Dear Mr. Finnegan,
This is with reference to the request received by Bryan Hail, Field Representative, to refine State Permit No.
73-22, which was issued to Joel Hartzler on July 7, 2022, that includes a three (3) slip docking facility and
dredging at 108 Teakwood Drive, adjacent to the Carolina Beach Yacht Basin, in Carolina Beach, New
Hanover County. State Permit No. 73-22 is due to expire on December 31, 2025.
The first action proposed in your request consists of shifting the authorized 16' long x 16' wide gazebo T-
head to the south, which would create a L-head with the gazebo to the south of the authorized pier. The
second action proposed is to extend the 6' wide fixed pier to 212' to encompass previously authorized
footprint of the 16' long x 16' wide gazebo and allow access to the authorized floating docks. The third action
is to change the 16' long x 16' wide gazebo to 14' long by 16' wide gazebo (See 1-3 dated received on
10/10/22 and 10/11/22).
Upon reviewing the information provided, the Division of Coastal Management has determined that the
proposed action is consistent with existing State rules and regulations and is in keeping with the original
purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit No.
73-22 as described in your drawing dated received October 10, 2022. Please note this refinement does not
alleviate the need to obtain any other local, state or federal permits.
