On behalf of Pulte Homes, we are requesting authorization for riparian buffer impacts totaling 91 sq
ft of permanent impacts for construction of a Non - electric Utility (sewer) at the proposed Townes at
Davis Square project.
The project is located at 920 Waldo Rood Blvd, in Cary, Wake County (35.7$41 °N; -78.8487 °W). The
nearest waterbody is an intermittent Unnamed Tributary to Turkey Creek, located in the Neuse River
basin. The Water Quality Classification for Turkey Creek is Class C; NSW and the Stream Index
Number is 27-33-2• The hydrologic cataloging unit for the site is 03020201.
Proposed Project
The proposed project consists of the construction of a residential townhouse development and
associated utilities. The only proposed impacts will be to riparian buffers for the connection of a
sanitary sewer line to an existing interceptor line on the west boundary of the tract.
Project History
A stream buffer determination was conducted by James Graham of NC DWR in August 2014. A
stream buffer determination letter was issued August 28, 2014 (NBRRO #14-299)• An addendum to
the buffer determination letter was issued October 17, 2014. Copies of the determination letters are
included with this packet.
Proposed Impacts
The proposed impact consists of 91 sq ft of permanent impacts to riparian buffers (Zone 1: o sq ft;
Zone 2: 91 sq ft) for the construction of a sanitary sewer line accessing an existing sanitary sewer

interceptor line on the western boundary of the property. There are no proposed stream or wetland
impacts associated with the project.
Avoidance and Minimization
The overall project was designed to avoid stream and buffer impacts to, the maximum practical
extent. The proposed sewer connection was designed to access an existing manhole at a location
allowing for minimum impact to,the stream buffer. Due to the location of the stream and the existing
, interceptorr line, non - impact areas are not available. The permanent impact is limited to the
necessary footprint for function and maintenance.
Mitigation
Because the proposed buffer impact for the Non - electric Utility (sewer) is located entirely Within
Zone 2 of the riparian buffer, this activity is considered "Allowable" and does not require mitigation.
The current request is for 91 sq ft of permanent, impacts to riparian buffers (see the attached maps
and PCN for details).

This,on -site determination shall,expire five (5) years from the-date of this letter. Landowners or affected parties that
dispute a determination made by the DWR or Delegated Local Authority may request a determination by the
Director. An appeal request must be made within sixty (60) days of date of this letter or from the date the °affected
party (including downstream, and /or adjacent owners)-is notified of this letter. A request for a determination by the

This determination is final and binding unless, as detailed above, yowask fora hearing or appeal within, sixty (60)
