In accordance with the application for discharge permit received on December 29, 1998,
the Division is forwarding herewith the subject NPDES permit. This permit is issued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated
December 6, 1983.
The following items included in the DRAFT permit have been retained in this FINAL
permit:
• Deletion of instream monitoring for temperature, based on consistency with General
Permit conditions.
• Change the permit expiration date to June 30, 2004.
If any parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina
27611-7447. Unless such a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable except after notice to the Division of
Water Quality. Part II, E.4. addresses the requirements to be followed in case of change in
ownership or control of this discharge. The Division of Water Quality may require modification
or revocation and reissuance of the permit.

previously approved by the Division). Such notification shall include completion of Biocide Worksheet 101 (if applicable), a copy of the MSDS for the
additive, and a map indicating the discharge point and receiving stream. There shall be no chromium, zinc, or copper added to the discharge except as
pre -approved additives to biocidal compounds.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

Part III of this Permit).

E. The Permittee shall obtain authorization from the Division of Environmental Management prior
to utilizing any biocide in the cooling water. The Permittee shall notify the Director in writing not
later than ninety (90) days prior to instituting use of any additional biocide used in the treatment
system which may be toxic to aquatic life other than those previously reported to the Division of
Environmental Management. Such'notification shall include completion of Biocide Worksheet
Form 101 and a map indicating the discharge point and receiving stream. Concentrations of
chromium, copper, or zinc added to biocides shall not exceed applicable water quality standards or
action levels in the receyving stream, as determined by calculations from the Biocide Worksheet
Form 101 with Supplemental Metals Analysis Worksheet.

Summary
• This is a minor renewal for an industrial facility that receives liquid asphalt in bulk, then stores it in
storage tanks (> 1 MG) before shipping to asphalt plants via tank truck. There is no onsite
manufacturing of asphalt. The only potential wastestreams would be stormwater collected from the
bulk storage containment areas, and a small amount of boiler blowdown. Both of these wastestreams
are piped to a 100,000-gal spill containment basin, which discharges as needed via manual gate
valve. DMRs for the last 18 months (1/98-6/99) indicate no reported discharge, while the 1999 CEI
reported no discharge over the past 4 years.
• When the facility discharges, the treated wastewater would go to an unnamed trib to Grants Creek>
Yadkin River>High Rock Lake. The receiving ditch is a zero -flow stream (both 7Q10 and 30Q2 =
0). The Region believes any discharge would infiltrate into the ground before reaching Grants Creek.
The entire Grants Creek is classified as partially supporting (PS) in the 305(b) report, and listed in
the 1998 303(d) list as impaired for fecal, turbidity, and sediment.
• I talked with Bill Mills (Stormwater/General Permits) to see if this individual permit could be
converted over. However, the General Stormwater Permit (NCG16-) for asphalt facilities covers just
batch plant manufacturing facilities, and the Stormwater General Permit for petroleum storage
(NCG08-) is restricted to bulk storage < 1 MG. Therefore, permitting will need to remain within the
individual permit domain.
• Based on the history of limited discharge, NPDES is recommending permit renewal with limited
permit changes. Although the discharge is located above High Rock Lake, nutrient monitoring was
not added, since it is not domestic waste and discharges appear to be limited.
Region Data.
• MRO (Wes Bell) conducted a Compliance Evaluation Inspection (CEI) on February 25, 1999 and
reported no major concerns and good O&M. The report stated that there has been no discharge over
the past 4 years, and recommended removal of instream monitoring. Staff report dated 3/15/99
(Samar Bou-Ghazale) recommended permit renewal.

Bill- Could you take a look at this renewal application and let me know if it could be covered
by General Permits. It looks like there was some initial discussion between Bradley and Dave
about this, but I'm not sure anything was resolved. The permittee would like to switch to
general permit coverage if possible.
Basically, this facility stores liquid asphalt in storage tanks, which they then ship out in tank
trucks. The only potential discharges appear to be stormwater from bulk storage containment
areas (SIC 2951- NCG160000?), and boiler blowdown (NCG500000?). There is a spill
containment basin (100,000 gpd cap). NPDES has permitted discharge from the basin, but
there has been no discharge reported for the last 4+ years.

Inman Asphalt currently has an NPDES permit (#NC0049905) for its Salisbury, NC
Terminal. This facility is located at 1825 Jake Alexander Blvd., Salisbury, Rowan
County, North Carolina.
This facility was formerly Chevron Oil, a modification for Name and Ownership
change was issued May 12, 1997. The permit will expire at the end of July.
Inman Asphalt is, therefore, requesting that another permit be issued to begin at
the expiration of this permit. There are no changes in any of the information
contained in the permit.

The Division of Water Quality has received your request for renewal of
Inman Asphalt's NPDES permit for the Salisbury ( NC) Terminal (Permit
NC0049905).
Please note that the Division is currently rescheduling expiration dates
for many permits in the Yadkin -Pee Dee River basin, including
NC0049905. This permit will likely be assigned a new expiration date
(5-31-99 or 6-30-99).
The Division will retain your request and notify the permittee (and RTP
Environmental Associates) of the new expiration date. A renewal notice
and application form will be sent at the appropriate time prior to the
new expiration date.
Please note that this facility should also have an NPDES stormwater
permit. Contact the Mooresville regional Office at (704) 663-1699 or
the Stormwater and Gerneral Permits Unit at (919) 733-5083 to discuss
coverage under the appropriate stormwater permit for this industry.

The Division is beginning the second five-year cycle of river basin planning and permit renewals. An
examination of the basin planning schedule has revealed that the timing of permit renewals does not
allow an evenly distributed workload as first envisioned. This results in problems with the efficiency
and effectiveness of the NPDES program. In an effort improve customer service, and after thorough
review of the water quality issues in your area, the Division is changing the permit renewal schedule for
all NPDES permits in your sub -basin.
This permit modification changes the expiration date of the subject permit to June 30, 1999. Please
find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the
old page. All other terms and conditions contained in the original permit remain unchanged and in full
effect. This permit modification is issued pursuant to the requirements of North Carolina General
Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S.
Environmental Protection Agency.
If you have already submitted a permit renewal application for the subject facility, the Division will
retain the application until your permit is due for renewal. No additional forms or fees will be required.
If any parts, measurement frequencies or sampling requirements contained in this permit modification
are unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be a written petition conforming to
Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings,
Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this
decision shall be fmal and binding.

,ermits in the Yadkin River basin have expiration dates in calendar year 1999. The
acilities listed above have permit expiration dates in 1998. In order for the Division to
:valuate all permit renewal requests in the Yadkin River basin during the same calendar
.ear, the Division plans to extend the expiration dates of the permits for the facilities
fisted above. No conditions in the existing permits will be changed or modified. This is
m administrative change to better align permitting and Basinwide Planning operations
vithin the Division of Water Quality. On the basis of preliminary staff review of Article
!1 Chapter 143, General Statutes of North Carolina (and other lawful standards and
egulations). the North Carolina Environmental Management Commission proposes to
:xtend the duration of the NPDES permits listed above, subject to specific pollutant
