We have also performed the targeted surveys for the sunflower and did not observe any individuals. The USFWS has concurred with that conclusion, which is also attached. I have finished my review of the Oaks Commerce Site NWP 39 Application and need more information. Please provide to me. I also wanted to mention a few things 1. Please provide the mitigation bank/ In-lieu fee acceptance letter (what does the applicant propose? I will charge 2:1 mitigation on both the wetlands/stream impacts unless there are NCSAM/NCWAM forms, and the argument is made for a lower threshold) 2. Were surveys done for the Schweintiz’s Sunflower?(suitable habitat is present) please provide so I can consult with USFWS (Asheville) if outside consultation has occurred, please provide responses. 3. Informal consultation has been initiated with NCSHPO due to the Historic Nature of the Railway. (Piedmont and Northern Railway Linear Historic District) as well as two listed historic structures, GS2350 and GS2356 4. This permit trips the Individual Water Quality Certification by the State ( 30 Public Notice, etc) once the IWQC is issued, I need to coordinate with the EPA for concurrence. (only after the IWQC is issued) After all of this information is received and sorted, I can verify the NWP 39 for this project. Regards Krysta Krystynka B.
