Hi Jennifer,

When Version 3 was processed, whoever was listed as the primary contact would have received an email with information on how to pay the fee.

Typically projects are submitted with all impacts at the same time instead of multiple small projects back to back. Version 3 will be reviewed in the order that it was received. I anticipate
that the review of Version 2 will be complete will before I begin my review of Version 3.

Good Morning Colleen,

I’m happy to report that our Pre-Filing requirement has been met and the ePCN was submitted yesterday for Version 3. To the best of my ability I determined that the NWP 3 (Version 2)
is still under review, per the edocs link you had previously provided. So I have the following questions:

1. Do I pay now or wait until I receive an email (like the email request on edocs for Version 2) requesting payment? I just don’t want to hold up the process.
2. With the NWP 3 not being issued yet, will that delay the processing time of the Version 3 application? If so, any thoughts on what the delay may look like or timeline we are looking
at? I would like to update the client so expectations are appropriate.

The old pre filing meeting request form is no longer available.

In the top section about “Additional Requirements for 401 Certification….” there is a link to the new email address that should prompt you with the requirements when you click on it.
The email address should provide an automatic confirmation of receipt, but I would recommend CC’ing yourself for a copy as a backup. You’re also welcome to CC me.

That is confusing. Based on that information, it sounds like you do need a pre-filing meeting request as it appears what you are working on is not associated with the current impacts
being reviewed and are not part of the Version 1 application. New impacts would be a Version 3, not a re-opening of Version 1.

To the best of my knowledge my permitting should be associated with the NWP 29, so Version 1. My anticipation was to expound upon the original application for the NWP 29 as I believe
we should still be under thresholds. There will be additional buffer impacts to both zones to report for my activities. My activities have nothing to do with the Dam repair therefore
I do not anticipate there to be changes to Version 2 based off of my permitting needs.

As far as I am aware I do not know of future additional changes, however we are only handling specific tasks for the client and are not the project management consultant. The way the
project has unfolded has resulted in several hands in the pot, which for permitting purposes makes it a bit redundant and more confusing, lol. I’m just trying to make sense of it all.

The issued 401 is a NWP29 with dredging impacts only. (Thanks for verifying – I wanted to make sure I was indeed looking at the right project and hadn’t missed a change in NWP number!)

The 401 application currently under review is a NWP 3. If what you’re working on is revisions based on the CURRENT 401 application that is in house then my understanding is no, you do
not need a pre-filing meeting.

HOWEVER if you’re working on what will be a Version 3, then yes, a pre-filing meeting request would be required. You can submit the request to [e-mail] <mailto:[e-mail]>

Do you know which version you’re working on? Are there more changes coming to Version 2?

Is this the Hsu Pond project (DWR#20211818 https://edocs.deq.nc.gov/WaterResources/Browse.aspx?dbid=0&startid=2120117)? A version 1 was issued using NWP 29 on 2/17/22 for dredging in
the pond, and a Version 2 is currently under review under a NWP 3. The USACE requested additional information for the Version 2 on 4/5/22.

I do not see a NWP 23.

Hi Colleen,

I’m preparing a permit application for the residential property at 9313 Macon Road in Raleigh, NC, for structures that will allow the owners to enjoy their pond. Recently, Kris Bass
handled permit coordination regarding dam repair on the property and was issued a NW 23 on 3/1/22 from USACE (SAW-2016-01125). I assume a corresponding 401 was also issued at this time?

If a permit has already been issued will I need to submit a Pre-Filing Request for my additional permit needs? I know there has been some recent changes governing this so I wanted some
clarification.
