This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. The following items included in the DRAFT permit have been retained in this FINAL permit: • Deletion of instream monitoring for temperature, based on consistency with General Permit conditions. • Change the permit expiration date to June 30, 2004. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division of Water Quality. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. Page 2 NPDES No. NC0049905 Summary • This is a minor renewal for an industrial facility that receives liquid asphalt in bulk, then stores it in storage tanks (> 1 MG) before shipping to asphalt plants via tank truck. There is no onsite manufacturing of asphalt. The only potential wastestreams would be stormwater collected from the bulk storage containment areas, and a small amount of boiler blowdown. Both of these wastestreams are piped to a 100,000-gal spill containment basin, which discharges as needed via manual gate valve. DMRs for the last 18 months (1/98-6/99) indicate no reported discharge, while the 1999 CEI reported no discharge over the past 4 years. • When the facility discharges, the treated wastewater would go to an unnamed trib to Grants Creek> Yadkin River>High Rock Lake. The receiving ditch is a zero -flow stream (both 7Q10 and 30Q2 = 0). The Region believes any discharge would infiltrate into the ground before reaching Grants Creek. The entire Grants Creek is classified as partially supporting (PS) in the 305(b) report, and listed in the 1998 303(d) list as impaired for fecal, turbidity, and sediment. • I talked with Bill Mills (Stormwater/General Permits) to see if this individual permit could be converted over. However, the General Stormwater Permit (NCG16-) for asphalt facilities covers just batch plant manufacturing facilities, and the Stormwater General Permit for petroleum storage (NCG08-) is restricted to bulk storage < 1 MG. Therefore, permitting will need to remain within the individual permit domain. • Based on the history of limited discharge, NPDES is recommending permit renewal with limited permit changes. Although the discharge is located above High Rock Lake, nutrient monitoring was not added, since it is not domestic waste and discharges appear to be limited. Region Data. • MRO (Wes Bell) conducted a Compliance Evaluation Inspection (CEI) on February 25, 1999 and reported no major concerns and good O&M. The report stated that there has been no discharge over the past 4 years, and recommended removal of instream monitoring. Staff report dated 3/15/99 (Samar Bou-Ghazale) recommended permit renewal. It looks like there was some initial discussion between Bradley and Dave about this, but I'm not sure anything was resolved. The permittee would like to switch to general permit coverage if possible. Basically, this facility stores liquid asphalt in storage tanks, which they then ship out in tank trucks. The only potential discharges appear to be stormwater from bulk storage containment areas (SIC 2951- NCG160000?), and boiler blowdown (NCG500000?). There is a spill containment basin (100,000 gpd cap). An examination of the basin planning schedule has revealed that the timing of permit renewals does not allow an evenly distributed workload as first envisioned. This results in problems with the efficiency and effectiveness of the NPDES program. In an effort improve customer service, and after thorough review of the water quality issues in your area, the Division is changing the permit renewal schedule for all NPDES permits in your sub -basin. This permit modification changes the expiration date of the subject permit to June 30, 1999. Please find enclosed the revised permit cover page.
