I understand, we just need to verify that that is the case. Once it has been verified, we will rescind the permit. I have
already drafted up the permit rescission letter, I am just waiting on our inspector to confirm that no work has been done
on the site (it's part of the rescission process). They should be out there sometime this week, hopefully today or
tomorrow.

I received a permit rescission request from the permittee, Classica Homes, today. One of our inspectors will be out at
the site at some point in the near future to verify that construction has not started on -site. If that is the case, I will
rescind the permit and send out a letter confirming that this permit has been rescinded. Once the permit is rescinded, I
will return the minor modification application that we received on 9/20/2021(since a rescinded permit cannot be
modified) and any future development of the site will require a brand new post -construction permit.

I received a phone call from a lawyer representing Classica Homes (I did not catch his name) earlier today essentially
asking how Classica Homes, the current permittee, can be removed from the permit for this project. There are two
options to accomplish this goal:
1) The current permittee completes and submits a Permit Rescission Request Form
(https://deg.nc.gov/about/divisions/energy-mineral-land-resources/energy-mineral-land-rules/stormwater-
program/post-construction, under the "How to Rescind a Post -Construction Permit" heading). Choosing this
option would require the proposed permittee, Toll Southeast LP Company, Inc., to get a brand new post -
construction permit (as opposed to modifying the current permit since the current permit will be rescinded).
2) Both the current and proposed permittees complete and submit a Permit Transfer Application Form
(httos://dea.nc.2ov/about/divisions/ener2v-mineral-and-land-resources/stormwater/stormwater-
program/post-construction-program/permit-transfers-renewals, under the "Permit Transfer & Renewal Forms"
heading). Choosing this option would allow the proposed permittee to keep and modify the existing post -
construction permit (SW3190703). As I mentioned in my October 19, 2021 request for additional information
letter, the permit transfer rules were very recently changed and we have not yet had the opportunity to update
this form to be compliant with the new rules.
