Subject: Request for additional stream mitigation for the widening of NC 67 from SR 1355
(Messick Road) to US 601 in Booneville, Yadkin County. State Project
No. 6.771008. Division 11. R-3415.
The purpose of this letter is to request that the North Carolina Ecosystem Enhancement
Program (EEP) provide confirmation that you are willing to provide compensatory mitigation for
the project in accordance with the Memorandum of Agreement (MOA) signed July 22, 2003 by
the USACE, the NCDENR and the NCDOT. This letter supercedes a previous request dated
November 29, 2004 and December 13, 2004. Since these requests impact numbers have
changed.
RESOURCES UNDER THE JURISDICTION OF SECTION 404 AND 401 OF THE CLEAN
WATER ACT.
We have avoided and minimized the impacts to jurisdictional resources to the greatest extent
possible as described in the permit application. There are jurisdictional stream impacts that need
compensatory mitigation. This mitigation will be provided by the EEP program. An application
for a Nationwide Permit will be submitted upon receipt of acceptance of this mitigation. A copy
of the permit application, when submitted, can be found at

The project is located in the Yadkin-Pee Dee River basin in Hydrological Cataloguing Unit
03040101. Additional impacts of 14 ft of cool water streams will occur.
• Revised total impacts for the entire project are to 12121inear feet of streams (937 ft of cool
water streams, 275 ft of warm water streams).

In order to satisfy regulatory assurances that mitigation will be performed; the NCDWQ
requires a formal letter from EEP indicating their willingness and ability to provide the
mitigation work requested by NCDOT. The NCDOT requests such a letter of confirmation be
addressed to Mr. John Hennessy of NCDWQ, with copies submitted to NCDOT.
