I connected with Phillip Tripp of Tripp Engineering. They are willing to support the issuance of the designer certification;
however, they will need to get the basin surveyed to compare to the design before they will issue the certificate. lam
working with him to get me a proposal and schedule the surveyor. He indicated that they are very busy but will do their
best to work us in in a timely fashion.
Given that the designer certification issuance may take a few weeks, I will endeavor to submit the renewal for
processing as you indicated below.

Application. As requested under Section C— Submittal Requirements, it looks like we need to submit the Designer
Certification with the renewal. However, as you noted in the letter, this was never done for this project. How should I

Hello All,
The reason HMF Realty was tagged at the bottom of the letter was because your organization is the current owner of
the property. Stormwater permits are not included with the buying and selling of properties, so while y'all own the
property, Therma-Tru is still the permittee. A transfer request is required to transfer ownership of the permit from
Therma-Tru to HMF Realty, LLC, and both companies are needed to undergo the transfer. I'll go ahead and include the
transfer application form and the email of Sean Melville (SMelvillee mlock.com), a representative from Therma-Tru.
Also here is a copy of the most recent permit for this site.

Thanks for your clarification.

The letter you sent was to Therma Tru corporation. My involvement has been with HMF Express in the past, and now
HMF Realty, the current owner of the building. We purchased the building from Southside Holdings, and I believe they
purchased it from Therma Tru.
I am not clear as to who is the permit holder and what the obligations of HMF Realty are in regard to this matter. Also, if
you can send a copy of the subject permit, that may help us to understand our next steps. Can you do?

The NCG/NPDES file is related to industrial processes and works to make sure that the project in question isn't leaching
or exposing water resources to materials, chemicals, harmful residues, etc. It doesn't exclude the permittee from

I was copied on your letter dated July 151, 2022 regarding renewal of permit SW8 980611.
My understanding is that the property was excluded from renewal due to its Exclusion No. NCGNE0621. My last
involvement with the subject Exclusion was the required self -certification letter dated January 29, 2019. At one point
we were operating under permit NCF030584; you may reference this permit as well to get a full history on compliance.
I will copy several of the interested parties on this message and will attach your July 151h letter and the Exclusion
documents for reference.
Please reply to all and let us know what next steps may be required, or please send us a letter to correct the status.

We were also contacted by the new property owners today from HMF Realty, LLC about transferring this permit as well.
Both current (Therms-Tru) and proposed (HMF Realty) permittees are required to sign the transfer application.
The contact I currently have for HMF Realty is Bob Drach, ([e-mail]). Please work together as the
application needs to be signed by both parties, with original signatures. We will also be reaching out to Mr. Drach
informing him on the process as well.

Thanks for following up. I have been gathering some information about this permit for you and will share these details
with you.
Attached I have the NC Secretary of State business registration report when Therma-Tru Holdings, Inc. became Therma-
Tru Corp in September of 2000. 1 have also attached the permit that was issued to Therma-Tru Corp, SW8960811 on
March 26, 2001, and the application for that permit that was submitted to our office for review on December 7, 2000,
listing Therma-Tru Corp. as the permit holder. On the New Hanover County registry for deeds, I have found the deeds for
when Therma-Tru Corporation received the property in November of 2000 and when the property was sold in 2006.
If I missed anything or if there any additional information that you have that could be provided, please let me know!
If you have any questions about the renewal or transfer applications, I will be able to help with those also. I appreciate

Post -Construction Stormwater Management Permit SW8 980611 for the subject project expired on March 20h,
2015. This is a reminder that permit renewal applications are due 180 days prior to their expiration per 15A
NCAC 2H.1045(3). North Carolina General Statutes and the Coastal Stormwater rules require that this property
be covered under a stormwater permit. Failure to maintain a permit subjects the owner to assessment of civil
penalties. More information about the Post -Construction State Stormwater Program can be found on the
following website: deq.nc.aov/SW
The renewal timeframe is currently set at 8 years. Since this permit expired on March 26', 2015, two renewals
are needed to return this permit to an active status as demonstrated below:
First renewal: March 26, 2015 + 8 years = March 2011, 2023
Second renewal: March 26t'', 2023+ 8 years = March 26th, 2031
Please submit a complete permit renewal form along with two (2) processing fees of $505.00 for a total of
$1,010.00 and other submittal requirements within 30 days. The permit renewal form can be found under the
Post -Construction section of this website or at: https./;'deq.nc.gov/about/divisions/energy-mineral-and-laud-
resources/stormwater/stormwater-program/post-construction-2. Also, it was noted in the file review that a
designer's certification that the project was constructed in accordance with the approved plans as required by the
permit has not been submitted. Please include this with your application.
Permits are not automatically transferred when the property ownership changes. If this property has had an
ownership change, a permit transfer application form along with the submittal requirements will also need to be
submitted. This form can also be found on the website provided above.
