W.Bames(aD_usace.armV.mil SUBJECT: Pine Gate Renewables, Phobos Solar, LLC Phase II Nash County, North Carolina Request for Additional Information Mr. Barnes, On August 23, 2021, Kleinfelder submitted a Pre -Construction Notification (PCN) to the U.S. Army Corps of Engineers (USACE) on behalf of Pine Gate Renewables (the applicant) for the proposed Phobos Solar, LLC Phase II project (the Project) for authorization under Nationwide Permit 51 for Land -based Renewable Energy. The Project consists of a proposed solar renewable energy facility located on a 1,063.3-acre property in Middlesex, Nash County, North Carolina (Attachment A). This letter follows the request for additional information (RAI) received on September 23, 2021, from your office regarding the referenced Project. As identified in the PCN submittal, fencing is to be installed along the perimeter of the solar array footprint within the property boundary in order to provide site security. Permanent impacts to wetlands and streams will be limited to areas where fence installation is proposed. The Project proposes to install fencing perpendicular to five (5) wetland and stream crossings within the property (Attachment B). Other alternatives proposed for the solar array and fence installation were evaluated during site design planning and resulted in an increased number of impacts to natural resources within the property. The preferred Project was selected as it proposed perpendicular crossings in narrow sections of on -site wetlands, streams, and riparian buffers to minimize the number of impacts to natural resources and subsequently reduce construction costs for the fence installation. For each proposed fence crossing, the applicant will mechanically clear trees and shrubs within a 10-foot-wide corridor (impact area) in order to provide clearance for the fence installation equipment. Root systems from the cleared trees and shrubs will remain intact and no herbicides will be used. Matting will be placed within the impact area during project construction to prevent further disturbance to the herbaceous and soil layers and temporary silt fence and hay bales will be installed along the impact area limits to prevent sedimentation downstream. Fence posts will be installed along the stream banks and outside of the ordinary high-water mark (OHWM) and the pre -construction elevations will be maintained. Fencing will be installed above the stream channels as not to obstruct downstream flow. Following the fence installation, tree and shrubs within the 10-foot-wide fence corridors will be mechanically removed as -needed to maintain the structural integrity of the fencing over the life of the solar project. No herbicide use is proposed and existing root systems and herbaceous vegetation within the fence corridors will be preserved in order to maintain soil stability in the area. The PCN submitted on August 23, 2021 was additionally provided to the North Carolina Department of Environmental Quality (NCDEQ) for approval of a Section 401 Water Quality Certification and Riparian Buffer Authorization. Land disturbance actions associated with the fence installation will be conducted in accordance with NCDEQ standards. A 50-foot vegetative buffer will be maintained with temporary silt fencing around all undisturbed wetlands and streams and all temporary erosion control measures will be maintained in proper working condition during the entirety of Project construction. In areas where a 50-foot buffer cannot be maintained or is proposed to be impacted, a double row of silt fence will be installed where a 10-foot buffer will be maintained between the last row of silt fence and the undisturbed wetlands and/or streams.
