Dear Sir: The North Carolina Department of Transportation (NCDOT) submitted an application for Individual Section 404 and 401 permits for U-2510A to the respective agencies on February 2, 2007. On February 22, 2007, Carolina heelsplitter, a federally endangered mussel, was discovered in Sixmile Creek approximately 3.5 miles downstream of the Site 3 culvert crossing on NC 16. As a result of this discovery, U.S. Fish and Wildlife (USFWS) requested an Indirect and Cumulative Impacts (ICI) report specifically focused on Sixmile Creek. This report was submitted to USFWS, the Army Corps of Engineers and the North Carolina Division of Water Quality on June 7, 2007. USFWS requested that the proposed ditch on the northwest quadrant of Site 3 be removed and a scourhole be installed to let the water overflow and filter down through the floodplain instead of flowing directly into Sixmile Creek. The North Carolina Division of Water Quality (NCDWQ) approved this design change which will result in no permanent surface water impacts (revised permit drawing and roadway plan sheet attached). USFWS also requested a construction sequence for Site 3 to verify that the method of demolition on the existing 4-barrel culvert would not add more sediment to the stream. The construction sequence for Site 3 is included. The following comments are provided in accordance with the provisions of section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). The North Carolina Department of Transportation proposes to improve NC 16 (Old Providence Road) from South of SR 1316 (Marvin-Weddington Road) in Union County to South of I-485 (Charlotte Outer Loop) in Mecklenburg County, a length of 3.1 miles. The proposed project crosses Sixmile Creek and two intermittent tributaries. The existing culvert on Sixmile Creek will be replaced with a bride. In our November 17, 2005, letter regarding this project, we concurred with a "not likely to adversely affect" determination for impacts to the federally endangered Carolina heelsplitter (Lasmigona decorata) mussel. Subsequently, on March 14, 2006, the Carolina heelsplitter was discovered (six individuals) in Sixmile Creek in Lancaster County, South Carolina, south of the North Carolina state line and approximately 10 miles downstream of the Sixmile Creek crossing of NC 16. Before this discovery, the range of the Carolina heelsplitter in North Carolina included Waxhaw, Goose, and Duck Creeks in Union and Mecklenburg Counties. During a February 2007 survey of Sixmile Creek in North Carolina (for a potential mitigation project), Carolina heelsplitter individuals were found approximately 4 miles downstream of the crossing of NC 16. In 2004 and 2006, surveys of Sixmile Creek in the direct project impact area found no heelsplitters or shells. On March 8, 2007, a site meeting was convened to discuss specific minimization measures for the culvert removal and bridge construction on Sixmile Creek. A number of minimization measures regarding construction were identified and agreed to. In addition, we requested that an updated Indirect and Cumulative Effects (ICE) analysis be conducted. Your letter requesting concurrence outlines the minimization measures agreed to for the direct impacts of construction at the crossing of Sixmile Creek and more stringent measures to control sediment and erosion for the entire 3.1-mile-long project. The results of the updated ICE analysis indicate that the growth of subdivisions and related services has continued since the first analysis and that the area is being served with the existing infrastructure. The improvements that will occur as a result of the subject project will enable faster, safer travel through the area but will induce little further growth. Future construction and reconstruction projects will be required to conform to new National Pollutant Discharge Elimination System (NPDES) Phase II requirements, which, in the Sixmile Creek watershed, mandate 100-foot intermittent buffers and 200-foot perennial buffers and storm-water controls that will help protect Sixmile Creek from further degradation. Given (1) the measures that will be implemented to minimize direct impacts at the crossing of Sixmile Creek, (2) the negative survey results in the project area, and (3) the requirements of NPDES Phase II for future construction projects, we concur with your conclusion that the implementation of this project is "not likely to adversely affect" the Carolina heelsplitter. In view of this, we believe the requirements under section 7(c) of the Act are fulfilled for this species. However, obligations under section 7 of the Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that maybe affected by the identified action. Construct drilled shafts prior to embankment construction. Piers can be constructed on crane mats if necessary. No riprap needed for pads. These mats will be outside the stream. (assuming looking downstream and barrel #1 is on left side....) Divert .water into barrel 3 in order to remove sediment from barrel #4. Once this is complete, divert water into barrel #4 with impervious dikes. Impervious dikes will need to be constructed underneath the newly constructed stage 1 bridge. Sheet piles will not be an option. Cannot drive sheets for dikes prior to stage 1 construction because of trying to minimize diversion period and removal of sheets will be required. Can't remove sheet piles under new bridge. With stream diverted into barrel #4, remove roof slab and walls for barrels 1-3. "Beating" down will be more easily contained than sawing due to difficulty in containing saw slurry. Keep both walls up for barrel #4. Once barrels 1-3 roof slab and walls are removed (leaving floorslab), we will construct the "typical section" through the length of the removed culvert, flood benches, etc. using stockpiled material from barrel cleanout. Once acceptable channel section is constructed, divert water from barrel #4 to new channel side, between new channel bank and newly constructed impervious dike (through culvert length) to contain stream flow outside of barrel#4. Once water is diverted out of barrel #4, remove roof slab and walls for barrel 4 allowing construction of bank section. Remove impervious dike placing stream into new fully constructed channel (same channel dimensions as existing upstream/downstream channel). - Finish stage 2 bridge over stream. Impervious dike will most likely be barrier rail, sand bags, or other nonerodables. Newly constructed banks could be armored with riprap at and above water elevation. With bridge this wide, vegetative cover on streambanks will not be feasible.
