Hi Dave,
1) Yes, Wed Jan 14 looks good for me for the field verification. Wetland YG is within the 100 -yr floodplain of the river, but
evidence of ground- surface flow and hydric soil indicators in this wetland fizzle out approximately 70 feet from the river's
OHWM (right bank). From that point to the river's edge appears to be non - wetland levee with no discernable flow
channel. I believe this makes YG "isolated" as stated in the PCN, but we can certainly examine and reassess my
determination on Jan 14.
3) Regarding size of the intake, Since YG is at the bottom of the ravine, it will be unavoidably impacted by channel
excavation regardless of the size of the intake. The other potentially size - related impact is the length of riverbank
affected. By copy of this email I will let engineer Paul Stimpson explain whether the length of riverbank that needs to be
excavated and block - stabilized would be any less if the project were sized to serve Yanceyville only.
4) 1 will forward the US -FWS response and any related correspondence when I receive it from John Ellis and Sarah
McRae. We've also been including Shari Bryant at NC -WRC in the loop on US -FWS email exchanges.
5) 1 will send you PDF maps of the four SHPO- concern properties along NC -62.

Thanks for your PCN and attached plans dated 11/22/2013, received 11/28/2014, for the above
referenced project. I have reviewed the information and need clarification before proceeding
with verifying the use of Nationwide Permit 12

1) I would like to schedule a JD site visit to verify the location of waters of the US in
the proposed project footprint. In particular, I cannot verify that wetland YG is
isolated given the information submitted; the Dan River is a Traditionally Navigable
Water, so wetland YG only has to be considered Adjacent to fall under CWA section 404
jurisdiction. A field review will be necessary for this determination. I will also
view the remainder of the proposed corridor while on site. I have Wednesday January
14, 2014 at 10am available for a site visit; please confirm that this date /time works
for you.
2) Please note that any changes in boundaries to waters of the US during the JD site visit
may alter proposed impact estimates, and thus may require changes to the PCN form and
plans.
3) As we discussed on our 9/10/2014 meeting, the pump station /water intake is designed for
a much larger distribution than what is currently proposed for the Yanceyville WTP raw
water line. Please evaluate whether or not minimization of impacts would be
practicable in designing a pump station /water intake for only the raw water line
currently proposed. If minimization of impacts is not practicable, please explain
why. i.e. would the intake pipe be smaller if designed only for the Yanceyville raw
water line, and, if so, would any of the proposed impacts be reduced due to smaller
intake channel, etc.? (Nationwide Permit Condition # 23 a and b)
4) Please forward the USFWS response once received regarding the Roanoke logperch and
James spinymussel, as we must reach an effects determination (and potentially consult
with the USFWS) prior to verifying the use of a Nationwide Permit. (Nationwide Permit
Condition # 18)
5) Regarding cultural resources, please provide more information on the location of the
properties of concern versus the location of the proposed impacts, as this will
determine the level of consultation required from the USACE. (Nationwide Permit
Condition # 20)
Please submit the requested information (via e -mail is fine) within 30 days of receipt of
this Notification, otherwise we may deny verification of the use of the Nationwide Permit or
consider your application withdrawn and close the file. If you have any questions please
let me know.
