SUBJECT: CAMA Dredge/Fill Permit Application for James Ragan, Pamlico County,
North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 500 Block
of Midyette Street Oriental, NC adjacent Camp Creek. Our comments are provided in accordance with
provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as
amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as
amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.).
The applicant proposes to establish a 10-slip docking facility off an undeveloped lot in Oriental. A 5' by
80' pier would extend into the water and connect to a 5' by 70' dock and an angled 5' by 90' dock. The
two docks would have a total of five 3' by 20' finger piers and six mooring piles to create 10 wet slips. A
5' by 20' stepdown is proposed along the 5' by 80' pier to serve as a kayak launch. Water depths appear
to be near -1.5' NWL for the stepdown structure and approximately -4.5' NWL within the slips. No detail
was provided for the upland development. Camp Creek at this location is classified SC NSW HQW by
the Environmental Management Commission, is designated a secondary nursery area by the NC Division
of Marine Fisheries, and is subject to the Neuse Basin Buffer rules.
The NCWRC has reviewed the information available within the permit application and does not believe
there is adequate information with regard to purpose and need and potential impacts to conduct an
adequate review of the project. As currently proposed, there is no upland development, including access
and parking for the facility. The application indicated there are coastal wetlands on the site and is within a
nutrient sensitive water basin. Therefore, the unknown upland development may have unknown and

undue impacts on wetland habitats and riparian buffers. If this project proceeds, the following information
should be provided so the development can be reviewed as a wholistic project:
• Presentation of upland development that shows purpose and need for a 10-slip clocking facility.
This could be individual lots or designation of access for the facility.
• Wetland delineation for the site.
• Map that includes delineated wetlands, normal water level, AEC's, Zone 1 and Zone 2 of the
Neuse Buffer, and more detailed water depths, especially in the areabehind the spine of the
facility as it goes to the 5' by 20' stepdown.
• Means to deter docking for greater than 10 vessels. This may include rails on the back side of the
dock spine.
