4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The Site is mostly forested and undeveloped, however, there are four unoccupied structures on the property. Evidence of past agricultural operations on the Site include cleared areas
visible in historic aerial imagery. The majority of the canopy consists of mature pines, especially in the eastern half of the Site. The drainages in the western portion of the Site contain more
hardwood trees. The topography of the Site ranges from a low point of +/- 260 feet above mean sea level (msl) at the northwestern property corner where the drainage exits the Site, to a
high point of +/- 300 feet msl in the southeastern corner of the Site adjacent to East Stewart Street. Surrounding areas are a mix of residential development, commercial development,
agricultural land and woodland.

The purpose of the project is to construct a residential development at the site to help meet the need for housing in the area.

The overall project is a single-family residential subdivision with residential streets and utilities that will connect to existing adjacent streets and utilities. The proposed impact results from a
single sewer line crossing on the site. Heavy equipment typically used for utility installation projects (e.g., backhoes, bulldozers, etc.) will be utilized.

1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
The only impact proposed for the development is the needed sanitary sewer connection to the existing sewer line, maintained and owned by Harnett
Regional Water. The proposed sewer crossing is aligned to cross the stream as perpendicularly as possible, while still connecting to the existing
manhole within the existing sewer line on the other side of the channel. The upstream manholes on the existing sewer line have inverts which are set
much higher, therefore, this location is the only feasible way to get the proposed sanitary sewer from the northern portion of the Site to connect to the
existing line. Directional drilling or boring would not be feasible at this location as the existing manhole is within the wetland area and the impact for a
receiving pit would create more impact to the streams & wetlands than the proposed open cut method. No road crossings of streams are proposed. Lots
were positioned to avoid additional fill in wetlands and streams. Construction fencing will be used to define the construction corridor and prevent any
accidental, additional impacts. Silt fencing will be installed to provide additional protections from stormwater runoff.

Coffer dams and a temporary bypass pump will be utilized to ensure that all installation activities are constructed in the dry.

Per the NC DWQ April 2004 Version 2.1 Cumulative Impacts policy, small scale residential development projects have a "low potential for cumulative
impact" since the project already in a developed landscape (i.e. existing residences and development in the vicinity) and the area already contains the
necessary infrastructure (i.e. sewer, water, electricity, etc.). The project drains to Black River, which is Class C; Swamp waters (Sw), (i.e. not HQW or
ORW). We anticipate the NCDWR will advise us if a qualitative or quantitative analysis is needed.

Properties", and one is identified as "Study List - Determination of Eligible Property". The Coats School (HT0028) was a 1920s brick Colonial Revival
school and gymnasium building in the northeast quadrant of the intersection of East Stewart Street and North McKinley Street. The school was
demolished and removed between 2009 and 2013 based on historic aerial imagery. The lot where the school was is currently vacant.

On behalf of Lee Smith, T&L Coats, LLC (applicant), please find attached a complete application and
supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) that
the activities associated with the proposed development of the Messer Parcels (Project) may proceed under
Nationwide Permit (NWP) 58. A courtesy copy of this application is being provided to the NC Division of Water
Resources (NCDWR) because proposed jurisdictional wetland and stream impacts are below notification
thresholds.
Project Purpose and Location
The purpose of the proposed project is to construct a residential subdivision to help meet the housing needs in
the area. The +/12.28-acre tract is located +/- 0.25 mile east of the intersection of East Stewart Street (Hwy 27)
and NC 55 intersection, on the north side of East Stewart Street in Harnett County, NC. The coordinates of
35.4149°N, 78.6692°W generally correspond to the center of the Site.
The Site is mostly forested and undeveloped, however, there are four unoccupied structures on the property.
Evidence of past agricultural operations on the Site include cleared areas visible in historic aerial imagery.
Surrounding areas are a mix of residential development, commercial development, agricultural land and
woodland.
Project Detail
The proposed Project consists of the construction of a residential subdivision with associated roads, driveways
and utilities. Municipal sewer and water are available to the site.
Access to the Site will be provided via East Stewart Street along the southern property line. The site is serviced
by municipal water and sewer. Heavy equipment typically used for utility installation projects (e.g., backhoes,
bulldozers, etc.) will be utilized.
A review of the NC Natural Heritage Program dated June 30, 2021, lists no federally listed T&E species on or
within 1.0-mile of the Site.
The Site itself is not listed as a historic property. There are 21 historic properties located within 1.0 mile of the

Project History
Mr. David Gainey of Sage Ecological Services, Inc., performed a wetland and stream delineation at the site. A
Preliminary Jurisdictional Determination (PJD) request was submitted to the USACE on December 28, 2021
(SAW-2022-00056). A response has not been received as of the date of this application.
Avoidance and Minimization
Impacts to streams and wetlands have been carefully considered to avoid permanent impacts. This project has
been designed to meet purpose and need while avoiding and minimizing impacts to onsite natural resources to
the greatest extent practicable. There are 0.884 acres of onsite wetlands, of which only 0.029 acres are proposed
to be temporarily impacted for a sewer line installation. There are 340 linear feet of stream onsite, and only 31
linear feet will be temporarily impacted for the sewer line installation. Construction fencing will be used to define
the construction corridor and prevent any accidental additional impacts, while silt fencing will be installed to
provide additional protection from runoff.
Project Impacts
Only 31 linear feet of stream will be temporarily impacted, and temporary wetland impacts total 0.029 acres.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database indicates that
there are no records for rare species, important natural communities, natural areas, and/or
conservation/managed areas within the proposed project boundary. Please note that although there
may be no documentation of natural heritage elements within the project boundary, it does not
imply or confirm their absence; the area may not have been surveyed. The results of this query
should not be substituted for field surveys where suitable habitat exists. In the event that rare
species are found within the project area, please contact the NCNHP so that we may update our
records.
The attached 'Potential Occurrences' table summarizes rare species and natural communities that
have been documented within a one -mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one -mile
radius of the project area, if any, are also included in this report.
If a Federally -listed species is found within the project area or is indicated within a one -mile radius of
the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for
guidance. Contact information for USFWS offices in North Carolina is found here:

Please note that natural heritage element data are maintained for the purposes of conservation
planning, project review, and scientific research, and are not intended for use as the primary criteria

If the template file is not first saved to your local disk, the data validation macros will not function.
** Please be aware that the .shp, .shx, .dbf, and .prj files at a minimum must be received in order to be a complete submission.
For Aquatic Resources, ORM must receive both an AR worksheet and a shapefile in the submission.
- In the Shapefile, each geometry must include an attribute for WatersName and each WatersName MUST be unique within and across all files.
- Furthermore, there must be a one to one relationship between the WaterName in the AR Worksheet and the WatersName in the Shapefile.
- When uploading Aquatic Resources via shapefile, the Latitude / Longitude in the AciResources worksheet is not required.
For Project Boundary, the submitted file must contain only one Geometry.
