This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994 (or as subsequently amended). The following modifications from the draft permit are included in the final permit: • Fluoride monitoring was changed to monthly. The draft permit specified 2/month instead of monthly as proposed in the fact sheet. • Nutrient monitoring frequency was modified to weekly. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. PROVISIONAL WAIVER OF INSTREAM MONITORING REQUIREMENTS Instream monitoring requirements in this NPDES permit shall be provisionally waived so long as the Permittee remains a member of the Upper Cape Fear River Basin Association and the Association continues to function as approved by the Division and Environmental Management Commission. If the Permittee does not participate in the Association or if the Association ceases to function, the instream monitoring requirements in this permit become effective immediately; and the Division may reopen this permit by administrative letter to establish additional instream monitoring requirements it deems necessary to adequately characterize the effects of the discharges on water quality in the receiving stream. Permit NC0047597 ti. A. (4.) CALCULATIONS OF MASS LOADS a. The permitte shall calculate monthly and annual TN (or TP) loads as follows: i. Monthly TN (or TP) Loads = TN (or TP) x TMF x 8.34 Where: TN (or TP) = the average Total Nitrogen (or Total Phosphorus) concentration (mg/L) of the composite samples collected during the month. TMF = the total monthly flow of wastewater discharged during the month (MG/mo) 8.34 = conversion factor, from (mg/L x MG) to pounds ii. Annual TN (or TP) Load (lb/yr) = Sum of 12 monthly TN (or TP) Loads for calendar year. b. The permitte shall report monthly total nitrogen and total phosphorus results (mg/L and lb/mo) in the appropriate discharge monitoring report for each month and shall report each year's results (lb/yr) with the December report for that year. A. (5). NUTRIENT MONITORING RE -OPENER Pursuant to N.C. Gen. Stat. Section 143-215.1 and the implementing rules found in Title 15A of the North Carolina Administrative Code, Subchapter 2H, specifically, 15A NCAC 2H.0112(b)(1) and 2H.0114(a), and Part II, Sections B-12 and B-13 of this Permit, the Director of DWQ may reopen this permit to require supplemental nutrient monitoring of the discharge. The additional monitoring will be to support water quality modeling efforts within the Cape Fear River Basin, and shall be consistent with a monitoring plan developed jointly by the Division and affected stakeholders. (6) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90 %. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Permit NC0047597 A. (7.) EFFLUENT POLLUTANT SCAN The Permittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the attached table. The analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria. Samples shall represent seasonal variations. Unless otherwise indicated, metals shall be analyzed as "total recoverable." The current permit expires April 30, 2006. The Permittee submitted Standard Form 2A on September 9, 2005 to request renewal of the permit. South Durham has a full pretreatment program with the Division of Water Quality's Pretreatment Unit and will continue to implement this program in the new permit term. Permitted industrial flow is 0.53 MGD and average industrial flow is 0.29 MGD. The facility has not requested any changes to the permit, other than the removal of the fluoride limit. Instream Monitoring, Verification of Existing Conditions and DMR Data Review This facility discharges to an unnamed tributary to New Hope Creek in sub basin 03-06-05 of the Cape Fear River Basin. The receiving stream is classified WS-IV NSW waters, and is listed as impaired on the 2006-303(d) list due to impaired biological integrity and turbidity. DMR data from January 2004 through December 2005 were reviewed. Data are summarized below. These are discussed in the Reasonable Potential Analysis section. Permittee is a member of the Upper Cape Fear River Basin Association, therefore does not collect separate instream data. Fact Sheet NPDES NC0047597 Renewal Page 1 Correspondence The Raleigh Regional Office (RRO) last conducted a Compliance Evaluation Inspection in August 2004 and found the facility to be in compliance. The South Durham WRF has received no Notices of Violation (NOVs) or Enforcements Actions over the course of this permit term. The facility has also been in compliance with its toxicity limit during this permit term. South Durham is a member of the Upper Cape Fear River Coalition. Recommend continuation of waiver of instream monitoring for dissolved oxygen and temperature as long as this membership continues. PERMITTING STRATEGY Waste Load Allocation (WLA) The Division prepared the last WLA for the previous permit renewal. The previous and current effluent limits were based on guidelines and water quality standards. The Division has judged previous parameters and limits to be appropriate for renewal with some exceptions. Changes to toxicant monitoring are discussed in the Reasonable Potential Analysis section. Weekly average ammonia limits based on a 3:1 ratio with the monthly average will be implemented in this permit. This is a new statewide policy that resulted from EPA requirements. The resulting summer weekly average limit will be 3.0 mg/L and the winter limit will be 6.0 mg/L. In addition, an annual pollutant scan will be added such that the Permittee can collect the necessary data required by EPA Form 2A throughout the permit term. This condition is now standard on all major municipal permits in North Carolina. Reasonable Potential Analysis (RPA) The Division conducted EPA -recommended analyses to determine the reasonable potential for toxicants to be discharged by this facility, based on DMR and pretreatment data from January 2002-January 2006. Calculations included parameters listed in the previous permit and pre- treatment documents to include: cadmium, fluoride, mercury, molybdenum, copper, and zinc. Results suggest no reasonable potential for the facility to discharge cadmium, fluoride, molybdenum, or copper. Therefore, the fluoride limit will be removed and the monitoring reduced to 2/month. Zinc showed reasonable potential, but is an action level standard. Since the facility has not been experiencing toxicity, monitoring will be continued with no limit. Mercury has an allowable concentration of 12 ng/L. In the initial analysis, only nine data points using Method 1631 were available; the highest actual concentration was 5.1 ng/l and the maximum predicted concentration was 14.6 ng/L. At the Division's request, the permittee collected five additional samples, all of which measured below 2 ng/1. The additional data lowered the maximum predicted effluent concentration to 12.5 ng/1. Due to the small data set, the recent implementation of the new low-level method change, the lack of impairment for mercury in the receiving waters, and the highest actual concentration of less than half the allowable, the Division recommends that mercury continue to be monitored in the LTMP without being limited in the permit at this time. Toxicity Testing Current Requirement: Chronic toxicity P/F @ 90%; January, April, July, October. The facility has consistently passed the toxicity test since 2001. Cape Fear Nutrient Permitting Strategy For the 2006 permit renewal cycle the Division developed a permitting strategy to address nutrient concerns in the Cape Fear River Basin. This strategy is being applied at permit renewal to existing discharges on the basin. The strategy calls for additional nutrient monitoring and Fact Sheet NPDES NC0047597 Renewal Page 2 reporting to support the efforts of the Modeling and TMDL Unit in developing special studies and TMDL projects. Dischargers in the Jordan Lake watershed will monitor TN and TP 3 times per week, report nitrogen species, and report TN and TP as both concentration and mass loads. The permit also includes a re -opener special condition. In the event that the Environmental Management Commission adopts a nutrient management strategy or the EPA approves a TMDL in the coming permit term, the condition allows the Division to re -open affected permits to set nutrient limits and related conditions accordingly. SUMMARY OF PROPOSED CHANGES In keeping with Division policies, the following will be incorporated into the permit: • New weekly average ammonia limits (both summer and winter) • Annual pollutant scan included • Elimination of the fluoride limit and reduction of the monitoring frequency to 2/month • Nutrient monitoring and reporting as per new Cape Fear Nutrient Strategy. The following comments address concerns by the City of Durham: 1. There appears to be a typographical error in the Effluent Limitations and Monitoring Requirement sheet as the frequency for Fluoride monitoring does not match the monthly monitoring as proposed in the cover letter. The City is requesting the Fluoride monitoring requirement be removed based on over 10 years of effluent fluoride analyses with all concentrations well below the 1.8 mg/1 limit, see attachment. Effluent Fluoride samples will still be analyzed quarterly as part of the Long Term Monitoring Plan. 2. The Division of Water Quality is recommending three times per week monitoring for Total Phosphorous and Total Nitrogen which includes Total Kjeldahl Nitrogen, Nitrite Nitrogen and Nitrate Nitrogen. The cover letter states the additional data is needed to support the modeling efforts for special studies and TMDL projects. The City is requesting the monitoring frequency remain weekly for both parameters. The South Durham Water Reclamation Facility has been operating biological nutrient removal processes for over 10 years. In 1995 and 1996 Total Nitrogen was analyzed monthly and Total Phosphorous weekly. Given the amount of data already collected, it would not appear additional three times per week sampling would provide significant benefit that would justify the cost of the additional analyses. Especially, since Jordan Lake will not be sampled at the same frequency to provide a direct correlation. In addition, it appears that no other dischargers to Nutrient Sensitive Waters have a three times per week testing requirement. All waters are Impaired on an evaluated basis in the fish consumption category because of fish consumption advice that applies to the entire basin. In the water supply category, all WS classified waters (10,902.4 acres and 124.9 miles) are Supporting on an evaluated basis based on reports from DEH regional water treatment plant consultants. Refer to Appendix X for a complete list of monitored waters and more information on Supporting monitored waters. There were 53.6 stream miles (28.5 percent) and 8,288.8 freshwater acres (76 percent) monitored during this assessment period in the aquatic life category. There were 21.1 miles (11.2 percent) and 8,288.8 acres (76 percent) of Impaired waters in this category. There were also 3.3 miles (1.7 percent) Impaired for recreation in this subbasin. 5.3 Status and Recommendations of Previously and Newly Impaired Waters The following waters were either identified as Impaired in the previous basin plan (2000) or are newly Impaired based on recent data. If previously identified as Impaired, the water will either remain on the state's 303(d) list or will be delisted based on recent data showing water quality improvements. If the water is newly Impaired, it will likely be placed on the 2006 303(d) list. The current status and recommendations for addressing these waters are presented below, and each is identified by an assessment unit number (AU#). Refer to the overview for more information on AUs. Information regarding 303(d) listing and reporting methodology is presented in Appendix VII. 5.3.1 B. Everett Jordan Reservoir New Hope Creek Arm [AU # 16-41-1-(14)] New Hope River Arm [AU # 16-41-(0.5) and (3.5)a] Morgan Creek Arm [AU # 16-41-2-(9.5)] (Subbasin 03-06-06) Haw River Arm [AU # 16-(37.3) and (37.5)] (Subbasin 03-06-04) 2000 Recommendations The 2000 basin plan recommended that DWQ continue to monitor Jordan Reservoir to assess impacts from increasing wastewater discharges and development in the watershed and to update the NSW strategy for the reservoir and its watershed. Current Status Jordan Reservoir (9,766.5 acres) is Impaired because the chlorophyll a standard was violated at stations in all mainstem segments of the reservoir and because modeling indicated violations of the chlorophyll a standard in the New Hope Creek, Morgan Creek and Haw River Arms of the reservoir. The highest chlorophyll a levels were collected from August to November. Chlorophyll a levels exceeded the standard in 73 percent of samples in the New Hope River Arm and in 13 percent of samples in mid reservoir. Blooms of blue-green algae associated with taste and odor problems in drinking water were observed in July 2003. The reservoir has been eutrophic since 1982. The Beaver Creek, Parkers Creek and White Oak Creek Arms (2,613.5 Chapter 5 — Cape Fear River Subbasin 03-06-05 55 acres) are Not Rated for aquatic life. Data to assess recreation use support were not collected in the reservoir. 2005 Recommendations Refer to Chapter 36 for complete discussions of the Jordan NSW strategy, TMDLs, modeling, monitoring, HB515 and SB1366. DWQ, with the Jordan stakeholders, will continue to monitor the reservoir to assess water quality changes associated with implementation of the NSW strategies. Segments 16-41-1-(14), 16-41-1-(0.5) and 16-41-2-(9.5) will remain on the 303(d) list. The Haw River and New Hope River Arms will be added to the 303(d) list. TMDLs are currently being developed to address the Impairment in Jordan Reservoir (Chapter 36). 5.3.2 New Hope Creek [AU# 16-41-1-(0.5)a, b, and (11.5)a, b and el 2000 Recommendations The 2000 basin plan recommended that DWQ work with the stormwater programs to help improve water quality in New Hope Creek. DWQ also encouraged smaller facilities to connect to the regional WWTP where possible. Current Status New Hope Creek [16-41-1-(0.5)a] from source to Sandy Creek (17.4 miles) is Supporting aquatic life because of a Good -Fair benthic community rating at site BB324. New Hope Creek [16-41-1-(0.5)b and (11.5)a] from Sandy Creek to SR 2220 (1.1 miles) is Supporting aquatic life because of a Good -Fair fish community rating at site BF57. The creek had no intolerant species indicating degraded water quality. New Hope Creek [16-41-1-(11.5)b] from SR 2220 to I-40 (3.5 miles) is Impaired for aquatic life because the dissolved oxygen standard was violated in 13 percent of samples and the turbidity standard was violated in 12 percent of samples collected during the assessment period at site BA177. This segment is Not Rated for recreation because fecal coliform bacteria screening criteria were exceeded at site BA177. DWQ performed a statistical trend analysis at site BA177 using total nitrogen, total phosphorus and total suspended solids data collected from 1990 to 2004. There was a significant decrease in total nitrogen of 0.17 mg/1 per year in New Hope Creek. Downward trends were noted for total phosphorus and total suspended solids, although these trends were not significant. New Hope Creek [16-41-1-(11.5)c] from I-40 to SR 1107 (4 miles.) is Impaired for aquatic life• because of a Fair benthic community rating at site BB238. The riparian zone was intact at site BB238, but the banks were steep and eroding and there was little pool and riffle habitat. The stream also contains trash from the surrounding urban watershed. DWQ completed a fecal coliform study in New Hope Creek in 2000 and determined that fecal coliform bacteria did not exceed the standard in this segment. This segment is Supporting recreation because of this sampling. There are many single family NPDES permitted discharges in this watershed that may contribute oxygen -consuming wastes as well as bacteria and nutrients. Chapter 5 — Cape Fear River Subbasin 03-06-05 56 2005 Recommendations DWQ will continue to monitor the New Hope Creek to identify stressors to the benthic community. DWQ will continue to work with Durham stormwater program to pursue funding for BMPs in the New Hope Creek watershed to further decrease nutrient loading into Jordan Reservoir. Further recommendations to protect streams in urbanizing areas and to restore streams in existing urban areas are discussed in Chapter 31. Segment 16-41-1-(11.5)b and c remain on the 303(d) list. Segments 16-41-(0.5)a and b and 16- 41-(11.5)a will be removed from the 303(d) list. TMDLs (Chapter 35) will be developed for identified stressors within 8-13 years of listing. Water Quality Initiatives In 1997, Durham County received a $750,000 CWMTF (Chapter 34) grant to purchase 340 acres of conservation easements along New Hope Creek [16-41-1-(0.5)a] and Mud Creek [16-41-1-10] in this watershed. The Triangle Land Conservancy (Chapter 34) also received a $2,750,000 CWMTF grant to acquire 392 acres along the New Hope Creek Greenway. In 1998, Chapel Hill received a $502,000 CWMTF grant to acquire 105 acres of permanent easements along Dry Creek. In 1999, NCEEP (Chapter 34) received a $582,500 CWMTF grant to stabilize and restore 450 linear feet of Sandy Creek [ 16-41-1-11 ] in Duke Forest and to construct a bioretention areas to treat runoff from 25 acres of urban area. This grant also included restoration of 8.2 acres of bottomland hardwood wetlands in the New Hope Creek watershed. The NCEEP completed 3,000 linear feet of stream enhancement in the Sandy Creek watershed. 5.3.3 Northeast Creek [AU # 16-41-1-17-(0.7)a, bl and b2] 2000 Recommendations The 2000 basin plan recommended that DWQ work with the stormwater programs to help improve water quality in Northeast Creek. Current Status Northeast Creek [ 16-41-1-17-(0.7)a] from US 55 to Durham Triangle WWTP (3.3 miles) is Impaired for aquatic life because the turbidity standard was violated in 15 percent of samples and the dissolved oxygen standard was violated in 11 percent of samples at sites BA197. This segment is Supporting recreation because the fecal coliform bacteria standard was not violated during intensive sampling to assess the standard at site BA197. Northeast Creek [ 16-41-1-17-(0.7)b l ] from Durham Triangle WWTP to Kit Creek (3.3 miles) is Impaired for aquatic life because the turbidity standard was violated in 10.3 percent of samples at site BA209. This segment is Impaired for recreation because the fecal coliform bacteria standard was violated during intensive sampling to assess the standard at site BA209. Northeast Creek [16-41-1-17-(0.7)b2] from Kit Creek to downstream of Panther Creek (3.2 miles) is Impaired for aquatic life because the turbidity standard was violated in 15 percent of samples at site BA209. This segment is Supporting for recreation because the fecal coliform bacteria standard was not violated during intensive sampling at site BA209. DWQ developed a fecal coliform bacteria TMDL that was approved by EPA in September 2003. The TMDL recommended a 90 percent reduction in bacteria loading from urban stormwater in Durham (Chapter 35). In 1990, the facility was upgraded to include processes for chemical and biological phosphorous removal in addition to belt filter presses for sludge dewatering. Traveling bridge effluent filters were also added to improve effluent quality. In 1994, the facility was expanded to 20 MGD and upgraded to include biological nutrient removal, gravity belt thickeners, ultraviolet light disinfection, odor scrubbing and a computer control system. With the addition of two anaerobic digesters in 1998, all sludges, primary and waste activated, are digested anaerobically then land applied as a Class B product. The City contracts with Synagro Southeast to land apply biosolids to privately owned farm land that is permitted in the City of Durham's name. The South Durham facility is home to the Water and Wastewater Laboratory. This state - certified laboratory runs the majority of analyses for two (2) water plants, two (2) wastewater plants, the Industrial Pretreatment Program and the Storm Water Program. At present no other construction is planned for the facility. Dewatered biosolids are stored on a sludge storage pad and land applied as a Class B product on permitted sites under Land Application Permit, WQ0003504. The City contracts with Synagro for the land application of all solids produced at the facility. By the mid-1990s the program was fully implemented. The major areas of the program are: Data Management - The City has 41 permanent flow monitors in its collection system. These monitors are checked daily for indications of line failures or Sewer System Overflows (SSOs). The flow data helps direct the efforts of the program. The City maintains a Rodding Database (since 1990) of all the lines are rodded and cleaned. This is used to identify repeat blockages that need to be addressed with preventative maintenance. Outfall Maintenance — The City actively maintains its sewer outfalls to ensure accessibility for both routine maintenance and emergencies. The City maintains two mowing crews. In addition the City contracts out over 90 miles of mowing annually. Cleaning — The City cleans between 500,000 - 600,000 feet of sewer lines on an annual basis using City staff. The new state collection system permit requires the City to clean 10% of the system on an annual basis. An additional 150,000 feet will be cleaned using private contractors to meet the new permit requirements. Inspections — The City inspects approximately 100,000 feet of sewer line on an annual basis using Closed Circuit TV (CCTV). In fiscal year 2005 - 2006 the City plans to increase the annual CCTV inspection to 250,000 feet. CCTV inspections identify lines that need to be rehabilitated or replaced. The City also performs biannual inspections of its high priority lines. In addition, the City conducts manhole inspections. Preventive Maintenance — By analyzing the rodding database, the City has identified sewer lines that have repeat blockages due to roots or grease. The City has contracted root control contracts in previous years as areas were identified; a contract is planned for this fiscal year. The City anticipates having a grease control contract underway this year as well. Rehabilitation/Replacement - CCTV inspection identifies lines that need to be rehabilitated or replaced. These lines are prioritized on a point repair/replacement list that is updated monthly. City crews perform work on the higher priority lines. The City contracts out between $750,000 - $1,500,000 annually for point repairs and line replacement. Summary: The City maintains an extensive Sewer Rehabilitation Program. In addition to existing City maintenance efforts, the City has approved $2,200,000 in the FY 2005 - 2006 budget for sewer rehabilitation. The fall 2005 bond referendum also includes $4,300,000 for sewer rehabilitation. This year the City will contract for replacement of over six miles of its oldest sewer outfalls as well as replacing a major pump station.
