Dear Ms. Thompson:
In accordance with the discharge permit application received on July 8, 1997, the Division is
forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U.S. Environmental Protection Agency dated December 6, 1983.
There has been one change to the draft permit - the permitted flow has been changed from 0.021
MGD to 0.01 MGD. This facility's treatment system is sized for 0.01 MGD and an authorization to
construct for an expansion has never been submitted. All permit pages referencing the flow have been
corrected.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is
made, this decision shall be final and binding.
Please take note that this permit is not transferable. Part II, E.4. addresses the requirements to be
followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Water Quality or permits required by the Division of Land Resources, or any other Federal
or Local governmental permit that may be required.

of bar screen, aeration basin, clarifier, chlorination, and post dechlorination located at
Smoketree Lodge Condominiums, on NC Highway 105, north of Boone, Watauga County

2. Discharge wastewater from said treatment works at the location specified on the attached
map into an unnamed tributary to the Watauga River which is classified Class B-Trout HQW
waters in the Watauga River Basin.

Permits & Engineering Comments:
1. Raleigh Central Office has not yet received renewal application. Mike Mickey indicated to Paul
Clark (April 15, 1997) that facility intends to renew permit.
2. The facility submitted an engineering alternatives analysis (EAA) which included cost of meeting 5
mg/1 BOD5 and 2 mg/1 NH3N (both summer) limits. EAA concluded WWTP modification with surface
water discharge was the most reasonable and cost effective alternative. Facility has had to comply
with 5/2 limits (15A NCAC 02B .0224) since 11/1/95.
3. The Division may want to require facilities that discharge to B-trout HQW waters to meet 5/2 limits
all year if they are capable (see The Ponds). Region please comment.
4. The ammonia toxicity mass balance calculation using 7Q10 and permitted flows calculates allowable
concentrations of 1.0 mg/I (summer)/1.8 mg/I (winter). However, facility's flow is less than 1 MGD,
thus: a) Division policy requires NH3-N limits no lower than 2/4 mg/1 and b) facility has choice of 2/4
NI-I3N limits or chronic toxicity at 90%. The 2/4 ammonia limits are already in their permit. Region
-please confirm that facility prefers ammonia limit to chronic toxicity. . .
5. Facility discharges into trout waters, recommend adding footnote prohibiting instream temperature
from increasing more than 0.5° C as a result of the discharge (15A NCAC 02B .0211 and .0219).
6. Recommend elimination of special conditions D (incorporated into boiler plate) and E (no longer
applicable because more stringent limits incorporated into permit).

This facility has a system sized for only 0.01 MGD. Please revise effluent pages to
reflect this flow. They never applied for an authorization to construct to expand the
plant above the 0.01 MGD. The facility would prefer NH3-N limits. There is no
objection to year round 5/2 limits. This facility plans to tie into a proposed utility in
Avery County which will discharge in Watauga (Chuck Davis is the engineer for the

April 15, 1997
Smoketree Lodge Condominiums has applied to renew their permit to discharge 0.0210
MGD treated wastewater.
Treatment system consists of bar screen, aeration basin, clarifier, chlorination and
dechlorination and discharges to an unnamed tributary of the Watauga River (Class B-Trout
HQW) in the Watauga River Basin.
Compliance Summary
Review of 1995-present DMRs indicate the facility has had regular violations including:
56.0 ug/1 (chlorine-9501), 474/100 ml (fecal coliform-9506), 0.028 MGD (flow-9605),
9.5 mg/1(BOD5-9605), and 8.5 mg/1 (NH3-N, 9611) and violations also occurred prior to
1995. None of the violations appear to be parameter specific. In June 1995, fecal coliform
increased dramatically downstream of discharge likely as a result of high effluent value.
WLA Summary
The facility discharges into a stream with 7Q10/30Q2=0. During the most recent permit
period, the facility submitted an engineering alternatives analysis (EAA-940414) which
included cost of WWTP modification to meet 5 mg/1 BOD5 and 2 mg/1 NH3N summer
limits. EAA concluded WWTP modification with surface water discharge was the most
reasonable and cost effective alternative. Facility has had to comply with 5/2 limits (as
required by 15A NCAC 02B .0224) since November 1, 1995.
The ammonia toxicity mass balance calculation using 7Q10 and permitted flows calculates
allowable concentrations of 1.0 mg/1 (summer)/1.8 mg/1(winter). However, facility's flow
is less than 1 MGD, thus: a) Division policy requires NH3-N limits no lower than 2/4 mg/1

limits are already in their permit. Region should confirm that facility prefers

The chlorine toxicity mass balance calculation using 7Q10 and permitted flows calculates an
allowable concentration of 17.0 ug/l.
Instream Monitoring
Facility discharges into trout waters, recommend adding footnote prohibiting
ambient stream temperature from increasing more than 0.5° C as a result of
the discharge (15A NCAC 02B .0211 and .0219).
Review of instream monitoring data for the period 1995-present indicate that the discharge
does not appear to be adversely impacting the receiving stream. Temperature, dissolved
oxygen, fecal coliform, and conductivity values were very close if not identical at the up -
and downstream stations the majority of the time. The exception was one high fecal
coliform value at the downstream station in June 1995.
Other Items
Recommend the following: a) changing BOD5 and NH3N sample type from
grab to composite, b) changing frequencies of several parameters and
adding total nitrogen and total phosphorus monitoring on a semi-annual
basis to be consistent with 02B .0500, c) changing Total Suspended
Residue monthly average from 30.0 mg/1 to 10.0 mg/1 to be consistent with
water quality standard for trout receiving waters, and d) elimination of
special conditions D (no longer applicable because 5/2 limits incorporated
into permit) and E (incorporated into boiler plate).
