1. Review of Application Item IX.1. and the Pender County GIS database shows that the parcel in which
the storage structure and spray fields are located on is not owned by Pender Packing Company,
Inc. Parcel No. 3204-40-8465-0000 is listed as being owned by Mr. Timothy Guy Baker, and it is
unclear whether a lease agreement or easement has been registered for this property. Pursuant to 15A
NCAC 02T .0504(f)(3) an agreement to lease the property that is written, notarized, and signed by both
parties, indicating the intended use of the property, accompanied by a plat or survey map shall be
provided. Lease agreements shall adhere to the requirements of 15A NCAC 02L .0107 (see below).
2. Pursuant to 15A NCAC 02L .0107(k), if the Permittee is not the owner of the land within the
compliance zone, the landowner shall execute and file in the Register of Deeds in the county in which
the land is located, an easement running with the land that contains either a notice of the permit,
including the permit number, a description of the type of permit, and the name, address and telephone
number of the permitting agency; or a reference to a notice of the permit with book and page number
of its recordation if such notice is required to be filed by statute. The Director shall, upon request by
the landowner, file a document terminating the easement with the appropriate Register of Deeds once
the following conditions have been met:
a. all required groundwater remediation has been completed;
b. groundwater monitoring is no longer required pursuant to 15A NCAC 02L .0110(f); and
c. monitoring wells have been abandoned pursuant to 15A NCAC 02C .0113.
