Enclosed is the annual as distribution report for the calendar year 2010, using the forms provided by NCDENR-
DWQ. During 2010, ash was distributed in two forms:
1. Fyyash that settled into the scrubber ponds was mixed with flyash from the multi -cyclone, bottom ash, and
dry wood to reduce the moisture content. The ash was distributed for land application in this form. See the
ash distribution records for a list of recipients.
2. Bottom ash from the boiler grate was also distributed. This ash was hauled in a very dry form and used as a
soil amendment in a commercial operation. A composite sample was collected and Total metals and TCLP
were performed before distribution. Additionally, bottom ash was mixed with pond ash to help reduce the
moisture content.
All samples were analyzed by Pace Analytical Services, Inc., a North Carolina certified laboratory.

Baxter Healthcare. Corp., is the generator of the ash provided to _ 11 ?9
(Recipient). Application of the aforementioned ash is prohibited except in accordance with the
instructions on this sheet.
Dwnsj)orr: Adequate provisions shall be taken to ensure that the transportation of ash does not cause
nuisances and hazards to public health and safety or otherwise cause an adverse impact (e.g.. transport
wet ash in leaf -proof trucks or cover dry ash).
.Storeqe: The ash shall be adequately stored to prevent wind erosion or surface runof!' from carrying ash
into any surface waters. Keeping the ash slightly moistened will accomplish this objective under normal
conditions. However, berms, barriers, or tarps, may be necessary under windy or rainy conditions or ii
erosion or runoff cannot be controlled.
,rfpn/icuPion: When using ash, the following shall apply:
a The ash application rates shall be limited to those that can be agronomically justified (i.e., limited to
that needed to meet the liming requirements of the crops being grown on the land).
o Ash shall not be placed within 50 feet of any surface water.
® Ash shall not be placed within one foot of the seasonal high water table.
* Ash shall not be placed within 100 feet of any water supply well or spring unlCss underlain and
overlain by a liner with a maximum hydraulic conductivity of 1 Q"' centimeters per second. if such a
liner/cover is provided, ash shall not be placed within 25 feet of any water supply well or spring..
© The ash shall not be applied to any site that is flooded, frozen, or snow-covered.

laboratory results are available upon request.

Baxter Healthcare, Corp., is the generator of the ash provided to .J _�r��r
(Recipient). Application of the aforementioned ash is prohibited except in accordance with the
instructions on this sheet.
Trcmporr: Adequate provisions shall be taken to ensure that the transportation of ash does not cause
nuisances and hazards to public health and safety or otherwise cause an adverse impact (e.g., transport
wet ash in leak -proof trucks or cover dry ash),
SiorcrsAe: The ash shall be adequately stored to prevent wind erasion or surface runoff from carrying ash
into any surface waters. Keeping the ash slightly moistened will accomplish this objective under normal
conditions. However, berms, barriers, or tarps, may be necessary under windy or rainy conditions or if'
erosion or runoff cannot be controlled.
Applic-crtion. When using ash, the following shall apply:
* The ash application rates shall be limited to those that can be agronomically justified (i.e., limited to
that needed to meet the liming requirements.of the crops being grown on the land).
Ash shall not be placed within 50 feet of any surface water.
a Ash shall not be placed within one foot of the seasonal high water table,
* Ash shall not be placed within 100 feet of any water supply well or spring unless underlain and
overlain by a liner with a maximum hydraulic conductivity of 104' centimeters per second_ Irsuch a

Baxter Healthcare, Corp will have no responsibility and shall not be held liable by Recipient or any third
party for any spill, misuse, misapplication or other mishandling of the ash. Recipient acknowledges and
agrees that the ash is being delivered by Baxter Healthcare, Corp to Recipient as an accommodation to
Recipient. in exchange therefore, Recipient agrees to indemnify, save and hold Baxter Healthcare, Corp
harmless from and against any and all liability, damage, loss, cost, expense (including attorneys' fees),
claim, demand, suit, action, judgment or recovery asserted against Baxter Healthcare, Corp by any third
Marty, including any governmental authority, whether for bodily injury (including death) or damage to
property. arising from or in connection with Recipient's receipt, transportation, handling or other use of
