The comments from the email from Margie DeBerry dated September 13, 2022, and the project's associated responses (in blue) are listed below. 1. 2x hard copies of the Application with the following corrections made (These items are required per 15A NCAC 02H .1042(2)(a) and per Section VI, 1 of the Application): a. Section III, lb — Please provide the contact information (street address, city, state, zip) for the Applicant. CDC — Updated. b. Section III, 2b — Please provide the contact information (street address, city, state, zip, phone, email) for the Property Owner. CDC — Updated. Section IV, 10 & 11 — Per 15A NCAC 02H .1003(3)(b) any off -site drainage area not bypassed around an SCM must be accounted for at its full build -out potential. This can be accomplished by having the property owners enter into a legal agreement limiting the amount of BUA and drainage area that can be directed from the off -site area to the SCM or by accounting for the off -site area as 100% BUA (its full build -out potential). Please either bypass the off -site component of the drainage area around the SCM or account for the off -site portion of the drainage area at its full build -out potential. Ix original, signed & notarized hard copy of the O&M Agreement Form (This item is required per 15A NCAC 02H .1042(2)0) and per Sections V & VI, 3 of the Application). The provided O&M Agreement form is missing the cover page and not signed by the Applicant/notarized. This form can be found on our website at the following address: https:Hdeq. nc. Gov/about/divisions/energy-mineral-and-land- resources/stormwater/stormwater-program/stormwater-design. Please note that a complete O&M Agreement Form will have 2 or more pages and uses macros to generate the relevant sheets based on the information entered into the cover page. NOTE: It is recommended to get a second copy of this form signed & notarized for the Applicant's records (it will be helpful when they go to record it with the Register of Deeds). CDC — The supplemental page has been printed and included with the resubmittal. 3. Ix copy of the USGS topo map showing the correct location of the project. It is noted that a USGS map was provided, however, the project site location as indicated does not correspond to the actual project location. CDC — The "Hydrology and Erosion Control Study" has been updated to reflect the revisions to the bypass drainage. The USGS map is included in Appendix A of this document. 4. Ix hard copy of official documentation showing that the Applicant (Patton Farm Development Group, LLC) is in good standing with the Secretary of State and showing the title and position information for the signing official (These items are required per 15A NCAC 02H .1040(l), .1042(2)(b), and per Section VI, 11 of the Application). CDC — A print out of the Secretary of State search results for the developer is attached. 5. 2x signed & sealed hard copies of a plan sheet showing the following: a. Wetland delineation or a note on the plans stating that there are no wetlands located on -site. This item is required per 15A NCAC 02H .1042(2)(g)(iii) & Section VI, 8m of the Application. Please also list the name of the individual that made this determination in a note on the plans. CDC — It is our understanding that there are no wetlands on the site. The Developer has hired Clear Water Environmental Consultants to complete an evaluation of the site. Their determination is pending and should be available within the next week. We will forward this determination when available. If wetlands are fond on site, we will contact NCDEQ and modify the plans, as necessary. b. Drainage area delineation to each proposed SCM (This item is required per 15A NCAC 02H .1042(2)(g)(iv) & Section VI, 8o of the Application). It is noted that drainage area maps were included in the Hydrology and Erosion control study, however the drainage area must also be shown on a plan sheet. CDC — A gray dashed line has been added to Sheet C400. A label has been added to identify this line. Patton Cove Subdivision September 29, 2022 Page 3 c. Planting plan showing details of the vegetated shelf (This item is per 15A NCAC 02H .1042(2)(i) and 15A NCAC 02H .1053(l 1)). CDC — Notes have been added to C402. d. Stormwater maintenance access and easement. This item is required by General MDCs 8 & 9 (15A NCAC 02H .1050(8) & (9)). CDC — An easement is labeled from right of way to and around the SCM on C402.
