Dear Mr. Jennings:
This letter is in reference to your request to modify the Department of the Army permit issued
to NCDOT (Action ID 2006-10391) dated October 21, 1998. The issued permit authorized
placement of till material in 20.11 acres of jurisdictional wetlands and 163 linear feet of stream
associated with the widening of an existing two lane road facility to a multi-lane facility for
approximately 7.7 miles on US IYUS 158 near Tarheel in Hertford and Gates Counties, North
Carolina.
Specifically,NCDOT is requesting that the permit be modified to allow a reinforced soil
slope instead of the pile panel wall system that was included in the permit drawings at Site 5
(From L-Station 76 +5 to 82 +00 Rt). The original design was intended to reduce wetland
impacts. However, further analysis of the site revealed previously unknown safety,
constructability, maintenance and cost issues associated with this design. As a result,NCDOT is
proposing that the permit be modified to allow construction of a reinforced soil slope. '.this
modification will result in additional impacts to 0.15 acres of riparian wetlands adjacent to the
Chowan River. In order to provide compensatory mitigation for these impacts,NCDOT will,
make an in lieu fee payment to NCEEP. This modification has been approved. All terms and
conditions of the original permit, including the 31 December 2017 expiration date remain in
