On behalf of Crosswinds Development, Inc., we are requesting authorization from NCDWR for 1,292
sq ft of permanent buffer impacts and 3,103 sq ft of temporary buffer impacts for construction of a
sanitary sewer line serving the proposed Logan's Manor subdivision in Holly Springs, Wake County.
The proposed Logan's Manor subdivision is located at 634 Bass Lake Road in Holly Springs, NC
(35.6414 0N, - 78.8126 1W). The proposed impact for the sewer outfall will occur on a ±116.4 acres
parcel owned by the Town of Holly Springs (Wake Co PIN #o658574596), which has a conservation
easement held by the Triangle Land Conservancy. There is an existing sanitary sewer interceptor
line on the northern portion of the property, extending along the southern bank of an Unnamed
Tributary to Basil Creek (Bass Lake) in the Neuse River Basin. The Water Quality Classification for
Basil Creek (Bass Lake) is Class B, NSW and the Stream Index Number is 27-43-15-3• The cataloging
unit for the site is 03020201.
Proposed Project
The proposed project consists of the construction of a new 8 -inch sanitary sewer line, which will
serve the proposed Logan's Manor subdivision on Bass Lake Road in Holly Springs, NC. The new
sewer line will extend from the proposed Logan's Manor subdivision to the north, through the parcel
owned by the Town of Holly Springs (PIN #o658574596) and connect to the existing sewer line on
the south side of the perennial stream. The new line will be installed using jack and bore in order to
avoid impacts to the stream. The only proposed impacts will be to riparian buffers for installation of
the sewer line and establishment of the 20' sewer easement. There will be no jurisdictional impacts
requiring 404/401 Permitting.
Project History
The proposed alignment for new sewer line the extension of Colby Chase Drive was reviewed for
wetlands by W &R in January 2013. The review of the proposed alignment determined there is a
stream (UT to Basil Creek) within the project area and no wetlands within the sewer alignment or
subdivision project area. The stream was determined to be subject to the Neuse River Riparian
Buffer rules.

Proposed Impacts
The proposed impacts consist of 1,292 sq ft of permanent impacts to riparian buffers (Zone 1: 769 sq
ft; Zone 2: 523 sq ft) and 3,103 sq ft of temporary impacts to riparian buffers (Zone 1: 1,461 sq ft;
Zone 2: 1,642 sq ft) for the construction of a new sanitary sewer line serving the proposed Logan's
Manor subdivision which will tie into an existing interceptor line. The proposed permanent impacts
will occur from establishment of the 20' sewer easement and perpetual maintenance of the entire
2o' easement. The proposed temporary impacts will occur from the establishment of a 20'
temporary construction corridor on each side of the easement in order to allow for construction
activities associated within installation and connection of the proposed sewer line.
The new line will be installed via jack and bore and will not result in impacts the buffered stream. No
wetlands were present within the alignment or within the subdivision project area.
Avoidance and Minimization
The proposed sewer line been designed to connect to the existing interceptor line at an existing
manhole in a location providing for minimal impacts to the riparian buffers. Please note that the
proposed sewer alignment will cross the riparian buffers at greater than a perpendicular angle (750 -
100. As a result of the existing interceptor line being so close to the stream, the proposed sewer
alignment could not be designed for a perpendicular crossing without resulting in a 9o° connection
the interceptor line. A 9o° sewer connection is typically avoided due to the higher risk of blockages
and backups. Therefore, the proposed sewer alignment could not be designed as a perpendicular
crossing, and the application is proposing mitigation for "non- perpendicular" impacts.
The proposed sewer line will be installed via jack and bore to avoid impacts to the buffered stream.
Mitigation
The proposed sewer crossing is non - perpendicular, which is identified as "Allowable with
Mitigation" in the Neuse River Riparian Rules Table of Uses. Therefore, the applicant proposes to
purchase 3,091.5 sq ft of riparian buffer mitigation from EBX. A copy of the EBX letter of Reservation
has been provided as an Appendix.
The current request is for 1,292 sq ft of permanent impacts and 3,103 sq ft of temporary impacts to
riparian buffers (see the attached maps and Authorization Form for details).

for construction of a sanitary sewer line on the adjacent, down - gradient parcel (Impact Parcel) owned by Town
of Holly Springs. The impact parcel and two subdivision parcels are currently undeveloped /agricultural use.
The general land use in the vicinity of the project consists of a mixture of residential land use.

Stream Buffer Determination Letter (NBRRO #13 -004) issued by NC DWQ on Feb 7, 2013. The Buffer
Determination letter is included with this submittal.
Withers & Ravenel conducted a wetland delineation of the proposed project, including the subdivision and
sewer outfall, and determined that there were no wetlands within the project area. As a result of the
installation of the sewer line below the stream using jack and bore, there will be no impacts to jurisdictional
features and a formal Jurisdictional Determination from the Corps is not required.

location providing for minimal impacts to the riparian buffers. Please note that the proposed sewer alignment
will cross the riparian buffers at greater than a perpendicular angle (75° - 105 °). As a result of the existing
interceptor line being so close to the stream, the proposed sewer alignment could not be designed for a
perpendicular crossing without resulting in a 90° connection the interceptor line. A 90° sewer connection is
typically avoided due to the higher risk of blockages and backups. Therefore, the proposed sewer alignment
could not be designed as a perpendicular crossing, and the application is proposing mitigation for "non -
perpendicular" impacts.

techniques.
Silt fencing will be installed around all disturbed areas to prevent accidental impact and sedimentation of
undisturbed buffers. Necessary equipment and materials will be staged in uplands. Access to work area will be
from uplands. Installation of the sewer line will be through subsurface boring, eliminating open -cut impacts to
jurisdictional stream.

This document confirms that Crosswinds Development, Inc. (Applicant) for the Logan's Manor
Project has expressed an interest to utilize 3,091.5 Square Feet of Riparian Buffer Mitigation
Credits from either of the EBX Neuse Riparian Buffer Umbrella Mitigation Bank (Nahunta Site)
located in the Neuse HUC 03020201. As the Bank Sponsor for the site, EBX attests to the fact
that mitigation is available for transfer upon permit issuance at this time.
Banker will notify applicant if the 3,091.5 Square Feet of Riparian Buffer Mitigation become
considered "At Risk" of not being available prior to permit issuance. Credits are not considered
secured until payment in full is received from the applicant resulting in the issuance of a and
Affidavit of Sale by the bank acknowledging that the applicant has fully secured credits from the
bank and the Banker has accepted full responsibility for the mitigation obligation requiring the
credits /units.
The Banker will issue the Affidavit of Sale within three (3) days of receipt of the Purchase Price.
Banker shall provide to Applicant with a copy of the Affidavit of Sale and a documented copy of
the debit of credits from the Bank Official Credit Ledger(s) showing the permit number and the
resource type secured by the applicant. A copy of the Affidavit of Sale, with an updated Official
Credit Ledger will also be sent to regulatory agencies showing the proper documentation.
