The Director of the Division of Water Quality (DWQ) has assessed the Town of Parkton civil penalties for the
above listed enforcement cases. In order to resolve this matter, DWQ and the Town of Parkton agree to enter a
payment schedule to settle these civil penalties. • '
The Town of Parkton agrees to pay $500.00 per month for 43 months with a final payment in the amount of
$397.59 to satisfy the total civil assessment of $21,897.59 for the multiple violations described in the above
listed enforcement cases. The Town understands that any default in payment or failure to submit payment by
the day in ' which payment is due will result in the immediate referral of this case to the Attorney General's
office for collection through the courts. The TOwn of Parkton also acknowledges that DWQ is within its
authority and reserves the right to take enforcement action against the Town for future violations should they
bccur.

Mr. Pauls Rawls contacted me concerning the recent violations (TX 00-072, TX
01-009; TX 01-017) and discussed the subsequent fines totaling $10122.72. The Town
is requesting that this amount be added to our current balance and that we be allowed to
continue the monthly payments of $205.83:
At recent Town Board meetings, the Board discussed the regionalization of our
wastewater system. Roy Lowder, Public Works Director, contacted PWC to obtain
information on the proposed regionalization. The Board also passed a resolution to
apply for a grant, for completing a wastewater regionalization study and a 20-year capital
improvement plan.
The Town Board recognizes the potential for growth. in the next few years and
has discussed annexation with the Town Attorney and are looking to begin the process
within one year.
The Town Board, Roy Lowder, and I are working to eliminate any future toxicity
violations and hope that with constant monitoring this problem could be eliminated.,

In the last six months, the Town 'o 'ar'on a -d-six biotoxicity analyses
beginning with October and ending with March. However, the Town was in compliance
with the April anaysis.
The attached letter to Mr. Rawls outlines the NOVs, the town's efforts to
correct and prevent problems at the wastewater treatment plant and the costs incurred
for the repairs. Since that letter, Mr. Roy Lowder, temporary ORC, has begun adding
Calcium Thiosulfate for de -chlorination to combat our toxicity problem.
The following is a breakdown of the individuals who have assisted Mr. Lowder in
preventing future violations and subsequent fines:
. Technical Services: Dean Gaster (NCRWA), Don Register (NCDENR—
Fayetteville), Tony Arnold (NCDENR — Raleigh), Paul Rawls (NCDENR — Fayetteville),
Kevin Beoden (NCDENR — toxicity — Raleigh), Dale Lopez (NCDENR — toxicity).
Contractors: (a) Miller-Willette-McNaughten, Inc. worked to repair the
aerator and digester. (b) RonCo Electric completed the electrical work on the digester
and refrigerated sampler. (c) Carolina Technical Services installed the Endress +
Hauser Open Channel Flowmeter and Honeywell Recorder.
Supplies: American Development Corporation supplied the chemicals and
Taylor Sand Co. delivered sand for the drying beds.
Employees: Jack Coe is a new addition to our work force. The Local
Government Commission supplied us with a worker free of charge. Mr. Coe assists Mr.
Lowder with the general, daily upkeep of the wastewater treatment plant.
Though our history is speckled with violations and reflects poor management by
the former ORC, Mr. Leonard Green, it is evident that our temporary ORC, Mr. Roy
Lowder, has made every attempt to cooperate and rectify the situation.
Due to the costs incurred, the town is currently in a financial bind and payment of
these fines would surely bankrupt our already depleted account. If fines are enforced,
the town may not be able to provide these necessary services to our populace. We
request that the fines be waived and are willing to cooperate by providing financial
statements showing our current financial situation.

This assessment is based upon the following facts. A review of the facility's toxicity self -
monitoring data from January through March 2001 has been conducted. The review has shown The
Town of Parkton to be in violation of the 90% chronic toxicity effluent discharge limitation found in
NPDES Permit No. NC0026921. The Town of Parkton's toxicity self -monitoring reports for January
through March 2001 revealed the following violations.

The Division of Water Quality (DWQ) issues/reissues NPDES permits with whole effluent toxicity
(WET) limits. The current chronic toxicity test condition language requires permittees to conduct multiple
concentration testing upon a single quarterly failure to meet the chronic toxicity permit limit. Permittees with
NPDES permits which contain "old" chronic toxicity pass/fail testing language will have the OPTION to respond
to any single quarterly toxicity test failure with follow-up multiple concentration toxicity testing (as contained in
the current language) or single concentration toxicity testing, thereby influencing the level of DWQ's enforcement
response.
NOTE: Choosing to respond to a chronic toxicity "fail" result with a pass/fail test instead of conducting multiple
concentration toxicity testing during the second and third months. of the monitoring quarter (monitoring quarter
defined by your permit) will result in enforcement for single concentration test results that do not meet chronic
toxicity permit limitations.
Important WET Enforcement Policy items are:
I. CHRONIC TOXICITY TESTING
• The first test of the quarter can be conducted as either a pass/fail test or a chronic
value (ChV) test.
• If the pass/fail test fails or if the ChV is lower than the limit, then a Notice of
Violation (NOV) is issued and at least two ChV tests (one per month) will be
conducted over the following two months. As many analyses as can be completed
will be accepted.
• A NOV will be issued for ANY test result failing to meet the permit limit.
• Any civil penalties assessed will be based on performance over a quarter. Facilities
may be assessed civil penalties for any month in which compliance with the WET
limit is not achieved. DWQ's enforcement response can be influenced by conducting
multiple concentration testing for the second and third months of the monitoring
quarter. Chronic values for all follow-up tests will be averaged arithmetically. If the
average is >_ the chronic permit limit, then civil penalties will not be assessed for
monthly violations occurring during the quarter. If the average chronic value is < the
permit limit, the facility will be assessed civil penalties for each month during the
quarter in which compliance with WET was not achieved.
• NPDES Permits containing chronic toxicity pass/fail testing will be modified upon
permit renewal to include the new permit language.
II. ACUTE TOXICITY TESTING
• A NOV will be issued for each acute limit violation.
• A civil penalty will be assessed for any two consecutive acute limit violations.
If you are unable to consistently comply with your toxicity permit limitation, you may notify your
respective Regional Office to discuss the possibility of entering into a Special Order by Consent (SOC). The SOC .
provides conditional compliance for permit parameters with which the facility can not consistently comply and
may be issued in situations where facility operation and maintenance are not in question. If a SOC is signed by the
permittee/DWQ and contains toxicity as a noncompliant parameter, you will be required to: conduct a Toxicity
Reduction Evaluation (TRE), submit quarterly TRE progress reports and eliminate/reduce effluent toxicants so
that compliance with the whole effluent toxicity limit can be demonstrated.
