Duke Energy Progress, LLC (Duke Energy) hereby requests modification of the subject NPDES
permit to include NPDES coverage of the Cooling Pond Seeps upon expiration or termination of
Special Order by Consent (SOC) - WQ S 18-006 and to update the modified compliance
boundary map as recently approved by the North Carolina Division of Water Resources on
2/23/2022.
1) Duke Energy is requesting addition of a special condition in the NPDES permit to
provide permit coverage for the minor release of pollutants from areas of seepage
around the site's 545 acre cooling pond.
Background
In 2014 Duke Energy conducted a comprehensive evaluation of all potential wastewater
bason areas of seepage at the H.F. Lee Energy Complex. The areas of the survey included
the site's ash basins and the wastewater cooling pond.
Areas of seepage associated with the ash basins and cooling pond are currently covered and
regulated by a Consent Order EMC SOC WQ S 18-006 between the North Carolina
Environmental Management Commission and Duke Energy (the SOC). Upon completion of
the SOC, regulatory oversight of seeps associated with the ash basin will be transferred to the
sites groundwater corrective action plan (CAP) for continued monitoring and regulatory
oversight.
The groundwater CAP does not address the areas of seepage associated with the cooling
pond. The cooling pond will continue to support the Combined Cycle Facility past the
closure of the SOC. The wastewater cooling pond was historically used during coal fire
operations but did not receive wastewater streams from any coal ash wastewater processes.
The cooling pond continues to be an active operational component for the natural gas fired
combined cycle plan and will be so for the foreseeable future with no current plan for
closure. The cooling pond currently has two permitted outfalls: Outfalls 002 and Outfall
002A.
There are 21 areas of minor seepages identified around the cooling pond's 4.63 mile
perimeter dike: (CPS01-CPS-21). These areas are depicted around the cooling pond on
Attachment A Map - Cooling Pond Seeps. A list of these seeps and generalized areas of
latitude and longitude are also in Attachment A. Chemical testing of the cooling pond
seepage areas has revealed some contain minor concentrations of pollutants. During the
2021 seep sampling event, 6 of the 21 cooling pond seep areas exhibited sufficient flow to
obtain a sample for analysis. These sample results are provided in Attachment B - October
2021 Cooling Pond Sample Results.
Collectively, the observed volume of seepage flow is very low compared to the volume of
other permitted wastewater discharges at the site. The sample result table in Attachment B
demonstrates the total flow of the sampled seeps is approximately 0.1 % of the average flow
from the ash pond at Outfall 001.
REQUESTS
1. Duke Energy requests inclusion of these cooling pond seepage areas in the NPDES
Permit through reference in a special condition to assure complete and appropriate
permit coverage. Duke Energy requests the existing instream monitoring requirements
upstream and downstream of the site along with required inspections of the seepage areas
in close proximity to the cooling pond dam in accordance with North Carolina Dam
Safety requirements be deemed sufficient to monitor any influence from these areas.
2. Duke Energy requests the updated compliance boundary map approved by the
North Carolina Division of Water Resources staff on 2/23/2022 be included in the
modified NPDES permit.
A copy of the updated compliance boundary map along with correspondence from
Division approving the updated compliance boundary is included for reference. An
electronic copy of the map can be provided upon request.
A check in the amount of $1,030 is included with this submittal to cover the required permit

The following proposed compliance boundary updates were submitted to DEQ by Duke Energy since 2019 (also
attached):
• Allen Steam Station — submitted 10/9/19
• Asheville Steam Electric Plant — submitted 2/10/21
o DEQ understands that Duke has documentation of ownership for the land under 1-26 that is included in
the updated compliance boundary map. DEQ will approve this proposed change to the compliance
boundary upon receipt of that documentation.
• Belews Creek Steam Station — submitted 3/11/20
• Buck Combined Cycle Station — submitted 10/22/20
• James E. Rogers Energy Complex (Cliffside) — submitted 7/22/19
• H. F. Lee Energy Complex — submitted 10/16/20
• Marshall Steam Station — submitted 7/26/21
• Mayo Steam Electric Plant — submitted 9/17/19
DEQ hereby approves the proposed changes to the compliance boundary at each of these sites. These maps will be
included in the facility NPDES permit the next time the permit is renewed or modified.
Additional Compliance Boundary Issues
The following issues are currently being reviewed by DEQ and will be handled in a separate correspondence:
• For the Cape Fear Steam Electric Plant, a different configuration of the compliance boundary was included in the
updated Comprehensive Site Assessment Report (submitted December 1, 2020) than is depicted in the current
NPDES permits.
• For the W. H. Weatherspoon Power Plant, a question exists regarding whether the Cooling Pond has a
compliance boundary.
