Subject: Approval of Neuse River Basin Riparian Buffer Impacts with Additional Conditions –
Addendum
Upper Walnut Creek Sanitary Sewer Improvements-Modification of Mitigation

Dear Mr. Hall:

An Authorization Certificate per the Neuse River Riparian Buffer Protection Rules for the Town of Apex
was issued on January 8, 2021. On September 23, 2022, the Division of Water Resources (Division)
received a modification request from Kimley-Horn. This modification request involves modifying the
mitigation banking information for the project. This addendum is in addition to prior approvals and
addendum for this project.

By copy of this correction letter, the Authorization Certificate is modified, as described below.
1. Mitigation must be provided for the proposed impacts as specified in the table below. The Division
has received an acceptance letter from NCDEQ Division of Mitigation Services (DMS) to meet this
mitigation requirement. Until DMS receives and clears your payment, and proof of payment has
been provided to this Office, no impacts specified in this Authorization Certificate shall occur. For
accounting purposes, this Authorization Certificate authorizes payment to DMS to meet the
following compensatory mitigation requirement [15A NCAC 02H .0506(b)(6)]:

the review of the Division under section the Neuse River Riparian Buffer Rules as described in 15A NCAC
