ICT #1 – All Work Except PVE
· Except for that work required under the Project Special Provisions entitled Planting,
Reforestation and/or Permanent Vegetation Establishment, included elsewhere in this proposal,
the Contractor will be required to complete all work included in this contract and shall place and
maintain traffic on same.
· The date of availability for this intermediate contract time is September 19, 2022.
· The completion date for this intermediate contract time is April 15, 2023.
· The liquidated damages for this intermediate contract time are Eight Hundred Fifty Dollars ($
850.00) per calendar day.
ICT #2 – Traffic Restrictions
· The Contractor shall not close or narrow a lane of traffic on NC 24 during the following
time restrictions: MONDAY THROUGH SUNDAY 6:00AM - 9:00AM & 3:00PM - 6:00PM
· In addition, the Contractor shall not close or narrow a lane of traffic on NC 24, detain and/or alter
the traffic flow on or during holidays, holiday weekends, special events, or any other time when
traffic is unusually heavy, including the following schedules:
1. For unexpected occurrence that creates unusually high traffic volumes, as directed by the
Engineer.
2 thru 8 .– See SP page 2 & 3. Restriction included for - Holidays and holiday weekends shall
include New Year's, Easter, Memorial Day, Independence Day, Labor Day, Thanksgiving, and
Christmas. The Contractor shall schedule his work so that lane closures will not be required
during these periods, unless otherwise directed by the Engineer.
· The time of availability for this intermediate contract work shall be the time the Contractor begins
to install all traffic control devices for lane closures according to the time restrictions listed
herein.
· The completion time for this intermediate contract work shall be the time the Contractor is
required to complete the removal of all traffic control devices for lane closures according to the
time restrictions stated above and place traffic in the existing traffic pattern.
· The liquidated damages are Eight Hundred Fifty Dollars ($ 850.00) per hour.
ICT #3 – Wetland Planting
· The Contractor shall complete the required work of Wetland Grass Planting, as shown on the
plans, as directed by the Engineer and within any seasonal limitations for the specific task
included herein.
· The date of availability for this intermediate contract time is April 15, 2023.
· The completion date for this intermediate contract time is June 15, 2023.
· The liquidated damages are Eight Hundred Fifty Dollars ($ 850.00) per day.
PROJECT SPECIAL PROVISIONS - GENERAL
PERMANENT VEGETATION ESTABLISHMENT:
· Overall Contract time includes 1 year period to warranty Wetland Plantings.

Submit two subcontracts: DBE / NON-DBE with signatures.
Federal Requirements:
1. Post NCDOT’s Notice of Nondiscrimination and the Contractor’s own
Equal Employment Opportunity (EEO) Policy in conspicuous locations
accessible to all employees, applicants and subcontractors on the jobsite.
2. Physically incorporate the required Title VI clauses into all subcontracts
on federally-assisted and state-funded NCDOT projects, and ensure inclusion by
subcontractors into all lower-tier subcontracts.
3. Required Solicitation Language. The Contractor shall include the
following notification in all solicitations for bids and requests for work or
material, regardless of funding source: “The North Carolina Department of
Transportation, in accordance with the provisions of Title VI of the Civil
Rights Act of 1964 (78 Stat. 252, 42 US.C. §§2000d to 2000d-4) and the
Regulations, hereby notifies all bidders that it will affirmatively ensure that any
contract entered into pursuant to this advertisement, disadvantaged business
enterprises will be afforded full and fair opportunity to submit bids in response
to this invitation and will not be discriminated against on the grounds of race,
color, or national origin in consideration for an award. In accordance with
other related nondiscrimination authorities, bidders and contractors will also
not be discriminated against on the grounds of sex, age, disability, low-income
level, creed/religion, or limited English proficiency in consideration for an
award.”
USE OF UNMANNED AIRCRAFT SYSTEMS
· The Contractor shall adhere to all Federal, State and Local regulations and guidelines for the use
of Unmanned Aircraft Systems (UAS).
Equipment Idling Guidelines
· Exercise reduced fuel consumption and reduced equipment emissions during the construction of
all work associated with this contract. Employees engaged in the construction of this project
should turn off vehicles when stopped for more than thirty (30) minutes and off-highway
equipment should idle no longer than fifteen (15) consecutive minutes.
· Sheet 19 for guidelines
CARGO PREFERENCE ACT
· Privately owned United States-flag commercial vessels transporting cargoes are subject to the
Cargo Preference Act (CPA) of 1954 requirements and regulations found in 46 CFR 381.7.
Contractors are directed to clause (b) of 46 CFR 381.7 as follows: (see page 21)
EROSION AND SEDIMENT CONTROL/STORMWATER CERTIFICATION:
· National Pollution discharge Elimination System (NPDES) permit for the work is required.
· Provide a certified Erosion and Sediment Control/Stormwater Supervisor, Foreman and Installer
to manage the Contractor and subcontractor operations, ensure compliance with Federal, State
and Local ordinances and regulations, and manage the Quality Control Program. (To be provided)
WORK ZONE INSTALLER:
· Provide the service of at least one qualified work zone installer during the setup, installation, and
removal of temporary traffic control within the highway right of way. The qualified work zone
installer shall serve as crew leader and shall be on site and directing the installation and removal
of temporary traffic control. If multiple temporary traffic control installations or removals are
occurring simultaneously, then each shall have a qualified work zone installer.
(To be provided)
· The work zone installer shall be qualified by an NCDOT approved training agency or other
approved training provider in the safe and competent set up of temporary traffic control. For a
complete listing of approved training agencies, see the Work Zone Safety Training webpage.
PROJECT SPECIAL PROVISIONS - ROADWAY
NOTES TO CONTRACTOR:
· Monitoring for the presence of shellfish species (oysters, clams, mussels, etc.) will be performed
just prior to construction along the proposed footprint of the granite sill. Any shellfish that are
present will be relocated just offshore of the construction and sill footprint.
(Coastal Fed. To survey) (Stroud Engineering to mark limits)
· All new rip rap will be granite material.
· Borrow material will be classified as dead marine sand, sample will need to be provided to
Engineer for approval prior to placement. (Sample of current material and borrow material to be
provided by NCDOT)
· Grading, handling, moving, placing, shaping of existing limestone Rip Rap to accommodate
proposed typical sections will be incidental to LS grading.
· Temporary Access plan will be submitted to the Engineer 30 days prior to installation for
approval. Construction of earthen causeway will not be allowed for temporary access, except at
proposed access points and with approval by the Engineer.
· Existing Utilities shall not be disturbed. Contractor shall adhere to all OSHA requirements in
regard to Overhead Electrical Lines. Contractor will coordinate with Duke Energy for Rip Rap
placement around existing guy wires and poles. 7 days’ notice minimum, with meeting onsite
with Duke Representative prior to work. Further guidance and contact information will be
provided. (TA Loving to coordinate)
· Contractor will install Safety Fence around all Wood poles, Existing hydrants and
Telecommunication Pedestals to clearly mark these locations during construction.
· Lane closures associated with material deliveries and construction of this project will be
incidental to all other items.
· The permittee shall limit in-water work between February 1 to June 30 of any year to the
maximum extent practicable to protect juvenile fishes that may be in the vicinity and shall also
limit in-water work to the maximum extent practicable from April 1 through October 31 to avoid
additional impacts to submerged aquatic vegetation (SAV)
· The authorized structure and associated activity must not interfere with the
public’s right to free navigation on all navigable waters of the United States. No
attempt will be made by the Permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work for reasons
other than safety.
ADA COMPLIANT PEDESTRIAN TRAFFIC CONTROL DEVICES & PEDESTRIAN
TRANSPORT SERVICE:
· Pedestrian Transport Service plan narrative, drop-off, pick-up locations will be submitted to the
Engineer for approval prior to closing the sidewalk. Drop-off and pick-up locations shall not be
located within the work zone, must be located away from traffic and provide ADA accessible
access to pedestrians. (Submit transport service plan prior to closing sidewalk)
· The Contractor shall provide a Pedestrian Transport Service through and/or around the project
when a traversable, firm, stable, and slip-resistant path for pedestrians cannot be maintained
through the work area. At minimum, the Pedestrian Transport Service shall be on-call 24 hours
per day Monday thru Sunday and operate at no-cost to the users.
BURNING RESTRICTIONS:
· Open burning is not permitted on any portion of the right-of-way limits.
SIDEWALK, CONCRETE CURB & GUTTER
· Quantity has been provided to repair existing curb, gutter and sidewalk that has been
previously damaged due to erosion. A quantity has been established to replace what is
needed for construction access. It is not the intention to replace all onsite. Care should be
taken to protect Sidewalk, Curb and Gutter where possible.
OYSTER STRUCTURE
· Provide subcontractor information and method of construction. (NCDOT aware of pre-
qualification requirement – please let us know when submitted so that we can follow up
with Central.)
TREE PROTECTION FENCE
· Place tree protection fence around any to be saved and all utility poles, hydrants, etc.
FABRIC INSERT INLET PROTECTION DEVICE (HIGH FLOW)
· Insert Inlet Protection Device, of the type specified, in inlet structures (catch basins, drop
inlets, etc) in areas where asphalt or concrete may prevent the proper installation of a
Rock Inlet Sediment Traps Type C, or as directed. Submit product data to Engineer for
approval prior to installation. (To be submitted)
WETLAND GRASS PLANTING
· The Contractor shall be responsible for taking sufficient soil samples for testing by the
North Carolina Department of Agriculture and Consumer Services, Agronomic Division,
Soil Testing Section, to determine the soil pH and nutrient content. Samples shall be
taken in the presence of the Engineer. Results shall be received by the Engineer directly
from the North Carolina Department of Agriculture and Consumer Services. The
Contractor shall be responsible for the addition of fertilizer and/or other soil amendments
as needed to ensure livability of the wetland grass planting. (Grass plantings are long lead
time items -6 months, supplier “Lumber River” ordering material early will be essential
to make the planting window.)
PROJECT SPECIAL PROVISIONS – PERMITS
(Please see permit conditions included in contract, some errors occurred transferring verbiage)
CAMA Major Permit Condition(s):
· The permittee shall limit in-water work between February 1 to June 30 of any year to the
maximum extent practicable to protect juvenile fishes that may be in the vicinity and shall also
limit in-water work to the maximum extent practicable from April 1 through October 31 to avoid
additional impacts to submerged aquatic vegetation (SAV).
· All temporary fill within wetlands and waters of the State where no stone currently exists shall be
placed on geotextile fabric to facilitate total removal of the temporary fill upon completion of the
project.
· Turbidity curtains shall be used where practicable to isolate all in-water work areas from the
adjacent waters of the White Oak River, including but not limited to installation and removal of
the temporary construction trestle and temporary access ramps, and placement of fill material
within or adjacent to wetlands or waters of the State. The turbidity curtains shall be of sufficient
length and effectiveness to prevent a visible increase in the amount of suspended sediments in
adjacent waters. The turbidity curtains shall be properly maintained and retained in the water
until construction is complete. The turbidity curtains shall be removed when turbidity within the
curtains reaches ambient levels.
· Prior to planting, the permittee shall submit a final planting plan for the authorized Coastal
Wetland planting areas in writing to DCM for review and approval. The planting plan shall
include a list of proposed species as well as identify different planting zones.
DEQ
· The permittee shall limit in-water work between February 1 to June 30 of any year to the
maximum extent practicable to protect juvenile fishes that may be in the vicinity and shall
also limit in-water work to the maximum extent practicable from April 1 through October 31
to avoid additional impacts to submerged aquatic vegetation (SA V).
· In accordance with commitments made by the permittee, in order to protect the endangered
West Indian Manatee, Trichechus manatus, the permittee shall implement the U.S. Fish &
Wildlife Service's
· The permittee shall notify the N.C. Division of Marine Fisheries (DMF) Shellfish Sanitation
and Recreational Water Quality Section at 252-726-7021 before any fill activity occurs due to
the potential for runoff or turbidity that could necessitate the need for a temporary closure
within the vicinity.
· In accordance with commitments made by the permittee, the permittee shall conduct a survey
for shellfish within authorized fill areas prior to construction.
· The authorized temporary construction trestle shall be elevated a minimum of 2 feet above
the normal high water level of the White Oak River as measured from the low chord of the
structure.
· Material excavated at the project site may be used in fill areas associated with the project or
shall be removed from the site and taken to a high ground location. (Waste site to be
submitted)
· All construction equipment access shall be through the use of existing high ground areas,
temporary construction · trestles and two temporary access ramps.
· Construction staging and stockpile areas shall be located staging only in area, upland and not
areas, in on any the wetlands authorized or waters of the temporary State outside construction
of the trestle, authorized or within impact the areas.
· The installation of piles for the temporary construction trestle shall be accomplished by use of
pile to utilize driving and/or another the type use of of pile a vibratory installation, hammer.
additional Should the authorization permittee from and/or DCM its shall be contractor
required.
USAMCE
· The Permittee shall install and maintain, at his expense, any safety lights and signals prescribed
by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. It is
recommended, at a minimum, the completed structure be equipped with reflective structures on
both ends to ensure safe navigation within the vicinity of the structure.
(Permit requires PVC pipe at 50’ On Center with yellow reflective tape 3’ above mean high
water)
· The permittee will adhere to the Submerged Aquatic Vegetation (SAV)
Monitoring Plan, Version 3, dated May 4, 2022 (attached) with the following
modification to the “Section 4 Proposed Mitigation and Monitoring Plan” found on
page 9:
· The permittee shall employ all sedimentation and erosion control measures necessary to prevent
an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This
shall include, but is not limited to, the immediate installation of turbidity curtains, silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must
remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973
(North Carolina General Statutes Chapter 113A Article 4).
Additional items discussed:
· Onsite Environmental Meeting with all permitting Agencies scheduled for Oct 6.
· No moratorium for this project, permit condition request contractor limit in water work to
the extent possible.
· Access points are permitted where shown on the plans, no additional access points will be
granted.
· DIV Environmental will coordinate a separate meeting to discuss implementing NCDOT
required actions to meet permit conditions.
· Contractor proposes 3 phase construction
· Contractor proposes Access Trestle supported on mats vs. pile supported, DEPT and
NCDCM has concern about the Mat Supported trestle meeting the permit conditions.
Contractor to submit proposal, sketch, and pictures. This method was used to
construction living shoreline at CCC in Morehead City. Further discussions to be held.
· Contractor request clarification no shifting traffic. Griding vs Water blasting paint
markings. DEPT requires water blasting on bridge. Contractor expresses concern about
performing traffic shift in one night due to paint not adhering to wet surface. DEPT
allows removal of paint/poly on bridge 24 hours prior to traffic shift to allow surface to
dry. Remove no more markings than needed.
· Contractor request direction on re-striping the entire bridge. DEPT will review budget as
this item of work becomes available.
· Contractor express concern about deleting center turn lane. Proposes delineators on
double yellow line. DEPT will review traffic concerns once temporary traffic pattern is in
place to determine if this necessary. Delineators are not currently part of the TMP plans
requirements.
· Town of Swansboro advises of upcoming events:
o Mullet Festival Oct 7 to Oct 9
o Candlelight event - Saturday Nov 12th
o Holiday Festival – Friday Nov 25th
