Dear Ms. Thompson:
Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are
forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency
dated May 9, 1994 (or as subsequently amended).
The Division has received comments from Richard S. DeMott, Chair of the Watauga River Conservation Partners. That
association is "concerned about the large number of wastewater treatment plants discharging into the Watauga River or its
tributaries and the impact these have immediately and over a period of time". The Division requires you to be diligent in your
plant operations and maintenance. Furthermore, the Division urges you to anticipate future needs by planning for wastewater
improvements. For example, the Division is in the process of implementing daily maximum ammonia limits into non -municipal
NPDES permits. Acceptable limits for your facility would be 10.0 mg/L during the summer months and 20.0 mg/L during the
winter months.
Compliance with all terms and conditions of the attached permit is the responsibility of the Permittee. Please note that T15A 08G
.0204 of the North Carolina Administrative Code has been interpreted to mean that the Operator in Responsible Charge is
responsible for operation of water pollution control systems.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the
right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be
in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office
of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this
permit shall be final and binding.
Please take notice that this permit is not transferable without prior notice to the Division. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division
of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits which may be required.

other conditions set forth in Parts I, II, III and IV hereof.
This permit shall become. effective September 1, 2003.
This permit and authorization to discharge shall expire at midnight on September 30, 2007:

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of
this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the
exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements,
terms, and provisions included herein.
Smoketree Lodge is hereby authorized to:
. Continue to operate an existing 0.010 MGD extended aeration wastewater
treatment system with the following components:

The facility is located north of Boone at the Smoketree Lodge Condominiums
WWTP off NC Highway 105 in Watauga County.

waters in the Watauga River Basin.

Hi! Hope life is good for you.
Reviewed draft permit renewal NC0049174, Smoketree Lodge, Watauga Co. Found two
things that may be worth looking at. First thing is that this permit has a chlorine limit
but uses UV disinfection, the other thing is that I show it discharging into a unt to the
Watauga River not the Elk River. Other than that, everything looks good.

I am writing to you once again on behalf of the Watauga River Conser-
vation Partners chapter of the Western North Carolina Alliance and this time
in reference to:
NPDES Permiit Number NC0058378, Elk River Utilities, Inc. - Elk River
Subdivision WWTP
NPDES Permit Number NC0049174, Smoketree Lodge, P. 0. Box 3407, Boone,
NC 28607
I am most familiar with the Smoketree Lodge WWTP which has had many
problems and violations over recent years which have been corrected for the
most part by the recent reconstruction. As with all WWTPs I am concerned with
the very modest stream available for discharge and particuarly in the current
drought situation. These and the other plants in this Watauga River Basin now
require close supervision to avoid serious spills and violations. These are
our concerns as review for repermitting occurs.

Environmental Management Commission implementing that Article, or who falsifies, tampers with, or knowingly renders inaccurate any
recording or monitoring device or method required to be operated or maintained under Article 21 or regulations of the Environmental
