PROJECT SUMMARY: The applicant proposes to construct 924 linear feet of vinyl bulkhead along the peninsula, install a boat ramp, reconfigure the existing docking facility and conduct maintenance dredging within the existing marina basin Ttereve Enterprises Page 2 9 PROJECT DESCRIPTION- The project site is located at 120 Halls Point Road, adjacent to New River, in Sneads Ferry, Onslow County To locate the project site from the WiRO take US -17 N for approximately 29 miles and turn right on NC -172 Travel approximately 7 miles and turn right onto Wheeler Creek Road Travel along Wheeler Creek Road for approximately 1 mile and turn left onto Halls Point Road The project site will be located on the left hand side of the road, directly behind Riverview Cafe The property is surrounded by both residential and commercial development The property is adjacent to New River to the north and residential properties to the east and west Riverview Cafe borders the property to the south The highground portion of the property is developed and consists of a seafood house, formerly known as "Everett's Seafood" The shoreline is stabilized partially by an old wooden bulkhead and the peninsula portion of the property is stabilized by rip -rap and /or concrete rubble Existing water dependent structures include a series of both fixed and floating docks The existing seafood house appears to be partially located above the normal high water line, however, it is difficult to determine how far back normal high water extends At the very least, the waterward portion of the property is over high water Upland vegetation consists of sparse lawn grass and almost the entire lot is gravel and /or concrete The property is approximately 1 59 acres in size and has an average elevation of approximately 4 feet above mean sea level The entire project site has approximately 1,125 linear feet of shoreline frontage, most of which is stabilized by an aging bulkhead and /or concrete rubble The site's permit history from DCM and the Corp of Engineers is minimal Our only permit records for this site are from the year 1999 and only include maintenance dredging (General Permit No 19836) within the marina basin It is uncertain whether any permit records lie with Onslow County As evident by the prior statements, the original marina property was developed prior to CAMA regulations The property currently provides dockage for less than 25 slips, however, according to the May 13, 2014 pre - application meeting, the Division of Shellfish Sanitation stated that the marina could be expanded to accommodate approximately 50 vessels and /or slips The Onslow County Land Use Plan classifies the adjacent waters and high ground area as Community Growth Area and the water portions as Conservation There are no known archaeological sites located in the project vicinity The waters of New River are classified SA by the Division of Water Quality They are NOT designated as a Primary Nursery Area (PNA) by the N C Division of Marine Fisheries and they are CLOSED to the harvest of shellfish 10. PROPOSED PROJECT: The applicant proposes to construct approximately 924 linear feet of vinyl bulkhead along the peninsula and western most property line, add a new boat ramp, install a new docking system and perform maintenance dredging within the existing marina basin As proposed, approximately 40' of new bulkhead would be installed and tie into the existing bulkhead located along the western side of the property The new bulkhead would be required to accommodate the new 15'x 35' boat ramp, which would be constructed along the western side of the existing fish house /building Two "wing walls" would secure the shoreline around the perimeter of the ramp and would span approximately 20 foot toward the high ground, and approximately 20' into the water This portion of bulkhead would tie into the western corner of the existing building /fish house Further towards the eastern property boundary, the applicant proposes to install another new section of bulkhead Beginning at the existing wall, in the southeast corner of the marina basin, the applicant proposes to begin the installation of approximately 883' of bulkhead The wall would span toward the east and wrap around the entire peninsula, ultimately terminating along the eastern property line As designed, the new wall would be located landward of both the normal high water line and the upper limits of coastal wetlands Ttereve Enterprises Page 3 In addition to the bulkhead, a new series of floating docks would be constructed within the existing marina basin As stated by the applicant, the existing docks associated with the marina would be removed prior to any new construction In total, three (3) new spines would be installed (of varying sizes) along with twenty -seven (27) new finger docks Working west to east in the marina basin, the applicant proposes to install "dock 1 ", which consists of a 6' x 138' long spine Dock 1 would extend toward the north, from the area immediately adjacent to the proposed boat ramp, and turn and continue to the east, via a 6'x 124' floating dock (Dock 2) Approximately eight (8) finger piers would extend from Dock 2, in both a north /south orientation Each finger dock associated with Dock 2 would measure 5'x 30' Continuing east, along the northern side of the building, the applicant proposes to install Dock 3, which consists of a 6' x 64' access pier This pier would provide access to four (4) floating finger piers, each measuring 5'x 30' that would run north to south Further south of these docks, the applicant proposes to install six (6) new finger piers that would connect directly to the existing bulkhead These docks would be comprised of two floating finger piers, each measuring 5' x 30', and four floating structures, each measuring 5' x 20' Further east, along the peninsula, the applicant proposes to install eight (8) new 5'x 30' finger docks that would extend from the new bulkhead towards the west As designed the proposed docking configuration would be located approximately 100' from the northern "shellfish boundary" and approximately 150' from the western "shellfish boundary" The Division understands these setback determinations were instituted to alleviate the Shellfish Sanitation's concerns over the proximity of the proposed facility to open shellfishing waters Lastly, the applicant proposes to maintenance dredge the existing marina basin As proposed, five (5) areas would be targeted for dredging and would include the areas along the western property line and the entrance channel For a detailed depiction of the dredge footprints, please refer to sheet 1 of 3, dated 11/17/2014, of the application package Approximately 29,050 cubic yards of material would be unearthed from the existing marina Water depths in the vicinity of the project range from approximately -1 5' at NLW to -4 6' at NLW The applicant intends to excavate the highlighted areas to a depth of approximately -5 0' (at NLW) to confirm with the existing entrance channel depths As stated, any /all dredge material would be staged a minimum of 30' from the NHW line, with the majority being used to backfill the bulkhead along the peninsula once it has been dewatered Any remaining material would be stored on high ground and spread throughout the site once it settled 11. ANTICIPATED IMPACTS: The proposed new vinyl bulkhead would result in the disturbance of approximately 16,632 sq ft of high ground Minor increases in turbidity should be expected during construction The proposed floating docks would incorporate approximately 6,136 sq ft of open water within the applicant's area of riparian access and within % of the width of the waterbody The proposed maintenance dredging would disturb approximately 29,050 sq ft of previously excavated shallow bottom area Approximately 23,604 sq ft of high ground would be filled as a result of spoil deposition and bulkhead construction As designed, no new high ground development, with exception of the bulkhead and boat ramp, would be located within neither the 75 ft Estuarine Shoreline Area nor the Estuarine Shoreline 30 ft buffer The proposed maintenance excavation within the existing boat basin is in the same footprint as previously authorized, based on the general permit Minor increases in turbidity should be expected during the dredging event, however no long term adverse impacts are anticipated Sedimentation and erosion control structures would be installed to prevent transport of material off the property Submitted by: Jason Dail Date: 11/26/14 Office: Wilmington ikA Chad Kimes, PE 104 Newton Road Hampstead, NC 28443 910- 470 -4494 del, irnevi chaitei net October 13, 2014 NARRATIVE For T"lt'EREVE Marina (Formerly Everett's Marina) / Tim Lanier SCOPE A scoping meeting on the proposed project was held on May 13, 2014. Based on this scoping meeting, TTERVE Enterprises (Applicant Mr. Tim Lanier) is requesting to construct the following: Maintenance dredge the existing basin as shown in the attached aerial to -5 NLW. Approximate dredge material will be 2500 cubic yards. The connecting channel to the river has a minimum of -5 NLW. This will allow proper flushing of the basin. This dredging is considered maintenance due to the various dredging for the established Marina in the past 60 years. 2. Reconfigure existing docking to comply with Shellfish Sanitation Policies as discussed at the Scoping meeting. In order to accommodate 50 slips, the proposed plans will meet the requirement of the 150' offset from the nearest shellfish lease. This has been depicted in the attached plans. Due to this offset, the docks are as follow: 1. Remove existing "L" Dock. 2. Remove existing 195' main dock. 3. Existing North Pier will remain to assist with boat ramp 4. New Proposed 6'x 138' main floating dock with attached 6' x 124' floating dock. These will have (8) 5'x 30' floating piers. (Slip 35 -50) 5 New Proposed 6' x 64' dock with (4) 5'x 30' piers. All fixed. (Slips 1 -8) 6. New Proposed (11) 5'x 30' Fixed Dock along bulkhead. (Slips 9 -12, 19 -34) 7. New Proposed (4) 5'x 20' Fixed Dock along bulkhead (Slips 13 -18) All docking will be for vessels 35' and under. All slips will be built to accommodate mechanical lifts if the owner requests them. Tie pilings are also included in this layout. Since the 1940's, this existing Marina has been owned and operated by the Everett family. The traditional use of the Marina was for commercial fishing. Typical recent use has been 30'- 50'shrimp trawlers, which have routinely stacked up to 3 wide parallel to these docks as shown in many aerials. There are not any plans for any docking of shrimp trawlers in the future. These proposed plans will provide residents in the area a much needed opportunity for a docking facility. RECEIVED DCM WILMINGTON, NC c,`T 2 2 2014 Page 2 (Scope Continue) 3. Approximately 924 linear feet of new bulkhead. The bulkhead will be placed at the proposed boat ramp and around the peninsula. As noted on aerials and attached pictures, this peninsula has eroded over time. The proposed bulkhead on the peninsula will be staked prior to construction. We are requesting CAMA to approve the location once the proposed bulkhead has been staked. Our plans are showing the proposed bulkhead to run on average to what was originally built to the existing NHW line on the Northern and Eastern side of the peninsula. Once the dredged material has dried, the majority of the spoil material will be used to backfill the new bulkhead and peninsula. 4. Proposed 15' x 35' concrete boat ramp with a 15' x 15' concrete approach. The grade on the boat ramp will be approximately 22 %. The existing area where the boat ramp will be placed is considered impervious due to the several inches of stone base for the existing drive in this area. DISPOSAL SITE The dredged material will be placed on site as shown on the plans. The area is approximately 14,214 square feet Once the dredged material has had an opportunity to dry and if the material is deemed suitable by the Engineer, the Owner is requesting to backfill the proposed bulkhead with this material. No fill will be placed within 30' of coastal wetlands Under this request, there will not be any impacts to wetlands. The majority of the dredging can be performed on land and the remaining by barge and excavator. All material will be protected by silt fence. Once the material has been placed, seeding and mulching will occur within 15 calendar days. ENVIRONMENTAL IMPACTS DREDGING: Existing basin has been maintained over the years. All dredging will be performed to ensure proper flushing. A. SAV's An SAV survey was performed on May 17, 2014 and on May 31, 2014 by Darian Chad Kimes, PE, Engineering Services. The SAV survey was performed at low tide and the water clarity was approximately 2' in depth SAV's were not present inside the area of the proposed dredging area. SAV's were not established in the RECEIVED DCM WILMINGTON, NC f!19V I A MIA Page 3 (SAV's Continue) existing channel to the River due to the depth. Due to the clarity issue, a second SAV was performed on May 31, 2014. The clarity was approximately 3' feet on this date. The results were the same that SAV's were not located inside the project limits. Therefore, there are no anticipated impacts to SAV's with this proposed project. A. Shellfish I do not anticipate any impacts to shellfish. B. Wetlands - - - - -- I do not anticipate any impacts to wetlands with dredging. All dredging will be a minimum of 5' from any wetlands. C. Indian Manatee Guidelines for Avoiding Impacts to the West Indian Manatee are attached to this proposal. CONTRACTOR Mr. Tim Lanier will be performing most of this work.
