Mr. Ross has indicated in his remission request that his waste application system has operated without an -approved CAW since at least 1999. On April 16, 1999, Soil and Water Conservation conditionally approved the waste management system for the Ross Dairy. That certification was conditional pending the purchase and installation of irrigation equipment. In a letter dated October 14, 1999, Division of Soil and Water Conservation completed the CAWMP certification process, thereby certifying that the irrigation equipment was in place and "capable of applying waste at rates that do not exceed those specified in the CAWMP". Mr. Ralph Ross received a cow copy p9this letter. $1000 was remitted from the original amount since Ross reportedly obtained technical assistance in correcting the issues with his irrigation system. Ralph Ross signed the conditional approval of the animal waster application plan on April 16, 1999. Additionally, Mr. Ross signed the waste utilization plan on October 9, 2000 that states "waste will be applied on the land according to this plan at the appropriate times and at rates that no run-off occurs. In summary, we the Division believe that the civil penalty amount assessed and that amount already remitted is fair and in accordance with all applicable rules and regulations. The corrections are for year 2006 vice 2007 and are. underline below. All other report information contained in the annual report dated 2/21/07 is correct and not included with this corrected cover letter. Enclosed is the annual ash distribution report for calendar year 2006, using the forms provided by NCDENR-DWQ. During 2006, ash was distributed in only one form. Flyash that was settled in the scrubber ponds was mixed with flyash from the multicyclone and dry wood to reduce the moisture content. The ash was distributed for land application in this form. Average moisture content was obtained from several samples collected and .analyzed periodically throughout the year. A composite sample was collected for chemical analysis from the final product prior to distribution. All samples were analyzed by Pace Analytical Services, Inc., a North Carolina -certified laboratory. Notification was made to the DWQ on February 9, 2007 for the. following issues: North Pond Ash was distributed in January and February 2006 and was not sampled in accordance with the SOP which required analysis prior to distribution. In addition, only one sample was taken and tested where the SOP required two samples to be processed.
