RISER Secretary BRAXTON DAVIS Director SEND VIA EMAIL NORTH CAROLINA Environmental Quality October 3, 2022, 2022 Orton Plantation Holdings, LLC State Permit No. 123-20 c/o Steve Morrison (Agent) 3805 Wrightsville Avenue, Suite 15 Wilmington, NC 28403 Dear Mr. Morrison, This is with reference to the request received on September 28, 2022 by DCM to refine State Permit No. 123-20, which was originally issued to Orton Plantation Holdings, LLC on December 23, 2020 for an elevated boardwalk and bridge maintenance adjacent to Lilliput and Allen's Creek in Winnabow, Brunswick County. State Permit No. 123-20 is due to expire on December 31, 2023. The action proposed in your submittal is to re -align the permitted elevated boardwalk adjacent to Allen's Creek to a linear east -west alignment (see Sheet 2 of 3). The boardwalk length would be reduced from 1,417 ft. long by 6 ft. wide to 1,335 ft. long by 4 ft. wide. The elevation is also proposed to change to comply with local floodplain requirements. The boardwalk would be elevated so that the structural cross members are at 10.4 ft. at NAVD88 (see Narrative). No additional development is proposed and the boardwalk would not require any excavation or fill activities. Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit #123-20, as described in your request dated September 28, 2022. By copy of this letter we are notifying the US Army Corps of Engineers and the Division of Water Resources of our action. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits. The piling -supported walkway is being changed from a relatively circular routing to a more linear east -west alignment as shown on the enclosed figures. The walkway dimensions are being changed from a 1,417' length by 6' width to a 1,335' length by 4' width. In addition, the elevation of the walkway has been increased so that the structure's cross members are at 10.4' NAVD88 (1' above the base flood level) to comply with the local floodplain requirements. The approved No -Rise Certification from the Brunswick County Floodplain Manager is attached. As with the existing permit, there are no excavation or fill activities proposed.
