Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The site is mostly undeveloped and forested. Historically the northern parcel has been used for silvicultural production. Several dirt roads extend throughout the site. One stream runs along the northwestern property boundary and two other streams are located in the eastern part of the site. Additionally, one stream and one wetland area bisect the parcel off Town Creek Road. Jurisdictional and non -jurisdictional wetlands are scattered throughout the site. Adjacent land use is residential or undeveloped and forested land. 4b. Have Corps permits or DWR certifications been obtained for this project (including all prior phases) in the past?* Yes No Unknown 4f. Explain the purpose of the proposed project: * The purpose of the project is to construct a residential subdivision within the tract to serve the housing needs of Brunswick County. Jurisdictional wetland and stream impacts are needed for road crossings to provide access throughout the site. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The project consists of constructing a residential development with 477 single-family lots. Stormwater ponds are planned throughout the site as well. The limits of disturbance will be cleared of vegetation and graded. Utilities and stormwater facilities will be installed. Homes will then be constructed. Track hoe, loader, dump truck, bob cat, and other standard construction equipment will be used. Note that the northern parcel and the parcel to the east used to be part of a larger parcel. The eastern parcel is now owned by Stanley Martin Homes. Although some roads from that development will provide access to this subdivision, they are independent projects. They have different ownership and are being developed by different entities. Both parcels have access to state roads and would be developed with or without the other project. The Town of Leland encourages interconnection of projects, which is why the two projects have shared roads. 5. Jurisdictional Determinations 5a. A JD has not yet been issued. Robb Mairs with NC DWR performed a stream determination on site. He also assessed the non-jd wetlands and determined that they were isolated and pocosin habitat. A stream and two wetland fingers run the entire length of the parcel that provides access off Town Creek Road and avoiding these features completely was not possible. Additionally, the Town encourages interconnectivity within a development to allow multiple ways in/out. Therefore, several crossings are needed to provide access to lots. Bridges were determined to be economically infeasible. Stream and wetland crossings were narrowed as much as possible in the design. 1 b. The NC Natural Heritage Program database was reviewed to determine if any rare species are known to occur on or near the site. According to their files, no federally listed species are known to occur within the site. There is one occurrence (1994) of the federally listed red -cockaded woodpecker within a one mile radius of the site. However, the northern site has been used for silvicultural production and has been periodically logged. The USFWS IPaC database was also reviewed and several species were identified as potentially occurring in the region. Many of these species require coastal and/or marine habitat and would not be found within the site. Channels on site do not appear to be large enough to provide suitable habitat for the American alligator. Forested areas within the site may provide suitable roosting habitat for the northern long-eared bat. Since no hibernacula or maternity roosting trees are known to occur in the area, any adverse effect from tree clearing would be exempt by the 4(d) rule. Portions of the site provide suitable habitat for the RCW and DRG performed a survey earlier this year. No cavity trees or birds were observed. See attached summary for additional information. 6. Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. Data limitations The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level information on the location, type and size of these resources. The maps are prepared from the analysis of high altitude imagery. Wetlands are identified based on vegetation, visible hydrology and geography. A margin of error is inherent in the use of imagery; thus, detailed on -the -ground inspection of any particular site may result in revision of the wetland boundaries or classification established through image analysis. r N�4 The accuracy of image interpretation depends on the quality of the imagery, the experience of the image analysts, the amount and quality of the collateral data and the amount of ground truth verification work conducted. Metadata should be consulted to determine the date of the source imagery used and any mapping problems. N Wetlands or other mapped features may have changed since the date of the imagery or field work. There may be occasional differences in polygon boundaries or classifications between the information depicted on the map and the actual conditions on site. Data exclusions ci k,.., Certain wetland habitats are excluded from the National mapping program because of the limitations of aerial imagery as the primary data source used to detect wetlands. These habitats include seagrasses or submerged aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and nearshore coastal waters. Some deepwater reef communities (coral or tuberficid worm reefs) have also been excluded from the inventory. These habitats, because of their depth, go undetected by aerial imagery. Data precautions Federal, state, and local regulatory agencies with jurisdiction over wetlands may define and describe wetlands in a different manner than that used in this inventory. There is no attempt, in either the design or products of this inventory, to define the limits of proprietary jurisdiction of any Federal, state, or local government or to establish the geographical scope of the regulatory programs of government agencies. Persons intending to engage in activities involving modifications within or adjacent to wetland areas should seek the advice of appropriate federal, state, or local agencies concerning specified agency regulatory programs and proprietary jurisdictions that may affect such activities. Pinewood Tract Brunswick County, NC RCW Assessment DRG evaluated the larger parcel to the north in February of 2022 to determine if the site provided suitable nesting or foraging habitat for the red cockaded woodpecker (RCW). This site has historically been used for silvicultural production. Most of the uplands within the site were cleared in 1998 and then thinned around 2017-2018. The majority of the site now supports a mix of longleaf and loblolly pine trees that are 4" to 8" DBH. These areas are generally too young and sparsely vegetated to provide suitable nesting habitat. However, some of the larger trees in these areas could provide suitable foraging habitat. The southcentral, northeastern, northwestern, and eastern portions of the tract support older trees that are 8" to 14" DBH on average. These areas appear to provide suitable nesting and foraging habitat for the RCW. Surveys were conducted in these stands of older and larger pines using USFWS protocol (walking line transects on a north - south orientation when possible). No cavities or RCWs were observed. The smaller tract located to the southwest (with access from Town Creek Road) was evaluated in October of 2022. Uplands within the site support a canopy of longleaf pines and a sparse shrub layer of turkey oak and laurel oak. Most of the longleaf pines were between 6" and 10" DBH, although a few were around 18" DBH. The pines were inspected for RCW cavities. No cavities or RCWs were observed. Since portions of the project area provide suitable foraging habitat for the RCW, adjacent forested tracts were evaluated from the project area to provide a cursory determination if they supported suitable nesting habitat for the RCW. Forested areas to the north are densely vegetated wetlands (adjacent to Beaverdam Creek) and unlikely to provide suitable nesting habitat for the species. Most trees have been cleared from the site to the east. Forested areas to the southeast that were visible from the project boundaries support mostly pine trees. However, these areas are fairly dense. A review of larger pines was conducted from the project area and no cavity trees or RCWs were observed.
