When providing an additional information response to the Division, please provide a letter addressing each comment and provide a reference as to the location of the requested information in the updated application package. A. Cover Letter: • 1. The cover letter requests that the permitted average monthly daily flow be reduced from 4 million gallons per day (MGD) to 3.925 MGD. Division review of the permitted annual loading rates in Attachment B of the permit issued October 22, 2010, indicates that removal of Field B upon completion of Phases I and II will result in an average daily flow disposal reduction of 99,802 gallons per day (GPD). Currently, all permitted irrigation fields combined are capable of disposing 5,009,761 GPD, which exceeds the permitted average daily flow of 4 MGD. Therefore, in lieu of approving the flow reduction request, the Division suggests that the monthly average daily flow remain at 4 MGD, but the daily maximum flow rate be reduced to 4,909,959 GPD to reflect the loss of Field B. The Division suggests that the monthly average daily flow remain the same because even with the loss of Field B, the remaining irrigation fields have more than enough capacity to accommodate 4 MGD of treated effluent. C. Application: 1. Application Item IV.4. indicates that the Applicant intends on submitting an Erosion and Sedimentation Control Plan (E&SCP) application on or about May 28, 2013. Per 15A NCAC 02T .0105(c)(6), the application for the E&SCP shall be submitted to the Division of Energy, Mineral and Land Resources prior to the issuance of this non -discharge permit. 2. Amend Application Item N.6. to reflect the permitted monthly average daily and maximum daily flows based on the comment in Section A — Cover Letter. 3. Per Application Instruction P and 15A NCAC 02T .0105(c)(10), amend Application Item IV.9. to state that documentation of the presence or absence of threatened or endangered aquatic species has been provided. Amend Application Item IV.10. to include the information for h p p replace the to -be -abandoned MW-3. Please note that the new monitoring well cannot be named MW-3, therefore must be renamed (i.e:,MW=.S3Aor MW-13). 5. Application Item VI.3. states that the 27 million gallon (MG) lagoon contains a discharge point. However, review of the Engineering Plans does not indicate an overflow or spillway for the 27 MG lagoon. Please amend. 6. Please amend Application Item VII.8. to include the post -Phase I acreage for Field B. Mr. Michael Miller May 23, 2013 ti Page 3 of 3 I. Engineering Plans: 1. Per Application Instruction I, please submit two set of Engineering Plans in 11 x 17-inch format. 2. A scaled map of the site, with topographic contour intervals not exceeding 10 feet or 25 percent of total site relief and showing all facility -related structures and fences within the wastewater treatment and storage systems. b. The location of all proposed, existing and to be abandoned wells (including monitoring), streams, springs, lakes, ponds, & other surface drainage features within 500 feet of all wastewater treatment and storage systems. c. Actual most restrictive setbacks as required by 15A NCAC 02T .0506(a) and (b), and as listed in Application Item VIII.3. d. Dewberry MEMORANDUM Date: 2/28/2013 To: Jon Risgaard, NC DENR Aquifer Protection Section From: Katie Jones, Dewberry Dan Wilkinson, Dewberry Subject: Campbell's Soup Supply Company - Non -Discharge Permit Modification — Information Required The purpose of the memorandum is to summarize the applicability of sections outlined in the Instructions for Form WWIS 08-11 & Supporting Documentation in accordance with15A NCAC 02T .0500 — Wastewater Irrigation Systems to the Campbell's Soup Supply Company (Campbell's) proposed project and associated non -discharge permit modification application. The proposed project is the installation of two irrigation storage basins (nominal volumes — 27 million gallon (MG) and 3 MG). The basins will increase the available storage at the facility by a factor of approximately 5, allowing Campbell's the flexibility to store more wastewater. Based on the nature of the project it is Dewberry's opinion that several of the sections outlined in the instructions for Form WWIS 08-11 are not applicable to the current project and therefore do not need to be included as part of the permit modification application. The table below summarizes these sections and our reasoning for their exclusion. Instruction Section Explanation for Exclusion f !"-Property Ownership Documentation 1,// Campbell's has demonstrated ownership of the proposed project site in previous permit applications. Soil Evaluation No new irrigation sites are proposed. Agronomist Evaluation No new irrigation sites or new crops for existing irrigation sites are proposed. G. Hydrogeologic Report This information has been previously submitted. H. Water Balance The proposed project increases the available storage by a factor of five, while neither reducing the irrigable acres nor increasing the permitted flow rate. L. Site Map A map of the proposed irrigation storage basins will be provided; however the remainder of the site will remain unchanged and previous site maps have been submitted. M. Power Reliability Plan This information has been previously submitted. N. Operation and Maintenance Plan An Operation and Maintenance (O&M) Plan for the new irrigation storage basins will be provided; however, the entire O&M Plan for the treatment facility and existing irrigation system will remain unaltered from previous versions submitted. O. Residuals Management Plan The proposed project does not include new, expanded, or replacement wastewater treatment systems. P. Additional Documents Certificate of Public Convenience and Necessity Final Environmental Document Floodway Regulation Compliance Not a Privately -Owned Public Utility Not using public monies or lands subject to the North Carolina Environmental Policy Act Proposed project is not located within the 100-year floodplain Proposed project is not for a Home/Property Owners' Page 1 of 2 February 28, 2013 Page 2 of 2 Operational Agreements Threatened or Endangered Aquatic Species Documentation Wastewater Chemical Analysis Association or Developer Proposed project is on an existing land application sprayfield Wastewater analysis previously provided with other application packages Application Section Explanation for Exclusion III. Consultant Information 2. Soil Scientist 3. Geologist 4. Agronomist No new soil evaluation, agronomist evaluation, or hydrogeologic reports are necessary. IV. General Requirements 9. Documentation for presence of absence of threatened or endangered species 10. Existing groundwater well network 9. Proposed project is on an existing land application sprayfield. 10. All existing monitoring wells will remain unaltered by the proposed project. V. Wastewater Treatment Facility Design Criteria Proposed project does not alter the existing WWTP. VII. Irrigation System Design Criteria Proposed project does not alter the existing irrigation system. With the sections detailed above not applicable, Dewberry envisions the permit modification applicable will consist of sections: A. Cover Letter B. Application Fee C. Wastewater Irrigation System (FORM: WWIS 08-11) Application — applicable sections only I. Engineering Plans J. Specifications K. Engineering Calculations P. Additional Documentation — Existing Permit. Dewberry-
