The purpose of the proposed project is to construct a single-family housing development to meet the growing demand for residential housing in Brunswick County. The development is
proposed to be constructed in a single phase. The proposed project consists of the construction of a single-family housing development comprised of 190 units, amenity building, pool,
public greenway, green space, and associated infrastructure (roads, parking, utilities, stormwater management, etc.).

The proposed Lockwood 211 Subdivision project is located on one parcel (PIN: 202909155651) totaling ±96.81 acres located at 200 Stone Chimney Road, south of the intersection of
Stone Chimney Road SW and Southport Supply Road SE/211 in Supply, Brunswick County (Lat: 34.011272°N;-78.269145°W).
The project is in the Lumber River basin and onsite waters drain to Lockwood Folly River. The Water Quality Classification for the Lockwoods Folly River is SC; HQW and the Stream Index
Number is: 15-25-1-(11). The cataloging unit for the site is 03040208.
The purpose of the proposed project is to construct a single-family housing development to meet the growing demand for residential housing in Brunswick County. The development is
proposed to be constructed in a single phase.
The project consists of the construction of the following:

E. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be
minimized.
Proposed permanent impacts for construction of the subdivision and infrastructure have been minimized to only those necessary for construction of a
single road crossing connecting the internal roadways to Stone Chimney Road SW.
The proposed road crossing has been designed to minimize wetland impacts by crossing the wetlands at the narrowest practical point where a gap in
the wetlands exists due to an existing culverted farm road crossing. Backslopes to stabilize and return road fill to natural grade have been designed at
3:1 slopes to minimize impacts.
Retaining walls have been designed and located within the site at various locations to stabilize site/lot fill to eliminate further impacts from traditional
backslopes that would have encroached into the wetlands. One temporary wetland impact (Impact W7) is necessary to allow for wall construction. No
impacts are proposed for stormwater, lot fill, or other roadways.
lb. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Construction techniques used to avoid or minimize impacts include installation of erosion & sediment control devices prior to construction. Matting will be
used where necessary to minimize the extent of impacts within the construction corridor. Silt fencing will be installed around all disturbed areas to
prevent sediment from escaping into undisturbed wetlands, and access during construction will be within uplands.

In February 2022, WR conducted a pedestrian survey of the review area to assess vegetative communities, and identify potential habitat for, or
occurrences of federal and state listed threatened and endangered species. WR requested a USFWS review of the survey listed species for
concurrence. In a later dated 4/28/2022, USFWS concurred that the proposed project is not likely to adversely affect federally listed threatened or
endangered species, their habitat, or species currently proposed for listing. Please see attached USFWS concurrence letter.

Froehling & Robertson requested a SHPO review for known occurrences of archeological, cultural, and historical resources within or in the vicinity of the
subject site. On January 25, 2022, SHPO recommended a comprehensive archeological survey be conducted. Archaeological Consultants of the
Carolinas, Inc. investigated the project area. As a result of the investigation, five new archeological sites were recorded within the project area. Due to
disturbance at each of these sites, SHPO recommended all five sites were not eligible for the NRHP and no further work is advocated. SHPO concurred
in a May 27, 2022, letter that no further archeological work was necessary. Please see attached SHPO letters.

The impacts associated with the access road from Stone Chimney Road will occur within the FEMA 100-year floodplain. However, there is no associated
FEMA Floodway, as the 100-year floodplain is associated with tidal flooding rather than stream flow. The culvert has been designed to not impede
movement of floodwaters within the FEMA 100-year floodplain. Furthermore, the road crossing/culvert will be reviewed and approved by the Brunswick
County Floodplain Manager and issued a Floodplain Development Permit.

Dear Mr. Beecher and Mr. Wojoski,
On behalf of Pulte Home Corporation, we are requesting authorization from the USACE to use
NWP’s 14 and 29, as well as requesting a 401 WQC from NCDWR, for the following impacts:
Because proposed impacts for the road crossing are within the 100-year floodplain, an NWP 29
cannot be used for the entire project, therefore WR is requesting the impacts for the road crossing
be authorized under an NWP 14 and the temporary wetland impacts for the retaining wall
construction be authorized under NWP 29. The proposed total permanent impacts to jurisdictional
waters requested are less than 0.5 acres. Therefore, the proposed impacts are eligible for
authorization under an NWP.
Please note that the project will not result in disturbance within the CAMA 75’ AEC associated
with the Lockwoods Folly River and therefore a CAMA permit from NCDCM is not required.
The proposed project consists of the construction of a single-family housing development

Project History
WithersRavenel completed a delineation for the project area in November 2021. The USACE
issued a Preliminary Jurisdictional Determination for the project area on 6/6/2022 which has been
attached to this application.
WithersRavenel coordinated with NCDCM in December 2021 and confirmed that the limits of the
tidal waters associated with the Lockwoods Folly River is along the edge of open water within the
river and that the wetlands on the west side of the river are not subject to CAMA jurisdiction. The
CAMA 75’ AEC is offset from the normal high-water line of the Lockwood Folly River as shown in
the attached Impact Maps.
Froehling & Robertson requested a SHPO review for known occurrences of archeological, cultural,
and historical resources within or in the vicinity of the subject site. On January 25, 2022, SHPO
recommended a comprehensive archeological survey be conducted. Archaeological Consultants
of the Carolinas, Inc. investigated the project area. As a result of the investigation, five new
archeological sites were recorded within the project area. Due to disturbance at each of these
sites, SHPO recommended all five sites were not eligible for the NRHP and no further work is
advocated. SHPO concurred in a May 27, 2022, letter that no further archeological work was
necessary. Please see attached SHPO letters.

NWP 14 - Road Crossing
0.086 acres of permanent impacts and 0.015 acres of temporary impacts for the following:
• Permanent Stream Impacts - 0.015 ac (149 lf)
• Permanent Wetland Impacts - 0.071 ac
• Temporary Stream Impacts – 0.003 ac (15 lf)
• Temporary Wetland Impacts – 0.012 ac
Impacts S1-S4 & W1-W5 - for construction of a road crossing of Wetland B. This road crossing
will provide a required second point of access to Stone Chimney Road SW. This crossing is
proposed at a location where there is a gap in Wetland B at the location of an existing culverted
farm road. The crossing has been designed with a 133.5-ft long x 48-inch culvert. The culvert has
been designed for the culvert to be buried 20% below the stream bed. A riprap dissipator will be
constructed below the culvert to reduce flow velocity and prevent erosion within Wetland B and
Stream 3. To ensure correct alignment from the culvert, a constructed channel will be created
through the rip rap dissipater. Temporary impacts are necessary at the road crossing for
construction access.

Impact W6 – for construction of a retaining wall at the northeast side of lots 20-22 to avoid
permanent impacts to Wetland B.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and “waters” could be minimized.
Proposed permanent impacts for construction of the subdivision and infrastructure have been
minimized to only those necessary for construction of a single road crossing connecting the
internal roadways to Stone Chimney Road SW.
The proposed road crossing has been designed to minimize wetland impacts by crossing the
wetlands at the narrowest practical point where a gap in the wetlands exists due to an existing
culverted farm road crossing. Backslopes to stabilize and return road fill to natural grade have
been designed at 3:1 slopes to minimize impacts.
Retaining walls have been designed and located within the site at various locations to stabilize
site/lot fill to eliminate further impacts from traditional backslopes that would have encroached
into the wetlands. One temporary wetland impact (Impact W7) is necessary to allow for wall
construction. No impacts are proposed for stormwater, lot fill, or other roadways.
Construction techniques used to avoid or minimize impacts include installation of erosion &
sediment control devices prior to construction. Matting will be used where necessary to minimize
the extent of impacts within the construction corridor. Silt fencing will be installed around all
disturbed areas to prevent sediment from escaping into undisturbed wetlands, and access during
construction will be within uplands.

Mitigation
Wetland Mitigation
The proposed project will result in 0.071 acres of permanent wetland impacts. Because the
proposed permanent wetland impacts requested do not exceed the 0.10-acre wetland mitigation
threshold the applicant does not propose to provide wetland mitigation.
Stream Mitigation
The proposed project will result in 0.015-acres (149 lf) of permanent stream impacts. Because the
proposed permanent stream impacts do not exceed 0.02 acres (USACE) or 150 lf (NCDWR) the
application does not propose to provide stream mitigation.
Stormwater Management Plan
The stormwater management plan consists of three wet detention SCMs. The stormwater
management plan will be reviewed and approved by NCDEQ-DEMLR and Brunswick County.

1)The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2)In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non-reporting NWP or other general permit,
and the permit applicant has not requested an AJD for the activity, the permit applicant is
hereby made aware that: (1) the permit applicant has elected to seek a permit authorization
based on a PJD, which does not make an official determination of jurisdictional aquatic
resources; (2) the applicant has the option to request an AJD before accepting the terms and
conditions of the permit authorization, and that basing a permit authorization on an AJD could
possibly result in less compensatory mitigation being required or different special conditions;
(3) the applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can accept
a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary;
(5) undertaking any activity in reliance upon the subject permit authorization without
requesting an AJD constitutes the applicant's acceptance of the use of the PJD; (6) accepting a
permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in

jurisdictional, and waives any challenge to such jurisdiction in any administrative or judicial
compliance or enforcement action, or in any administrative appeal or in any Federal court;
and (7) whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms and
conditions contained therein), or individual permit denial can be administratively appealed
pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to
make an official determination whether geographic jurisdiction exists over aquatic resources
in the review area, or to provide an official delineation of jurisdictional aquatic resources in
the review area, the Corps will provide an AJD to accomplish that result, as soon as is

This letter is to inform you that t he Service has established an on-line project plannin g and
consultation process which assists developers and consultants in determining whether a
federally-listed species or designated critical habitat may be affected by a proposed project. For
future projects, please visit the Raleigh Field Office’s p roject planning website at
https://www.fws.gov/office/eastern-north-carolina/project -planning-and -consultation. If you are
only searching for a list of species that may be present in the project’s Action Area, then you
may use the Service’s Information, Planning, and Consultation System (IPaC) website to
determine if any listed, proposed, or candidate species may be present in the Action Area and
generate a species list. The IPaC website may be viewed at https://ipac.ecosphere.fws.gov/.
The IPaC web sit e contains a complete and frequently updated list of all endangered and
threatened species protected by the provisions of the Endangered Species Act of 1973, as
amended (16 U.S.C. 1531 et seq.)(Act), a list of fede ral species of concern1 that are known to
occur in each county in North Carolina, and other resources.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, ensure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally-listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether add itional consultation with the
Service is necessary. In addition to the federally-protected species list, inf ormation on the
species’ life histories and habitats and information on completing a biological assessment or

Please check the web site often for updated information or changes.
If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species’ presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted f or actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally-protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might af fect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environment al Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
With regard to the above-referenced project, we offer the following remarks. Our comments are
submitted pursuant to, and in accordance with, provisions of the Endangered Species Act.
Based on the information provided and other information available, it appears that the proposed
action is not likely to adversely affect any federally-listed endangered or threatened species, their
formally designated critical habitat, or species currently proposed for listing under the Act at
these sites. We believe that the requirements of section 7(a)(2) of t he Act have been satisfied for
your project. Please remember that obligations under section 7 consultation must be
reconsidered if: (1) new information reveals impac ts of this identified action that may affect
listed species or critical habitat in a manner not previously considered; (2) this action is
subsequently modified in a manner that was not considered in this review; or, (3) a new species
is listed or critical habitat determined that may be affected by the identified action.
However, t he Service is concerned about the potential impacts the proposed action might have
on aquatic species. Aquatic resources are highly susceptible to sedimenta tion. Therefore, we
recommend that all practicable measures be taken t o avoid adverse impacts to aquatic species,
including implementing directional boring methods and stringent sediment and erosion control
measures. An erosion and sedimentation control plan should be submitted to and approved by
the North Carolina Division of Land Resources, Land Quality Section prior to construction.
Erosion and sedimentation controls should be installed and maintained between the construction
site and any nearby down-gradient surface waters. In addition, we recommend maintaining
natural, vegetated buffers on all streams and creeks adjacent to the project site.
The North Carolina Wildlife Resources Commission (NCWRC) has developed a Guidance
Memorandum (found at https://www.ncwildlife.org/Conserving/Learn-Resources/Ways-to-
Conserve) to address and mitigate secondary and cumulative impacts to aquatic and terrestrial
wildlife resources and water quality. We recommend that you consider this document and the
NCWRC ’s other conservation recommendations in the development of your project s and in
completing an initiation package for consultation (if necessary).

information about natural heritage resources for the project referenced above.
A query of the NCNHP database indicates that there are records for rare species, important natural

Thank you for your December 23, 2021, submission concerning the above-referenced project. We have
reviewed the project and offer the following comments.
While the area appears to be predominantly cleared farmland, there are two known historic archaeological
sites within the Area of Potential Effect (APE): 0002LFR, and BW535, which is a historic cemetery located
in the northeast of the APE. The APE’s proximity to Lockwood’s Folly River also raises the potential for
prehistoric sites to be present. We, therefore, recommend a comprehensive archaeological survey be
undertaken prior to any ground disturbing activities in the project area.
The purpose of this survey is to identify archaeological sites and make recommendations regarding their
eligibility status in terms of the NRHP. This work should be conducted by an experienced archaeologist
that meets the Secretary of the Interior Professional Qualifications Standards. A list of archaeological
consultants who have conducted or expressed an interest in contract work in North Carolina is available at
https://archaeology.ncdcr.gov/archaeological-consultant-list. The archaeologists listed, or any other
experienced archaeologist, may be contacted to conduct the recommended survey. Please note that our
office requests consultation with the Office of State Archaeology Review Archaeologist to discuss
appropriate field methodologies prior to the archaeological field investigation.
One paper copy and one digital copy (PDF) of all resulting archaeological reports, as well as a digital copy
(PDF) of the North Carolina Site Form for each site recorded, should be forwarded to the Office of State
Archaeology (OSA) through this office, for review and comment as soon as they are available and in
advance of any construction or ground disturbance activities. OSA’s Archaeological Standards and
Guidelines for Background Research, Field Methodologies, Technical Reports, and Curation can be found

We have determined that the project as proposed will not have an effect on any historic structures.

on April 27, 2022. We have reviewed this report which meets our standards and those of the Department of
the Interior and offer the following comments.
Your archaeological survey resulted in the following:
• The identification of five new archaeological sites.
• Two of these sites represent prehistoric occupations. Two have historic occupations. Two have both
prehistoric and historic components.
• Due to disturbance at each of these sites, all are recommended not eligible for the NRHP. They have
fulfilled their research potential at this level of investigation and no further work is advocated.
Based on the information provided, we concur with your determination. We also concur with your
recommendation that no further archaeological work is needed for these sites and that the project can
proceed as recommended within the APE.
