To provide the two required access roads, two new stream crossings are proposed. The combination of property configuration, property setbacks, and NCDOT requirements for suitable access road locations along Watson Road result in the need for a wetland impact along the southern access road. Impact area W1 extends beyond proposed contours (on Figure 3.2) to allow for appropriate erosion and sediment control measures (Figure 3.6).Two existing culverts along gravel roads are proposed for removal since they are not compatible with the layout of the proposed development. A combination Nationwide Permit 13 / 29 and associated Individual Water Quality Certifications are requested to authorize these impacts. The on -site water and sewer line extensions will run along the proposed access roads and will not result in additional impacts to streams or wetlands. Installation of the stream culvert will be conducted "in the dry" by use of a pump around system (Figure 3.5). Stream bank stabilization details for the existing culverts proposed are provided on Figure 3.7. Typical construction equipment will be used on site including bulldozers, excavators, dump trucks, etc. Section D.la Avoidance and Minimization - Design The project design avoids impacts to 2,820 linear feet of stream (96% of stream length and 95% stream bed acreage on site) and 0.209 acres of wetland (90% of wetlands on site). The proposed alignment for the municipal water and sewer line extension avoids impacts to streams and wetlands. The two existing stream culverts are being removed and the stream banks will be restored to offset the impacts of the two new stream culverts. Two access roads are required, due to the local fire code. The culvert at impact site S4 could not be reused for this project due to NCDOT line of sight issues for the access road. NCDOT required the road to be placed in the middle of the curve of Watson Road. The culvert at impact site S4 could not be reused as the alignment for the second access road to connect to Crescent Hill Drive while allowing enough space for an efficient use of developable space. The initial site plan proposed a wetland impact of 0.09 acres at impact site W1 but was reduced to 0.023 acres by using a retaining wall to limit grading into the wetland. Additionally, the western side of Kimsey Creek (currently forested) was initially proposed for development and would have required another stream crossing. This alternative was dismissed. Section F.5d Endangered Species and Designated Critical Habitat — Sources ClearWater consulted the FWS's interactive map of HUC 12 watersheds known to contain Northern Long -Eared Bat (NLEB) hibernacula or maternity roosts. The project site is DocuSign Envelope ID: 3A998D26-B154-41 E5-8AA8-7EABCOBC26E3 approximately eight miles from a documented HUC 12; therefore, the project satisfies the 4(d) rule and consultation for effects on the northern long-eared bat is not required. An Official Species List was obtained for the project through the USFWS Information for Planning and Consultation (IPAC) process on September 19, 2022 (Appendix B). A review of the NC Natural Heritage Program database on September 19, 2022, indicated one element occurrence (EO) for federally protected species occurring within a one -mile radius of the project boundary (Appendix B). The listed EO, is a low -accuracy occurrence of NLEB with a description of "Arden" in Buncombe County. EO details specify that the exact location is not known. The project site is primarily a maintained meadow with scattered rows and single trees. Minor tree clearing will be conducted east of Kimsey Creek. The wetlands on site are not suitable habitat for mountain sweet pitcher plant or bog turtle. The streams are too small and degraded to support Appalachian elktoe. It is the opinion of ClearWater that the development of the project site is not likely to adversely affected federally listed species known to occur within the project's vicinity. Section F.7b. Historic or Prehistoric Cultural Resources — Sources Two historic sites are near the project site. Lutheridge; Site ID: BN6304 (Status DOE) abuts the project site to the west and north. The Oak Park Historic District; Site ID: BN2467 (Status DOE) is approximately 0.25 miles to the east of the project site, on the opposite side of NC Hwy 25 (Hendersonville Road). Data gathered from NCHPO's HPOWEB 2.0 for General Audience. Accessed September 19, 2022. Both potentially historic sites near the proposed project site are within highly developed corridors along US Highway 25. The potentially historic sites are surrounded by dense commercial and residential development. Development of this project site for townhomes is consistent with the surrounding land use.
