WBS # 32635.3.FR6 Dear Ms. Tracey Wheeler, The North Carolina Department of Transportation is requesting a GP 291 to correspond with the modification of CAMA Major Permit # 104 -11 to allow for the mining of approximately 30- 50,000 cubic yards of sand from the Oregon Inlet groin area. The proposed boundary for excavation is outlined on the provided, map. The configuration of excavation within this area will be determined in the field by the USFWS refuge manager, with the intent to improve shore bird foraging habitat by creating shallow pools. The depth of excavation will not exceed 5 feet in any location. NCDOT will not enter the USACOE jurisdictional areas depicted on the map, which was determined during an agency field visit on 10/25/14 (included USACOE, NCDCM, USFWS, and NCDOT). Access to the mining area will be through a previous access point that limits disturbance to existing vegetated dune areas, bordering the Old Coast Guard Station. This access point will be utilized by off -road dump trucks, bulldozer and excavator. Sand material mined from the groin area will be temporarily located within the Old Coast Guard Station parking lot area. This sand will be utilized to construct a protective dune line on the southeast side of New Inlet. The dune creation is an effort to reduce the amount of over wash water that is ponding on NC 12. The water ponding along NC 12 has created lane closures and is a safety issue for vehicles traveling through this location. The proposed dune will be approximately 580 feet in length and have a base width of 25 -30 feet, with a height of 10 feet. It will tie into the existing dune lines along this area. Disturbance to existing vegetated dunes will be avoided and minimized to the- maximum extent possible. The over wash ponded /wet sand area has been claimed by the USACOE, as jurisdictional surface waters. The proposed dune alignment is within the 113 Airport Dr., Suite 100, Edenton, NC 27932 — Phone: (252) 482 -1850 Fax: (252) 482 -8722 jurisdictional surface water area and will result in 0.27 acres of surface water impact. This impact is shown on the provided modified permit drawings. The proposed sand mining from the groin area and dune construction project will take place outside of the active bird and sea turtle nesting time periods. Work will be scheduled to take place between November 15 and April 1St to avoid any potential impact to protected species. No work will take place, until approval from the USFWS, USACOE, NCDCM and NCDWR has been obtained. Department of Transportation, 113 Airport Drive, Suite 100, Edenton, NC 27932 Authorizing development in Dare County at NC 12 six miles south of Oregon Inlet, Pea Island NWR , as requested in the permittee's application dated 11/7/12 including attached workplan drawings (2), 1 aerial plan view drawing dated 11/6/12 and 1 typical section drawing dated 11/5/12. This permit, issued on November 8, 2012 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Emergency Response 1) Unless specifically altered herein, this minor modification to Permit No. 104-11 authorizes the addition of 570 linear feet of slope - stabilization sandbags to the west side of the roadway south of the temporary bridge, and the addition of 170 linear feet slope - stabilization sandbags to the west side of the roadway north of the temporary bridge, all as depicted on the attached workplan drawings. Any other development activities may require additional authorization. 2) Nothing in this minor modification authorizes any activity that has not received approval from the U.S. Fish and Wildlife Service ( USFWS) for work within the Pea Island National Wildlife Refuge. Should additional authorization from the USFWS be required for any portion of the authorized project, the permittee shall obtain this authorization prior to initiating that portion of the project. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on April 30, 2015 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal, Management Program.
