I intend to submit an SOA for stream and buffer impacts from RES tomorrow. * It is my understanding that the project engineers are still addressing the request for additional information submitted by the US Army Corps of Engineers via email on November 29th, 2021. Is this correct? If so, please provide a copy of the final response to the Division. [15A NCAC 02H .0502(c)] - Yes, they had to resubmit to City of Raleigh and get back to me when they have the revised maps. Revised impact maps are attached. * Please provide additional information on how the two drainage conveyances listed as “Impact Area 2- Drainage - Deemed Allowable” fit under Item 9 of the buffer rules. [15A NCAC 02B .0714(9)] - A perpendicular discharge pipe through the buffer is “deemed allowable” so long as it discharges into the stream. * The proposed road crossing in Impact Area 1 does not appear to be a perpendicular crossing of a stream or other surface water. Road impacts other than perpendicular crossings of streams and other surface waters require mitigation. Please provide additional information to demonstrate that this crossing is a perpendicular crossing or provide a statement of availability from a mitigation bank. [15A NCAC 02H .0714(11)] - This is listed as an intermittent stream which would not require mitigation from the state. The larger stream is perennial. The smaller stream in intermittent. * Has a stream/buffer determination been performed for this site by DWR? If so, please provide a copy of the Buffer Determination Letter. [15A NCAC 02H .0502(c)] - A buffer meeting was not conducted because both streams depicted on the soil survey/USGS are present in the field and enter the Site from an offsite culvert.
