The Division of Water Resources (Division) has performed a preliminary review of a 401 Water Quality
Certification application submitted for the above referenced project. The Division has determined that your
application is incomplete and cannot be processed. The application is on -hold until all of the following
information is received: -
The existing culvert installation does not conform to condition 13. Placement of Culverts and
Other Structures in Waters and Wetlands within Water Quality Certification 3890.
The culvert is not buried to 20% of its diameter and is perched above the streambed. The length
of the pipe also appears excessive (i.e., extends several feet beyond the headwall).
Please provide information regarding the steps to be taken to return the culvert installation to
compliance with the Certification and a reduction of the pipe length to the minimal required to
enable the road crossing at the stream.
If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the
Division will be unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package and the
appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies of all of the
above requested information to the 401 & Buffer Permitting Unit:
