Being that certain lot or parcel of land situated in Harlowe
Township, Carteret County, North Carolina which is more particularly
described as follows:
Being all of waterfront Lot #21 in Chadwick Shores Plantation
subdivision, lying to the east of SR #1155 Windberry Road. Included
herein for this waterfront lot is the non -warranty quitclaim
conveyance of any and all right, title, interest or claim the
Grantor has or may have in the marsh / wetlands lying between the
uplands of this Lot and the flow of the adjoining creek, this
quitclaim area delineated as "Public Domain" by the Incorporated
Subdivision Plat. However, as to this "Public Domain" area, no
warranty is made as to the title being conveyed. This conveyance
also includes all littoral and riparian rights associated with this
waterfront lot.
This lot description for Carteret County Tax Parcel
*6388.01.37.0710000 is in accordance to the below referenced
Subdivision Plat for Chadwick Shores Plantation which is
incorporated herein .for a more perfect and detailed description.
Restrictive Covenants:
This lot, the other lots and all of the realty in Chadwick Shores
Plantation Subdivision are subject to that Declaration of Covenants,
Conditions and Restrictions by North Carolina Coast S Lakes, LLC,
recorded in Book 1283, Page 113 and in Book 1299, Page 221 of the
Carteret County Registry. By acceptance of this Deed the Grantee
agrees for himself, his heirs, successors and assigns to be bound by
and abide with all of the provisions set forth in the said
Declaration which are designed to ensure the desired residential
development and future residential use of this lot and the
surrounding lots comprising Chadwick Shores Plantation.
Furthermore, the Grantee, by acceptance of this Deed, becomes a
member of the Chadwick Shores Plantation Homeowners' Association,
Inc. and agrees to be bound by all of the rules, regulations and
bylaws of the said Association or promulgated by the Association,

those applicable limitations set forth in that North Carolina
Division of Water Quality Stormwater Management Permit recorded with
and as a part of the above referenced Declaration of Covenants,
Conditions and Restrictions.
Incorporated Subdivision Plat:
This Description is in accordance to those Subdivision Plats for
Chadwick Shores Plantation by Simon R. Cox, PLS, of McDavid
Associates, Inc. in Farmville, North Carolina, recorded in Map Book
31, Pages 562-566 and in Map Book 31, Page 657 of the Carteret
County Registry. These Plats are incorporated herein for a more
complete and accurate description for Chadwick Shores Plantation and
the lot being conveyed herein.

TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all
privileges and appurtenances thereto belonging to the Grantee in fee
simple.
And the Grantor covenants with the Grantee, that the Grantor is
seized of the premises in fee simple, has the right to convey the same in
fee simple, that the title is marketable and free and clear of all
encumbrances, and that Grantor will warrant and defend the title against
the lawful claims of all persons whomsoever except for the exceptions
hereinafter stated.

Water Mark" as shown on the referenced Incorporated Subdivision Plat

To Whom it may concern,
Our project is located at 221 Settlement Lane in Newport, NC. We are proposing
a new docking facility. The docking facility will have a 6'x760' dock walkway, 10'x16' dock
platform, Xx12' gangway, 6'x20' floating dock, and a 13'x13' boat lift. The purpose of this
project is for recreational boating, fishing and wildlife observation. Logging malts will be used
for access to support excavator. Thank you for your time and consideration on this proposal.

Narrative Description:
The proposal is located adjacent to 221 Settlement Lane within Harlowe Creek near Newport,
Carteret County. This property is currently developed with a residence. This proposal is for private
use. The adjacent property to the property to the south is similarly developed and the adjacent
property to the north is undeveloped.
The elevation of the high ground on the property is approximately 4' above the normal high water
level. Vegetation on the property mainly consists of pine trees, lawn grasses, and Coastal Wetlands.
There is approximately 530' of shoreline on this 8-acre tract.
Water depths in the project area range from —0.0' to —2.0' nlw. The subaqueous substrate is soft
with shell. There is not a Federal Channel in the nearby vicinity of the project area. There is not a
cultural resource in the project area. This waterbody is approximately 188' across at this location.
These estuarine waters are classified as a Primary Nursery Area. Submerged aquatic vegetation
(SAV) is not present within the project area. This waterbody is closed to shellfish harvest and is
classified as SA; HQW.
Proposed Development:
The applicant is proposing to construct a 1-slip docking facility within Harlowe Creek in the
Chadwick Shores subdivision of Mill Creek. The proposed development would take place adjacent to
221 Settlement Lane, Carteret County. This proposal is for private use.
The applicant is proposing to construct a fixed pier, fixed platform, floating platform, and a boatlift.
The proposed pier would be 6' wide and 760' long. The proposed pier would originate at the high
ground on the property and traverse the Coastal Wetlands into Harlowe Creek. At the pier's
waterward terminus, the applicant is proposing a fixed "L" platform that would be 10' by 16'. On the
north side of the proposed fixed platform, the applicant is proposing a 13' by 13' boatlift. On the
southern terminus of the platform, the applicant is proposing a 3' by 12' aluminum gangway
connection to a 6' by 20' floating platform. The water depth within the proposed boatlift area is
-1.0' nlw.

Anticipated Impacts:
This proposal would not pose a hazard to navigation. The proposed docking facility would
extend approximately 550' waterward of nhw, and 40' waterward of the shoreline into this 188'-
wide tributary. This proposal would impact shallow bottom Primary Nursery Area habitat, as the
proposed boatlift would be sited in a location with -1' nlw. The proposal would shade 1,020
square feet of high ground, 3,300 square feet of Coastal Wetlands, and usurp 2,360 square feet of
Public Trust Area.
Traditional marine construction methodology would be utilized during the construction of this
project. Turbidity impacts are not anticipated during the construction activities within Harlowe
Creek. This waterbody is classified as a Primary Nursery Area. There is no SAV habitat present
within the project area. This waterbody is closed to shellfish harvest.
