Dear Sir:
Upon final review of the environmental permits for this project a discrepancy between the
permits issued under Section 404 and Section 401 was observed. Currently, under Section 401,
impacts from the proposed project are covered by General Water Quality Certification Numbers
3689 and 3688. These certifications correspond to the Nationwide Permits (NWP) 13 and 33,
respectively. Email correspondence with William Wescott of the US Army Corps of Engineers
(attached) indicates, that the proposed project is permitted under Section 404, NWP 3 and NWP
13. Under Section 401, the corresponding General Certification numbers are 3687 and 3689,
respectively.
We request that your office revise the General Water Quality Certifications to reflect the
applicable NWP 3 and NWP 13 by removing the General Certification 3688 and adding General
Certification 3687.
Please find enclosed a revised Pre -Construction Notification (PCN) form and correspondence
with William Wescott of the US Army Corps of Engineers.

I have looked through the package of information. The replacement o2 the existing
structure is already covered under a NWP 3. Temporary fill for construction purposes is
also covered under the NWP 3. Your proposed r�prap is less then the threshold; therefore,
does not require notification under NWP 13. I have attached the first page of NWP 3 and
NWP 13 and highlighted the areas of interest. No notification is required to USACE.
