PROJECT SUMMARY: The applicant proposes to excavate an access channel and boat basin for the construction of a 42 -slip community marina at the Devaun Park Subdivision. PROJECT DESCRIPTION The applicant's project is located at 9286 River Terrace, within the existing Devaun Park Subdivision, adjacent to Calabash River, in Calabash, Brunswick County. The project site can be accessed from NC Highway 179. Traveling from Calabash to Sunset Beach on Highway 179, turn right onto Shady Forest Drive Just past the Calabash River Bridge. Shady Forest Drive leads into Devaun Park. Once in the Subdivision, turn right onto Hutton Heights Way and follow to Calabash River The project site is at the intersection of Hutton Heights Way and River Terrace. The Devaun Park Subdivision occupies approximately 150 acres of land with elevations ranging from 20 to 30 feet above mean sea level. Subdivision roads, sidewalks, clubhouse, community docking facility and some residences have been constructed and the majority of lots remain undeveloped. The waterfront parcels adjacent to the existing community docking facility are owned by Horry County State Bank, described as Riverside Park and are the subject of this report CAMA Major Permit #09 -04 was issued to Stanaland Stewart Co. LLC on January 7, 2004 and authorized the construction of a 10 -slip community docking facility at the existing subdivision on Calabash River. The community docking facility was sited on a secondary channel or natural oxbow feature that was once the main channel of the River and is referred to as Calabash Creek CAMA Major permit #09 -04 expired on December 31, 2007. On behalf of the Stanaland Stewart Co., LLC, Land Management Group submitted an Environment Assessment (EA) for the expansion of the existing 10 -slip facility to a 42 -slip marina with the excavation of approximately 30,243 cubic yards of shallow bottom habitat for the boat basin and access channel The EA was submitted to the State Clearinghouse for review by DENR. After environmental review, it was found that the 42 -slip marina with boat basin and access channel excavation would not result in significant impacts to the environment. The project received a "finding of no significant impact" ( FONSI) from the Division of Coastal Management on October 12, 2010 and completed the SEPA review process in January 2011 This FONSI was for the excavation of approximately 149,559 square feet (3.43 acres) of open water dredging to a final depth of -7 feet for the siting of a 42 slip marina with slips ranging from 30 to 60 feet in length The project site (Riverside Park) is made up of three parcels, approximately 6.25 acres in area with approximately 1,897 linear feet of shoreline along south side of Calabash Creek. This portion of Calabash Creek is a secondary channel or oxbow The main channel of the Calabash River is located along the north bank of the creek or oxbow Existing development on the parcel includes a 1,600 sq. ft. sales office /pavilion, sidewalks, wooden decks and a 10 -slip community docking facility The majority of Riverside Park is relatively high in elevation for this part of Brunswick County, averaging approximately 16 feet above mean sea level. Along the shoreline the property elevation drops rapidly from the top of the bank to the normal high water contour over a distance of approximately 30 feet. Coastal wetland vegetation begins near the toe of the bank and consists almost entirely of Smooth Cord grass Marsh (Spartino alterniflora). The marsh extends water ward approximately 100 feet from the bank. The existing community docking facility is comprised of a fixed access pier, gazebo and floating docking system. The floating docking system consists of a main spine with four finger piers that provide dockage for ten (10) vessels. No other docking facilities are present along this shoreline. Horry County State Bank — Riverside Park Marina Page Three The waters of the Calabash Creek (aka Calabash River) are classified as SA by the North Carolina Division of Water Resources. The waters are closed to the harvest of shellfish and are not designated a Primary Nursery Area by the Division of Marine Fisheries PROPOSED PROJECT The applicant is proposing to excavate an access channel and boat basin for the construction of a 42 -slip community marina at the Devaun Park Subdivision. The proposed access channel would connect to the federally maintained navigation channel of the Calabash River and extend to the south east. The proposed access channel would range in width from approximately 60 feet to 160 feet at the connection with the federal navigation channel The access channel would measure approximately 400 feet in length from the point of connection with the federally maintained channel to the proposed boat basin The proposed access channel would be aligned along the -4 foot (@ MLW) water depth contour of the natural oxbow feature of Calabash Creek. Water depths in the location of the proposed access channel range from -2 feet to -5 feet at Mean Low Water (MLW). The proposed access channel would connect to a proposed boat basin that would be irregular in shape. The proposed boat basin would range in width from approximately 110 feet to 230 feet and would measure approximately 580 feet in length. Existing water depths in the location of the proposed boat basin range from approximately -0.8 feet to -5 feet at MLW. As proposed the access channel and boat basin would be hydraulically excavated to a final depth of -6 feet at MLW The proposed boast basin footprint would provide a 10 foot buffer from the edge of coastal wetlands. The proposed access channel and boat basin would be aligned along the natural oxbow feature of Calabash Creek that served as the main navigation channel prior to the ACOE establishment of the federal navigation channel to the northwest. The proposed access channel and boat basin would provide access exclusively for the Riverside Park Marina (see sheet 4 of 9). Spoil material associated with the excavation of the access channel and boat basin would be deposited into a settling dike located approximately 600 feet from NHW within the subdivision. The applicant has provided a deed of ownership for this area measuring approximately 200 feet in width by 375 feet in length (see sheet 7 of 9). The applicant has stated that this area will be available for future maintenance events. Riverside Park Marina would be sited within the footprint of the proposed boat basin. The proposed 42 -slip marina would utilize the existing pier and gazebo for access to a floating docking system. The floating docking system would extend to the northeast and southwest and would be connected to the existing access pier and gazebo via access ramp. The northeast portion of the proposed marina would consist of an approximately 12 feet wide by 43 feet long floating spine which transitions to an approximately 6 feet wide by 118 feet long main spine floating dock oriented parallel to the shoreline. As proposed, three (3) finger piers, each measuring 4.25 feet in width by 34 feet in length, and two (2) finger piers, each measuring 3.25 feet in width by 30 feet in length, would extend water ward of the main spine floating dock. The proposed finger piers would be oriented perpendicular to the shoreline. The applicant is proposing ten (10) tie pilings located between the proposed finger piers to provide tie off for vessels within the slips labeled #42 -34 (see sheet 5 of 9). The southwest portion of the proposed marina would consist of an approximately 12 feet wide by 43 feet long floating spine which transitions to an approximately 6 feet wide by 33 feet long floating section connecting to an approximately 6 feet wide by 92 feet long main spine floating dock The proposed main spine floating docks would be oriented parallel to the shoreline. As proposed, five (5) finger piers each measuring approximately 3 25 feet in width by 30 feet in length would extend water ward of the main spine Horry County State Bank — Riverside Park Marina Page Four floating dock. The proposed finger piers would be oriented perpendicular to the shoreline and the applicant is proposing nine (9) tie pilings located between the proposed finger piers to provide tie off for vessels within the slips labeled #33 -25 (see sheet 5 of 9). The south west floating docking system would connect to a proposed floating platform for golf cart parking measuring approximately 18.5 feet in width by 56 feet in length. The proposed golf cart parking area would connect to a main spine floating dock extending to the west, measuring approximately 186 feet in length by 6 feet in width. The proposed main spine floating dock would be oriented at an angle to the shoreline. As proposed, six (6) finger piers, each measuring approximately 3.25 feet in width by 30 feet in length would extend north of the main spine floating dock. The proposed finger piers would be oriented generally parallel to the shoreline. The applicant is proposing eleven (11) tie pilings located between the proposed finger piers to provide tie off for vessels within slips #24 -14. As proposed, seven (7) finger piers, measuring approximately 4.25 feet in width by 24 feet in length would extend south of the main spine floating dock The applicant is proposing twelve (12) tie pilings located between the proposed finger piers to provide tie off for vessels within the slips labeled #1 -13 (see sheet 5 of 9). As proposed, the marina would extend beyond the quarter width of the water body and appears to exceed the third width limitation long some portion of its proposed alignment. The proposed marina has been designed to follow the natural contours of the oxbow and to be located outside of the natural channel portion of the water body The proposed marina would provide dockage for 42 vessels, however there is the potential for dockage by small vessels on the landward side of the southwest floating docking system The applicant is also proposing construction of a wooden drip- through golf cart path and cart parking spaces on the high ground within the Riverside Park parcels. The proposed cart paths and parking areas would be located landward of the 30 foot Coastal Shoreline Buffer (see sheet 6 of 9) 10. ANTICIPATED IMPACTS: The applicant has designed the project to reduce the impacts associated with the previously proposed development that received a "FONSI" from the State clearinghouse in 2011 The applicant has reduced the dredged depth from -7 feet to -6 feet at MLW, the dredged footprint has been reduced by 28,790 square feet resulting in a reduction of 10,115 cubic yards of dredged material. The applicant has also reduced the dock footprint by 19,557 square feet. The currently proposed access channel and boat basin excavation would impact approximately 120,769 square feet ( +/ -2.77) acres of shallow bottom and deposition of dredge spoil material would impact 75,000 square feet of previously disturbed high ground. No coastal wetlands are proposed to be impacted as part of this project. The applicant has designed the project to provide a 10 foot buffer from coastal wetlands for excavation. The community marina would incorporate approximately 28,000 square feet of Estuarine and Public Trust area. The community marina would result in the shading if approximately 7,140 square feet of Estuarine and Public Trust Waters The community marina would be located entirely within the applicant's riparian area and would conform to the 15 foot adjacent riparian property setback. As proposed, the marina would extend beyond the quarter width of the water body and appears to exceed the third width limitation long some portion of its proposed alignment. The proposed marina has been designed to follow the natural contours of the oxbow and to be located outside of the natural channel portion of the water body. Horry County State Bank — Riverside Park Marina Page Five The golf cart path and parking would not result in any additional impervious surfaces within the Estuarine Shoreline AEC. Minor disturbances to high ground are expected as a result of the construction of the wooden walkway and open decks during piling installation. Wilmington Project Narrative CAMA Major Permit Application September 16, 2014 Riverside Park Marina Town of Calabash, Brunswick County, North Carolina Horry County State Bank, Applicant Proposed Project Horry County State Bank proposes to construct an open water community marina that will offer 42 permanent boat slips to residents of the Devaun Park Community. The proposed marina will be a floating structure Slips will range in length from 25 ft to 34 ft Pilings will anchor the dock system and serve to separate individual slips Residents will access the community marina via the existing timber access pier which features a 12 ft x 12 ft covered gazebo at the waterward end In order to construct the proposed marina, approximately 20,128 cu yd of sediment will be excavated below mean low water (MLW) to attain a final marina depth of -6 ft MLW. Excavated materials will be dredged hydraulically and pumped into the settling dike, located 600 ft inland within the Devaun Park neighborhood on a designated upland area A permanent marine pumpout station will be located along the waterward edge of the western dock system and will tie -in with the County sanitary services. No additional marine services will be offered. A wooden drip- through golf cart path and cart parking spaces will be located within Riverside Park to provide residents with convenient access to the marina No new impervious surfaces are proposed as part of this application. Impervious surfaces within the development are covered by stormwater permitting (SW8 010828 Mod) The previous land owner, Stanaland Stewart Company, LLC instated development of a 42- slip marina in this location in 2009 At that time, the NC State Environmental Policy Act (SEPA) required an Environmental Assessment be prepared for proposed open water marinas to evaluate potential environmental impacts under the SEPA procedure That process was completed and a planned 42 -slip marina received a "Finding of No Significant Impact" ( FONSI) from DCM on October 12, 2010 (copy enclosed) and completed the SEPA review process in January 2011 The currently requested marina maintains a total of 42 slips, but all slips have been reduced in size Smaller slips have resulted in a reduced dredging footprint and volume and a reduced use of public trust waters /bottom The enclosed table shows reduced impacts to the area of proposed dredging, the final project depth, and the marina footprint beyond the 2010 design which received a FONSI R E ',EIVi"=D DCM WILMINGTON, NO Riverside Park Manna, Devaun Park CAMA Major Permit application, Project Narrative September, 2014 5 E P 17 20114 1 Reduction of Impacts beyond 2011 marina layout with FONSI. Existing Conditions There is an existing 10 slip floating dock facility, 12 ft by 12 ft covered gazebo and wooden access pier in the footprint of the proposed project All existing water - dependent structures were authorized in 2004 by the previous land owner (CAMA Major Permit No 09 -04) The proposed project is located in the Lumber River Basin (Subbasin 03- 04 -59, Hydrologic Unit Code 03040207) The waters of the Calabash River In this vicinity are classified as Class SA, HQW and are closed to shellfishing Waters in the footprint of the proposed structure are not designated as PNA. The lunar tidal range in this vicinity is approximately 4 2 ft There Is a maintained federal navigation channel in the Calabash River adjacent to the proposed project The outermost structures of the proposed marina are over 400 ft from the federal channel. A review of historical aerial photography in the project vicinity indicates that the Calabash River was realigned sometime between 1949 and 1966 (see enclosed aerials) This dredged and federally maintained project is the designated navigation channel for commercial and recreational vessels passing the Calabash waterfront The dredged channel effectively bypasses the meander in the Calabash River, which is the site of the proposed marina As water flow was diverted from the natural river meander to the re- aligned navigation channel of the Calabash River, sedimentation rates increased in the oxbow, resulting In the very shallow water depths that are now present In the Immediate footprint of the proposed project The boundaries of jurisdictional 404 wetlands have been delineated on the entire Devaun Park property Boundaries were delineated with the original subdivision development, and all 404 wetlands and coastal wetlands within Riverside Park and the dredge deposit site were re- flagged and surveyed in 2010 The updated wetland survey for the proposed project Is included with this..,, Major Modification request There are no proposed impacts to 404 or coastal wetlands I " E I V E� D0fV1 VYILMINGTON, NC Riverside Park Manna, Devaun Park j E P 1 1 2014 CAMA Major Permit application, Project Narrative September, 2014 2 The majority of Devaun Park is within the Town of Calabash Extra - Territorial Jurisdiction (ETJ) and is zoned as a Planned Unit Development (PUD), receiving approval in September of 1999 The Town of Calabash accepted a voluntary annexation in 2008 from the previous land owner, Stanaland Stewart Company, LLC for the entire waterfront properties of Devaun Park including the Riverside Park Marina, The Pointe, homesites in Devaun Park Circle and homesites 39R and 40R in River Terrace The applicant received approval for the construction of a maximum of 44 boat slips in September 2007 (confirmation letter enclosed) The approval was extended in 2008 A stormwater permit was secured for the project (SW8010828 Mod) by the previous owner, Stanaland Stewart Company A request for transfer of the stormwater permit to the current owner has been submitted concurrent with this CAMA Major Permit application Minimization and Avoidance A list of mitigative measures adopted for the project as a result of these consultations are as follows • Riverside Marina Association (RMA) will establish a list of covenants requiring a closed head policy specifically prohibiting any overboard discharge or any in -water boat maintenance such as vessel painting or scraping All RMA members will be required to agree to the terms of these policies at the time they agree to utilize the marina • The marina will feature a permanent waste pumpout system on the waterward limits of the western dock to service vessel holding tanks The system will tie into the County sanitary services • There will be an emergency spill response kit available on the dock and ample signage as to its location Emergency contact numbers, including the US Coast Guard, will also be posted • A floating dock system is proposed ensuring the free movement of water through the marina area Due to the presence of the Corps - maintained navigation channel on the Calabash side of the river and the fact that no boat docks will ever extend from the marsh on the opposite side of the bypassed meander, there will be no negative impacts to navigation and public trust usage • The Calabash River in the vicinity of the proposed project has been restricted for shellfishing since 1968 and has been historically utilized for commercial and, recreational purposes No additional shellfish closures will result from the proposed project The Town of Calabash presently features commercial dockage directly across the river from Devaun Park Given the historic uses of this area of the Calabash River, the proposed project is in harmony with the existing water access and boating facilities along this section of the Calabash River corridor • There will be no new discharges to adjacent waters resulting from the project A State Stormwater Management Permit was secured for Devaun Park (SW8010828 Mod) by Stanaland Stewart Company LLC No new impervious areas are proposed in association with this project.
