Hello All.
I apologize for being a "Johnny come lately" to this discussion. However, Mr. Hindt, if you are planning on utilizing a
borrow or waste site which is in any way associated with a NCDOT project then it is highly recommended that an
environmental consulting firm be used to review all aspects of the project. NCDOT does not generally approve any waste
or borrow sites that have not received such review. There are so many aspects and variables which may result in liability
issues that NCDOT would not be willing to utilize any site that has not received a review from a trained professional
environmental consulting firm. Generally, the contractor that is working for NCDOT is responsible for securing the
environmental review. Once that has been obtained then it will be further reviewed by NCDOT for compliance. Please

In addition to that which Mr. Bailey stated below, as a contractor for NCDOT, you are also required to be in compliance
with the requirements of NCDOT's National Pollutant Discharge Elimination System (NPDES) General Stormwater
Discharge Permit (NCG 01000) for Construction Activities. NC Division of Water Resources (DWR) is responsible for
ensuring that the applicable requirements are met and to investigate pollutant /sediment discharges to surface waters of
the state. There are several permit conditions that you need to be aware of, some of which include monitoring of
rainfall, inspections, record keeping and ground stabilization. Approved soil erosion control measures and Best
Management Practices (BMPs) must also be utilized where needed. Jerry Parker can inform you of the details related to
the NPDES General Stormwater Permit. Please don't hesitate to contact me if there are further questions. Thanks.

Matt,
Thanks for the additional information. I'm just getting back into the office, so I apologize for not getting back with you
sooner. I've reviewed the information you sent and added the proposed borrow site into GIS. Based on aerial
photography and LiDAR I am concerned about 2 general areas within your drawn boundary. These areas are hatched in
red on the attached sketch.
There is a pond just to the north of the project boundary, leaving open the possibility of fringe wetlands along the
boundary within the project area. Further, the aerial photo shows what appears to be a stream just to the west of your
project area and likely extending into the project boundary. Wetlands may also occur along the fringes of this stream
and within non - stream narrow drainages along in the headwaters of the stream. As such, I cannot determine a lack of
waters of the US within the entirety of your project area based on the information provided.
It is possible that NCDOT conducted wetland delineations /stream determinations within this area for the project. As
such, I recommend that you contact NCDOT for this information. If you wish to pursue using portions of the project area
that may contain wetlands and other waters of the US I strongly recommend that you contact a qualified environmental
consultant to delineate any wetlands or waters of the US within the area and present the information to the USACE for
verification. Please note that authorization is required, in the form of a permit, for any discharges of dredged or fill
material in waters of the US prior to conducting the activity pursuant to section 404 of the Clean Water Act.

Thanks Mr. Hindt. NCDOT is ultimately responsible for ensuring that their borrow sources do not impact wetlands or
other waters of the US. Typically they will send a report detailing their borrow sources (if they occur within 400 feet of a
waters of the US) and have already had environmental consultants prepare the necessary documentation to send to us if
necessary. As a first step please coordinate with NCDOT to see if this work has been completed yet. I just left Jerry
Parker (NCDOT Div. 7 DES) a voicemail letting him know that I am referring you back to NCDOT on this. Please give me a
call if you have any questions.

Thank you for your inquiry. My name is David Bailey and I am the US Army Corps of Engineers regulatory project
manager responsible for Guilford County. I can better answer your question with a little more information. Is this
borrow area associated with a NCDOT project? If so, which project is it?
If not, I will need additional information about the footprint of the proposed borrow area. Based on that information I
will determine if a Jurisdictional Determination is required in order to identify any wetlands or other waters of the US on
site, and furthermore if any are proposed to be impacted and therefore subject to our permitting requirements.

My company has a project in Guilford County, NC and are looking to receive borrow material from a property owner in
the area. Per the NCDOT specifications, we need to check with you and see if you have regulatory jurisdiction in the
area. If so, we need to obtain a permit for such borrow sources. The property owners address is 2100 Neeley Road,
Pleasant Garden, NC 27313. Please let me know if we will need the permit and if so, what information you will need
from my company.
