Dear Mr. Bridges, Mr. Saint, & Mr. Rossi:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Minor Modification Application for the subject project on September 20,
2021. A review of that information has determined that the application is not complete. The
following information is needed to continue the stormwater review:
1. Please correct the following issues with the Application:
a. Part A2-7 & Part D — Per our records, the current permit holder is Classica
Homes. Please either have the permittee (Classica Homes) complete the minor
modification or submit a transfer application (available at the following website:

NOTE: The letter sent to the Mooresville Regional Office by Classica Homes,
dated July 20, 2021, asking to be removed from the permit, is not an acceptable
method to accomplish this goal. The permit must be transferred to another
suitable party via a permit transfer application. Please refer to Section III, General
Conditions, of the December 20, 2019 permit and 15A NCAC 02H .1045 for
more information. The updated permitting language that will be included with this
approved modification will make this process more clear.
NOTE: The rules for certain aspects of permit transferring were recently updated
per Session Law 2021-158 (Senate Bill 389)

have not yet updated our forms to account for this.
b. Part B2 — Since the designer of the proposed SCM is changing and the design
itself is changing, please provide two hard copies and one electronic copy of the
updated versions of the Application Form (SWU-101), Supplement-EZ Form, and
O&M Agreement Form (if applicable) indicating the proposed changes to the
design/designer. It is noted that the Minor Modification Application only requires
updated plan sheets, however, updated forms should also be provided so that the
permit package can accurately reflect the proposed design (this is an older form,
albeit the most up-to-date version, and does not account for minor modifications
that involve a change to the SCM/design forms).
c. Part B3 — The originally approved deed restriction documents indicate that the
lots were allocated a total of 243,085 sf (5.58 ac) of BUA. If the proposed wet
pond is only capturing 5.99 ac of BUA (and there is more than 0.41 ac of roadway
proposed) either the wet pond drainage area information is incorrect, or there has
been a reallocation/reduction in the BUA allocated to the individual lots. Please
either provide the revised deed restrictions (in accordance with this part of the
Application) or revise the wet pond drainage area information/calculations.
NOTE: The originally approved permit indicates that the drainage area of the wet
pond was designed to capture 7.87 ac of BUA whereas this design is only
proposing to capture 5.99 ac (This information will be clarified once the revised
forms and supplements are provided).
2. Please correct the provided stage -storage tables. A note above the main pond permanent
pool storage volume stage -storage table indicates that this table does not include the
forebay, however, the cross -sectional area at the permanent pool elevation in this table
(20,502 sf) is equal to that of the cross -sectional area at the permanent pool elevation of
the temporary storage volume above permanent pool stage -storage table (a note above
this table indicates that the temporary storage volume table accounts for the storage
volume above both the forebay and the main pool). Please revise as needed for
correctness and consistency.
3. This project is located within the Sixmile Creek Watershed which is subject to the Goose
Creek Watershed Rules (15A NCAC 02B .0600). The Goose Creek Watershed Rules
define the design volume as the difference between the pre -development and post -
development 1-year 24-hour storm event (not based on the 1.0" storm as is typical in
other parts of the state) and there is an emphasis on implementing stormwater control
measures that promote infiltration/groundwater recharge. The provided water quality
volume calculations do not appear to take this fact into consideration. Please revise the
design volume/calculations/design to take the Goose Creek Rules into consideration (It
appears as though the "over designed" design volume from the original permit was done
intentionally in order to meet the Goose Creek Rules). NOTE: If this revision to the
design causes an increase in the overall size of the SCM, it will no longer qualify as a
minor modification and will need to be resubmitted as a major modification.
4. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, 1 hardcopy of other
documents, and a response to comments letter briefly describing how the comments have
been addressed.

Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to November 18, 2021, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SW3190703 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
