The Division of Energy, Mineral and Land Resources received and accepted a State Stormwater Management Permit
Application for the subject project on July 20, 2021 and requested additional information on August 30, 2021, on
November 8, 2021, and on November 30, 2021. A review of the application indicates that the information requested on
August 30, 2021 has not been received in this Office within the stipulated timeframe. Per the requirements of Title 15A
NCAC 02H .1042(3)(a)(ii) of the Stormwater Management Rules, this Office is hereby returning the subject application as
incomplete. The $505.00 application fee has been forfeited and a new fee will need to be provided if you choose to
resubmit this application in the future.

I wish I would get a chance to work with you on this, for I have heard great things from friends I know at T&H. However
please read below.
Also, I am replying to this just encase Matt Graham or Carlton Burton, doesn't get back to you quickly. Which I have
internally forward this on.
To answer your initial question, please do not close this permit, however I do not know when it would get back to you.

I will be leaving from Burton next week. The KB Home site has been a mess from the get -go, I attempted to take it on,
however the Ponds/Sand Filters are one of the things I inherited in the design and know a little about. I was the one that
went completely through everything for the submittal and calc. Only to realize they designed the sand filters without the
SWHT which is required. I personally would have not done and got this done early but I understand with what's going
on. (See below) Nevertheless my goal is when I leave here is to only have that SW permit for the project outstanding to
have Burton handle it how they want to. I have attached the SWHT that was done by S&ME.
KB Home — Midland Crossing, formerly "Cedar Creek" history: The project switched hands of ownership, when that
happened, a certain amount is owed/outstanding to Burton. Burton is actively handling it and I do not know much about
and intentionally staying out of it. I think this is the last card Burton can hold onto before KB Home can take off. I will say
it is not KB home fought at all and have been wonderful to work with. The issues are with the previous owner, and I
came to Burton after the fact.

and project timeline.
