On September 1, 2022, during the compliant investigation it was documented you had excessive
ponding with runoff into the edge of the woods from a spray event a few hours earlier. No waste
reached the waters of the state. Mr. Warren made a dirt berm at the woods line to stop the flow of
waste.
Required Corrective Action for Violation 1:
Thank you for putting in the dirt berm and recover of waste from the site. In the future monitor
this pull as needed to prevent this from happening again.
Violation 2:

On September 1, 2022, it was documented that Mr. Warren was distracted by other chores and
failed to return in time to adjust the gun to prevent this excessive ponding and run off. In
addition, he failed to inspect the application field for ponded waste during or after the spray
event. He was not aware it was ponded and running into the edge of the woods until DWR staff
showed him.
Required Corrective Action for Violation 2:
In the future, inspect the spray application site, equipment, and all components of the waste
application system to ensure this does not happen again.
The Division of Water Resources requests that, in addition to the specified corrective action
above, please submit the following items on or before 30 days from receipt of this letter:
1. An explanation from the OIC for this farm regarding how violation occurred.
2. A list from the OIC concerning the steps that will be taken to prevent these violations
from occurring in the future.
Failure to comply with conditions in a permit may result in a recommendation of enforcement
action, to the Director of the Division of Water Quality who may issue a civil penalty assessment
of not more that twenty-five thousand ($25,000) dollars against any "person" who violates or
fails to act in accordance with the terms, conditions, or requirements of a permit under authority
of G.S. 143-215.6A.
