Accordingly, we are forwarding the attached NPDES discharge permit. It is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina,.and the U.S. Environmental Protection Agency dated October 15, 2007. There were several changes to your permit from the draft permit issued June 8, 2011. They include the following: • Quarterly monitoring requirements for copper and selenium were removed. A review of additional monitoring results shows that there is no reasonable potential for these pollutants to cause an exceedance of water quality standards. • Quarterly monitoring for bis(2-ethylhexyl)phthalate was also removed. The laboratory has confirmed that the only sample result above detection limits for this pollutant should be discarded, since there is zero confidence inits accuracy. • As a result of the revised reasonable potential analysis, daily and monthly limits were implemented for total mercury, with a monitoring frequency of once per month. These limits are conditioned with a 12-month compliance period, such that they will not go into effect until November 1, 2012. Additionally, the City may petition for a reduction to quarterly monitoring after 12 consecutive months of sampling results under the water quality standard of 12 ng/L. • The special condition concerning nitrogen optimization was deleted. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing upon written request within thirty (30) days after receiving this letter. Your request must take the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and must be filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such demand is made, this permit remains final and binding. This permit is not transferable except after notifying the Division of Water Quality. Monitoring requirement and limit applies only if chlorine is added for disinfection. The Division shall consider all effluent TRC values reported below 50 pg/L to be in compliance with the permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall below 50 pg/L. 6. TN = TKN + NO3-N + NO2-N, where TN is total nitrogen, TKN is Total Kjeldahl Nitrogen, and NO3-N and NO2- N are Nitrate and Nitrite Nitrogen, respectively. 7. TN or TP Load is the mass quantity of Total Nitrogen and Total Phosphorus discharged in a given period of time. See Special Condition A (8) Calculations of Total Nitrogen or Total Phosphorus Loads. 8. Compliance with mass limits shall be determined in accordance with Special Condition A (7), Annual Limits for Total Nitrogen or Total Phosphorus. 9. Total mercury shall be sampled using low-level Method 1631 E. Both limits will take effect November 1, 2012. Monthly monitoring commences November 1, 2011. After 12 consecutive months of monitoring with no sample results above water quality standards (12 ng/L), the Permittee may petition for a reduction to quarterly monitoring. 10. Chronic Toxicity (Ceriodaphnia) P/F @ 90%; January, April, July, and October (See A (4) Special Conditions of the Supplement to Effluent Limitations). 11. See Special Condition A (5) Effluent Pollutant Scan. There shall be no discharge of floating solids or foam in other than trace amounts. If the Permittee does not participate in the Association or if the Association ceases to function, the instream monitoring • requirements in this permit become effective immediately; and the Division may reopen this permit by administrative letter to establish additional instream monitoring requirements it deems necessary to adequately characterize the effects of the discharges on water quality in the receiving stream. 1, Permit No. NC0047597 . t: A (4) CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised - February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: NCDENR/ DWQ/ Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Permit No. NC0047597 ,T A (5) EFFLUENT POLLUTANT SCAN The Permittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the attached table. The analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria. Samples shall represent seasonal variations. Unless otherwise indicated, metals shall be analyzed as "total recoverable." Permit No. NC0047597 A (7) ANNUAL LIMITS FOR TOTAL NITROGEN OR TOTAL PHOSPHORUS (a) Total Nitrogen (TN) and Total Phosphorus (TP) allocations and load limits for NPDES dischargers in the Jordan Lake watershed are annual limits and apply on a calendar year basis. (b) For any given calendar year, the Permittee shall be in compliance with the annual TN (or TP) Load limit in this Permit if: (i) the Permittee's annual TN (or TP) Load is Tess than or equal to the effective limit, or (ii) the Permittee is a Co-Permittee Member of a compliance association. The TN (or TP) Load limit in this Permit may be modified as the result of allowable changes in the Permittee's allocations. Allowable changes include those resulting from purchase of TN (or TP) allocation from an authorized mitigation banker, the Ecosystem Enhancement Program, or other source allowed under applicable regulations; purchase, sale, trade, or lease of allocation between the Permittee and other dischargers; regionalization; and other transactions approved by the Division. (ii) The Permittee may request a modification of the TN (or TP) Load limit in this Permit to reflect allowable changes in its allocation(s). (A) Upon receipt of timely and proper application, the Division will modify the permit as appropriate and in accordance with state and federal program requirements. (B) Changes in TN (or TP) limits become effective on January 1 of the year following permit modification. The Division must receive application no later than August 31 for changes proposed for the following calendar year. (iii) Any requests for modification should be sent to: NCDENR/ DWQ/ NPDES Programs Attn: Jordan Lake Watershed Coordinator 1617 Mail Service Center Raleigh, NC 27699-1617 (d) If the Permittee is a member and co-permittee of an approved compliance association on January 1 of a given year, its TN and TP discharges during that year are governed by that association's, group NPDES permit and the limits therein. (i) (i) The Permittee shall be considered a Co-Permittee Member for any given calendar year in which it is identified as such in Appendix A of the association's group NPDES permit. (ii) Association roster(s) and members' TN and TP allocations will be updated annually and in accordance with state and federal program requirements. (iii) If the Permittee intends to join or leave a compliance association, the Division must be notified of the proposed action in accordance with the procedures defined in the association's NPDES permit. (A) . Upon receipt of timely and proper notification, the Division will modify the permit as appropriate and in accordance with state and federal program requirements. (B) Membership changes in a compliance association become effective on January 1 of the year following modification of the association's permit. (e) The TN and TP monitoring and reporting requirements in this Permit remain in effect throughout the term of the Permit and are not affected by the Permittee's membership in a compliance association. A (9) NUTRIENT MONITORING REOPENER Pursuant to N.C. South Durham has a full pretreatment program with the Division's Pretreatment Unit. It has three significant industrial users and one categorical industrial user. The two largest SIU's are both laundry facilities - Angelica Textile Service at an average flow of 83,600 GPD and Alsco at 67,900 GPD. The City has not requested any specific changes to the permit. On July 9, 2010, this permit was one of 14 that were modified to include total phosphorus discharge limits in accordance with the Jordan Lake nutrient management strategy wastewater discharge requirements at 15A NCAC 02B .0270. The new annual mass discharge limits for phosphorus were equal to the facility's TP discharge allocation. To further comply with the strategy, this permit draft includes nitrogen limits proposed to go into effect on January 1, 2016. DMR Data Review This facility discharges to an unnamed tributary to New Hope Creek in subbasin 030605 of the Cape Fear River Basin. The receiving stream is classified WS-IV NSW waters, and is listed as impaired on the 2010-303(d) list due to impaired biological integrity and turbidity. DMR data from January 2008 through April 2011 were reviewed. Data are summarized in Table 1. Table 1. The South Durham WRF has had no permit limit exceedances and received no Notices of Violation (NOVs) or Enforcements Actions over the course of the past two permit term. Additionally, the facility has also been in long-term compliance with its toxicity limit going back to at least 2001, with no toxicity test failures. The Raleigh Regional Office last conducted a Compliance Evaluation Inspection on March 30, 2010 and found the facility to be in compliance. As a member of the Upper Cape Fear River Basin Association, the permittee does not collect instream data. The waiver of instream monitoring may continue as long as this membership continues. Reasonable Potential Analysis (RPA) The Division conducted EPA -recommended analyses to determine the reasonable potential for toxicants to be discharged by this facility, based on DMRs and pretreatment data from January 2008-April 2011, and also using PPA results supplied with the permit application. All parameters of concern were included. The results of the RPA showed that reasonable potential to exceed water quality standards was present for the following parameters: silver, zinc, and mercury. As an action level parameter, quarterly monitoring was implemented for zinc. Silver will continue to be monitored in the facility's pretreatment long term monitoring plan. Total mercury had one sample result above the 12 ng/L standard. Monthly monitoring, with limits, will be added to the permit. The City may petition for a reduction to quarterly monitoring after 12 consecutive months of sampling results showing no reasonable potential to cause an exceedance of water quality standards. No reasonable potential was found for arsenic, beryllium, cadmium, total phenolic compounds, chromium, cyanide, fluoride, lead, copper, selenium, and molybdenum. The monthly monitoring for fluorides will be removed from this draft permit. Toxicity Testing Current Requirement: Chronic toxicity P/F @ 90%; January, April, July, October. This draft permit recommends that chronic toxicity continue to be monitored P/F @ 90%; January, April, July, and October. Jordan Lake Nutrient Management Strategy This permit was modified in July 2010 to implement the permitting strategy addressing the Jordan Lake rules. This strategy establishes nitrogen and phosphorus allocations for all existing wastewater dischargers that treat nutrient -bearing wastes. In accordance with these requirements, this draft permit includes a new annual mass discharge limit for total nitrogen of 185,345 pounds per year, effective January 1, 2016. Another requirement of this strategy is for a nitrogen optimization plan. The permittee submitted a plan to the Division on February 17, 2010. An updated special condition A (9) addresses further requirements regarding nitrogen optimization implementation. Summary of Proposed Changes The following are changes from the draft permit were incorporated into this final permit: • Quarterly monitoring requirements for copper and selenium were removed. A review of additional monitoring results shows that there is no reasonable potential for these pollutants to cause an exceedance of water quality standards. NC0047597 Page 2 • Quarterly monitoring for bis(2-ethylhexyl)phthalate was also removed. The laboratory has confirmed that the only sample result above detection limits for this pollutant should be discarded, since there is zero confidence in its resulting concentration. • As a result of the revised reasonable potential analysis, daily and monthly limits were implemented for total mercury, with a monitoring frequency of once per month. In order to provide time for the city to achieve compliance, these limits will become effective October 1, 2012. The city may petition for a reduction to quarterly monitoring after 12 consecutive months of sampling results showing no reasonable potential to cause an exceedance of water quality standards. • The condition concerning nitrogen optimization (former condition A9) was deleted. The Division is reviewing its policy on this subject. The following modifications from the draft permit remain in effect: • In accordance with the Jordan Lake nutrient management strategy, a new annual mass discharge limit for total nitrogen of 185,345 pounds per year, effective January 1, 2016, was added. • Limits for fluoride were removed, due to the results of the reasonable potential analysis. • The monitoring frequency for zinc was reduced to quarterly, in accordance with Division policy regarding action -level parameters. It defines the method detection limit (MDL) as "the minimum concentration of a substance that can be measured and reported with 99% confidence that the analyte concentration is greater than zero". Basically MDL means a level of a compound that you are fairly sure is above the background noise signal of your blank. MDL is statistically determined from analyzing 7 or more replicates of spiked water. Calculate the standard deviation and multiply that by Student T value to get the MDL. So the MDL is independent of accuracy and somewhat independent of the actual value at which the study is performed (there is a requirement that the MDL be within 10x of the true value or the study must be repeated). For example, a method may have a low calibration point, or MRL, of 1.0 ppb. The MDL study may be performed using a standard of 0.5 ppb. And yield a calculated MDL of 0.1 ppb. The accuracy of the MDL runs is not controlled. The 0.5 standard may give a calculated result of 0.1 or even 0.8. It does not matter, the MDL is calculated from the standard deviation, which is only a function of reproducibility, not accuracy. Results flagged with a "J" are estimates. There is zero confidence in the concentration. There is no quality control or calibrations performed below the MRL(Method Reporting Limit). The only confidence as defined by 40 CFR is that the value is greater than zero. A. As you know, after issuing the draft I found additional sampling data results which are not in our BIMS database. 1. The quarterly monitoring requirements for copper and selenium will be eliminated as you requested. With the addition of the new sampling results, each of these now shows no reasonable potential to cause exceedances of WQ standards. 2. Regarding bis (2 ethylhexyl) phthalate, one outlier data point caused the reasonable potential to be exceeded. As we discussed, quarterly monitoring can be removed only upon notification from your laboratory that the data point in question was not valid. 3. The additional data points for mercury sampling cause reasonable potential. One of the results is 18.3 ng/L, which is above the freshwater standard of 12 ng/L. We propose to add daily maximum and monthly average limits and monthly monitoring using EPA method 1631-E. The following comments address concerns by the City of Durham: 1. Quarterly monitoring requirements were added for copper and selenium. Based on the data used in the Reasonable Potential Analysis, RPA, provided by your office on June 16, 2011, there was one data point for selenium measured during the priority pollutant scan on March 5, 2008 that was above the detection limit. Upon review of that data you will notice that there was a data qualifier attached to the result indicating "the reported value is between the laboratory method detection limit (MDL) and the laboratory method reporting limit (MRL)". As discussed with Ms. Dana Satterwhite, Certification Unit Supervisor with NCDWQ Laboratory Section, the reported value indicates the analyte was present but there is no confidence in the value under the MRL therefore it is not accurate to use a number below the MRL for the RPA. In addition, I have attached DMR data for selenium through 2001 demonstrating there has not been a recorded value above detection limit in the 49 data points over ten years. Based on this information, the City is requesting removing the selenium monitoring requirement. Again, the City would request the removal of the copper monitoring requirement based on 10 years of data that is well below the action level. 3. The draft permit adds quarterly monitoring for bis(2-ethylhexyl)phthalate due to a result that was above the federal water quality criteria. This was a result submitted from the 2011 Priority Pollutant Scan that was qualified by the laboratory. The qualifier indicated "the reported value is between the laboratory method detection limit (MDL) and the laboratory method reporting limit (MRL)". As discussed in Item 1 above, it is not accurate to use a number below the MRL for the RPA. A review of the data used in the RPA illustrates the reported value in 2011 is lower than two of the other data points that are reported as a less than value. Given this information, the City requests removal of the monitoring requirement of bis(2-ethylhexyl)phthalate. Durham's plants are (or will soon be) subject to N & P limits under three nutrient management strategies. 1. The South plant is in the Jordan Lake watershed and subject to the TMDL and strategy for the Upper New Hope arm of the lake. It will receive nutrient limits once the legislature takes final action on the nutrient rules. The proposed discharge limits are 183,345 lb/yr TN and 14,053 lb/yr TP (3.04 and 0.23 mg/L, respectively, at the full permitted flow of 20 MGD). The TP limit is to become effective in CY2010, the TN limit in CY2016. 2. The North plant is already subject to nutrient limits calculated to protect the Neuse estuary. It has a TN discharge limit of 334,851 lb/yr (5.5 mg/L at 20 MGD permitted flow) and a TP limit of 2.0 mg/L, quarterly average. 3. The North plant faces additional controls under the Falls Lake strategy. We are working through a stakeholder process now to develop that strategy and an implementation schedule to meet the legislature's mandate that the EMC adopt rules for the strategy by next July. We have not developed a TMDL for Falls Lake, and our aim is to address the lake's WQ issues without going through the formal TMDL process. In 1990, the facility was upgraded to include processes for chemical and biological phosphorous removal in addition to belt filter presses for sludge dewatering. Traveling bridge effluent filters were also added to improve effluent quality. In 1994, the facility was expanded to 20 MGD and upgraded to include biological nutrient removal, gravity belt thickeners, ultraviolet light disinfection, odor scrubbing and a computer control system. With the addition of two anaerobic digesters in 1998, all sludges, primary and waste activated, are digested anaerobically then land applied as a Class B product. The City contracts with Synagro Southeast to land apply biosolids to privately owned farm land that is permitted in the City of Durham's name. The South Durham facility is home to the Water and Wastewater Laboratory. This laboratory runs all analyses for two (2) water plants, two (2) wastewater plants, the Industrial Pretreatment Program and the Storm Water Program. . Hazen and Sawyer Engineers are in the preliminary stages of designing a supplemental carbon feed facility as well as designing other process modifications to improve nitrogen removal in anticipation of the 2016 permit limit. The operations staff is continuing to make process adjustments in an effort to continue to lower nitrogen discharges.
