Brian,
NCDOT plans on letting the subject project to contract this month. The 401 (DWQ Project No.
070957) issued on June 29, 2007 has an October-April trout moritorium, which was in the original
NCWRC comments. I spoke with Dave McHenry concerning this project and he agrees that
Improvement Creek does not support brown or brook trout, so he modified the moritorium dates from
October to January. Do you need to modify the 401 formally or will an email suffice concerning
condition Number 6, the October 15 to April 15 moritorium dates? Just let me know how to proceed.

In the June 21 letter I sent on this project, I recommended the long trout moratorium. However, after more
consideration, the WRC would not object to adherence to the shorter January 1 to April 15 moratorium
instead because Improvement Creek probably only contains rainbows.
