HomeMy WebLinkAbout20190752 Ver 6_Chemours - 401 Permit Modification Request_20221012GEES fiEOSerrices, LLC-fieotechnical and Materials Engineers A Universal Engineering Sciences Company October 12, 2022 North Carolina Department of Environmental Quality Division of Water Resources 512 North Salisbury Street Raleigh, North Carolina 27699-1611 ATTENTION: Mr. Paul Wojoski Paul.Wojoski@ncdenr.gov Reference: Dear Mr. Wojoski: Chemours—Fayetteville Works —Barrier Wall Project Mitigation Banking Modification USACE Aid # SAW-2019-00296 The Chemours Company (Chemours) is requesting modification of the 824 linear feet of mitigation credits from the Lower Cape Fear Umbrella Mitigation Bank (LCFUMB) to North Carolina Division of Mitigation Services (DMS). Chemours obtained a letter from LCFUMB on February 7, 2022 reserving the 824 mitigation credits. Leading up to the approved 401/404 permit GeoServices continued to discuss the availability of credits and requested payment instructions from LCFUMB. After approval of the permits Chemours transmitted the permits to LCFUMB and was notified via email the credits are not available at this time and credits would have to be purchased from another mitigation bank. Chemours then requested additional credits from DMS to replace the credits requested from LCFUMB. DMS requested the 401 and 404 permit be modified to reflect DMS being the sole provider of credits. The US Army Corp of Engineers issued the revised permit on October 7, 2022. Chemours is requesting the 401 permit be modified to remove LCFUMB from the permit and DMS be the sole provider of mitigation credits in the amount of 4,597 linear feet.
