HomeMy WebLinkAbout20071587 Ver 1_WRC Comments_20070926®North Carolina Wildlife Resources Commission September 26, 2007 Ms. Lisa Leatherman, Lake Services Representative Duke Power Nantahala Plant 301 N&P Loop Franklin, NC 28734 Mr. Ian McMillan NCDENR, Division of Water Quality, 401 Unit 1628 Mail Service Center Raleigh, North Carolina 27699-1628 SUBJECT: Glen Pointe Development, Mr. Ray Trine 10-slip private marina -Lake Glenville Jackson County DWQ No. 07-1587 Dear Ms. Leatherman and Mr. McMillan: Biologists with the North Carolina Wildlife Resources Commission (Commission) reviewed the information about the private 10-slip marina on Lake Glenville being proposed by Mr. Ray Trine of Glen Pointe Development. Comments from the Commission are provided under provisions of the Federal Power Act, as amended (16 U.S.C. 791a-825r) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) to assist Duke Power with their Federal Energy Regulatory Commission license responsibilities and under provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The Commission has no major concerns with the proposal provided it complies with Duke Power's Shoreline Management Guidelines (SMG). In addition, should Duke Power decide to permit the marina, we offer the following recommendations to help conserve fish and wildlife resources and to help protect public use of the lake: 1. Boat slips should not be placed so as to impede or block navigation or to create a navigational hazard for vessels. Reflectors or night lights are recommended. Boat slips should not extend further into the lake than allowed by the SMG. 2. Large woody debris that extends into the water and that must be moved for the pier should be relocated and secured to the shoreline. Stumps, rocks or woody debris within the lakebed should not be disturbed or removed. 3. Paths or drives through buffers should be no wider than needed to access the boating facilities and to meet American with Disabilities Act (ADA) requirements. 4. The applicant should install suitable trees and brush under the fixed portion of the piers to provide complex aquatic habitat. They should be constructed and perpetually maintained (for the life of the pier) in "Fish-Friendly" manner (Duke Power has this information). 5. Stormwater treatment should be provided for any parking lots and other hardened surfaces. Low Impact Development (LID) techniques are encouraged. Information on LID practices and measures can be found at www.lowimpactdevelopment.org. 6. The use of pesticides, herbicides, fertilizers, and cleaners in close proximity to or over water should be restricted. 7. State erosion and sedimentation controls measures should be strictly adhered to. Thank you for the opportunity to review and comment on this project.
