentation. An erosion and sedimentation control plan should be submitted to and approved by the North Carolina Division of Land Resources, Land Quality Section prior to construction. In addition, we recommend maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site. The North Carolina Wildlife Resources Commission (NCWRC) has developed a Guidance Memorandum (found at https://www.ncwildlife.org/Conserving/Learn-Resources/Ways-to- Conserve) to address and mitigate secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality. The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to accept payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please note that this decision does not assure that participation in the DMS in - lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is calculated based upon the Fee Schedule and policies listed on the DMS website. Based on the information supplied by you in your request to use the DMS, the impacts for which you are requesting compensatory mitigation credit are summarized in the following table.
