County, NC. Approximate coordinates: 36.311206,-76.994146. See below for prior efforts to obtain this information.
I attached confirmation of the Pre -Filing request (submitted on 2/9/2021) associated with USACE Project ID SAW-2020-
01253. 1 also attached the NWP14 approval from USACE dated 9/13/21.
Permitted impacts included 0.281 acres of wetlands and 0.042 acres of perennial waters. Please refer to the exhibits
attached to the NWP14 approval. Any assistance you can provide is greatly appreciated.

I am reaching out about the 401 Water Quality Permit that we should have received with our approval of our 404 Permit
at Colice Hall Solar from last year for a NWP 14 Crossing. Our company needs this documentation for some financing. I
am reaching out one last time before I put together a letter explaining why we haven't received this document. Attached
is the two emails I sent for this documentation, I am currently pulling a call list together as well. If you could send me this
documentation that would be great.

Location description: The 61.9- acre project area, known as the Colice Hall Solar Site, is located between Colice Hall Lane and
E. Modlin Road north-northwest of Ahoskie, Hertford County, North Carolina. The site is comprised of three parcels

Description of projects area and activity: This verification authorizes the filling on 0.281 acres of wetlands and 0.042 acres of
perennial waters for the purpose of constructing a road crossing to serve as access between solar arrays for a proposed solar
energy facility.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
Conditions, your application signed and dated 9/26/2021, and the enclosed figures C201, C501, and C502 received on 03/31/2021,
08/10/210, and 04/14/2021, respectively. Any violation of the attached conditions or deviation from your submitted plans may
subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit
authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional general
permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided
it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit authorization
expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the
nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon
the nationwide and/or regional general permit, will remain authorized provided the activity is completed within twelve months of the

A LOW —DENSITY STORMWATER MANAGEMENT PERMIT WITHIN THE 20 COASTAL
COUNTIES ("OTHER COASTAL COUNTY WATERS"). REQUIREMENTS FOR THE
LOW —DENSITY PERMITTING OPTION FOR THIS REGION INCLUDE:
a. BUILT UPON AREA (BUA) IS RESTRICTED TO 24% AND REQUIRES
DISPERSED OVERLAND FLOW OF STORMWATER THROUGH VEGETATED
SURFACES. BUA SHOWN ON THIS PLAN IS WELL BELOW THE NOTED
THRESHOLD. ADDITIONAL BUA UP TO THE PERMIT RESTRICTIONS MAY BE
ALLOWED BUT SHALL BE SUBMITTED TO AND APPROVED BY NCDEQ
DEMLR BEFORE IMPLEMENTATION.
b. NEW STORMWATER CONVEYANCE SYSTEMS OUTSIDE OF OVERLAND FLOW
SHALL UTILIZE VEGETATED SWALE WITH SIDE SLOPES OF 3 (HORIZONTAL)
: 1 (VERTICAL) OR SHALLOWER AS SHOWN ON THIS PLAN. THE MINIMAL
USE OF CULVERTS FOR ACCESS IS PERMISSIBLE AS APPROVED BY
NCDEWQ DEMLR AND OTHER AUTHORITIES HAVING JURISDICTION. THE
CONTRACTOR SHALL VERIFY ALL APPROVALS HAVE BEEN OBTAINED.
c. THE CONTRACTOR SHALL REFER TO THE ISSUED STORMWATER

. A 50' VEGETATED SETBACK APPLIES TO JURISDICTIONAL STREAMS AS NOTED

VEGETATED SETBACK SHALL BE MEASURED HORIZONTALLY FROM AND
PERPENDICULAR TO THE TOP OF BANK OF STREAMS, NORMAL POOL OF
IMPOUNDED STRUCTURES AND MEAN HIGH WATERLINE OF TIDAL WATERS.
. THE VEGETATED SETBACK MAY BE CLEARED OR GRADED BUT MUST BE
REPLANTED AND MAINTAINED IN GRASS OR OTHER VEGETATION. ALL EROSION
AND SEDIMENTATION CONTROL PROVISIONS SHALL BE ERECTED PRIOR TO AND
CLEARING OR GRADING.
BUILT UPON AREA IS NOT PERMITTED WITHIN THE VEGETATED SETBACK
UNLESS IT MEETS THE REQUIREMENTS OF G.S. 143-214.7(B2)(2) AND IS
APPROVED BY STATE AND LOCAL PERMITTING AGENCIES. SOLAR PANELS ARE
NOT CURRENTLY CONSIDERED IMPERVIOUS AND HENCE DO NOT QUALIFY AT
BUILT UPON AREA. IMPERVIOUS ITEMS SUCH AS BUILDINGS, COMPACTED
ROADS AND TRANSFORMERS ARE CONSIDERED BUILT UPON AREA AND ARE
NOT PERMITTED WITHIN THE VEGETATED SETBACK UNLESS OTHERWISE
AUTHORIZED AND APPROVED UNDER THE AFOREMENTIONED STATUTE. NO SUCH
APPROVALS ARE INCLUDED WITHIN THIS PLAN.
THIS SOLAR FARM WILL UTILIZE A TRACKING PANEL THAT WILL ROTATE THE
ORIENTATION OF THE PANEL FROM THE EAST TO THE WEST THROUGH THE
DAY TO MAXIMIZE THE CONTACT WITH SUNLIGHT. THE PANEL CONFIGURATION
IS DESIGNED TO ALLOW FOR STORMWATER RUNOFF FROM THE PANELS NOT
TO EXCEED A 10' FALL FROM THE LOWEST ELEVATION (DRIP LINE)
THROUGHOUT THE ROTATION AND PROMOTE DIFFUSE FLOW ONTO THE
VEGETATED SURFACES BELOW. IN MINIMAL CIRCUMSTANCES WHERE THE DRIP
LINE WILL FALL WITHIN A SWALE SLOPE, MATTING SHALL BE USED AND
PARTICULAR CARE SHALL BE TAKEN TO ESTABLISH VEGETATION ON THE
SLOPE. PROPERLY INSTALLED HPTRM'S ARE RECOMMENDED AT THESE
LOCATIONS.

1. PRIOR TO CONSTRUCTION, THE CONTRACTOR SHALL CONTACT NC ONE
CALL TO LOCATE UNDERGROUND UTILITIES.
2. ALL STORM SEWERS SHALL BE PLACED IN ACCORDANCE WITH THE
MANUFACTURER'S RECOMMENDATIONS. CULVERTS SHALL BE SMOOTH
INTERIOR, DOUBLE WALLED HDPE WITH GASKETED CONNECTIONS UNLESS

3. DRAINAGE STRUCTURES SHALL BE CONSTRUCTED PER NCDOT 840.
4. INSTALLATION OF STORMWATER MANAGEMENT MEASURES SHALL BE IN
ACCORDANCE WITH THIS PLAN AND REQUIREMENTS STIPULATED BY THE
DIVISION OF WATER QUALITY STORMWATER PERMIT.

Conditions for Transfer of Compensatory Mitigation Credit:
• Once this document has been signed by the Mitigation Sponsor and the District is in receipt of the signed form, the
Permittee is no longer responsible for providing the mitigation identified in this form, though the Permittee remains
responsible for any other mitigation requirements stated in the permit conditions.
• Construction within jurisdictional areas authorized by the permit identified on page one of this form can begin only after
the District is in receipt of a copy of this document signed by the Sponsor, confirming that the Sponsor has accepted
responsibility for providing the mitigation requirements listed herein. When NCDMS provides mitigation for authorized
impacts conducted by the North Carolina Department of Transportation (NCDOT), construction within jurisdictional areas
may proceed upon permit issuance; however, a copy of this form signed by NCDMS must be provided to the District
within 30 days of permit issuance. NCDOT remains fully responsible for the mitigation until the District has received this
form, confirming that the Sponsor has accepted responsibility for providing the mitigation requirements listed herein.
• Signed copies of this document must be retained by the Permittee, Mitigation Sponsor, and in the USACE administrative
records for both the permit and the Bank/ILF Instrument. It is the Permittee's responsibility to ensure that the District
Project Manager (address below) is provided with a signed copy of this form.
• If changes are proposed to the type, amount, or location of mitigation after this form has been signed and returned to
the District, the Sponsor must obtain case -by -case approval from the District Project Manager and/or North Carolina
Interagency Review Team (NCIRT). If approved, higher mitigation ratios may be applied, as per current District guidance
and a new version of this form must be completed and included in the District administrative records for both the permit
and the Bank/ILF Instrument.
Comments/Additional Conditions: A letter from The Great Dismal Swamp Restoration Bank — Timberlake Mitigation
Bank, confirming they are willing and able to accept the applicant's compensatory mitigation responsibility, dated 8/3/2021
was included with the preconstruction notification.
